Abstract

Badan Permusyawaratan Desa (BPD) sebagai badan legislative di tingkat Desa sekaligus wakil dari masyarakat Desa diberikan kewenangan penuh untuk menerapkan budaya demokrasi di tingkat Desa, baik dalam hal pengawasan terhadap pemerintah Desa maupun dalam hal penampungan aspirasi masyarakat Desa. BPD diharapkan menjadi wadah menampung aspirasi bagi masyarakat Desa untuk menyampaikan ide atau gagasan mereka agar dapat terealisasi dalam pembangunan dan kebijakan yang ada di Desa, berperan aktif dalam hal pelaksanaan tugas dan fungsinya. Tujuan dari penelitian ini adalah untuk mengetahuai peran BPD Desa Sadha, Kecamatan Golewa Selatan, Kabupaten Ngada dalam pembentukan peraturan Desa. Tipe penelitian yang digunakan dalam penelitian ini adalah penelitian deskriptif kualitatif. Analisa data pada penelitian yang bersifat kualitatif berlandasan pada penggunaan keterangan secara lengkap dan mendalam menginterprestasikan data tentang variable, bersifat non-kulitatif dan dimaksudkan untuk melakukan eksplorasi mendalam dan tidak meluas terhadap fenomena. Hasil penelitian menunjukkan bahwa kinerja BPD dalam bidang aspirasi masyarakat meliputi cara BPD dalam menampung aspirasi masyarakat. Cara yang dilakukan BPD dalam menampung dan menyalurkan aspirasi adalah dengan keterbukaan BPD dengan masyarat setempat.

Abstract

This research aims to find out how the implementation of parking retribution in Bajawa City and the supporting and inhibiting factors of parking retribution implementation. This research uses a descriptive qualitative approach with empirical legal research type. The data collection techniques in this research are observation, interview, and document study. The data analysis techniques used in this research are data reduction, data presentation, and conclusion drawing. The results showed that the implementation of parking levies in bajawa city is not good enough seen from the results of research on parking lots, parking rates, the work of parking attendants, and community responses regarding parking where the four aspects have not been implemented properly where parking lots are still narrow, parking attendant services have received a lot of criticism from the community Parking rates set by the Ngada Regency Government are correct but the results of the levy itself are still very dependent on whether or not visitors are busy. The work of the parking attendants is not optimal because the parking attendants on duty have never received special training, so the work of the parking attendants has received a lot of criticism from the community. Parking attendant services to parking service users are said to be ineffective and need to be improved. Supporting factors in the implementation of parking levy collection are joint operations and the role of mass media as a source of information for the community. The inhibiting factors in the implementation of parking levy collection are the emergence of illegal parking, lack of awareness of parking attendants and the public in traffic and inadequate parking facilities.

Abstract

The magnitude of potential and knowledge needs in agriculture requires community empowerment, especially farmers. Community empowerment is an activity or way in an effort to make the community more empowered or able to overcome problems in themselves and their environment. Gunung Village, Kota Komba District, East Manggarai Regency until now has not received maximum yields due to the influence of community knowledge about how to farm properly and correctly, therefore the community needs knowledge in agriculture, it is required to empower the community, especially farmers as regulated in Law of the Republic of Indonesia Number 19 of 2013 concerning the Protection and Empowerment of Farmers Article 1 CHAPTER 1. This makes the basis for research to find out the government's ability to empower farmers in Mountain Village, Kota Komba District, East Manggarai Regency. The type of research used is empirical juridical research or called field research, which examines applicable legal provisions and what happens in reality in society.The results show: (1) That in the implementation of farmer empowerment in Gunung Village, the village government collaborates with the agriculture office to socialize education and training, counseling and mentoring as well as the development of a marketing system for agricultural products to the village community to improve agriculture in the village, (2) supporting factors in empowering farmers in Gunung Village include the Budget, leadership and Power of the Village Head, The Government has a good relationship with the community, while the inhibiting factors in empowering farmers in Gunung Village include community attitudes, and low skills of farmers.

Abstract

Munculnya kegiatan Pedagang Kaki Lima yang mengganggu ketertiban umum seperti berjualan di pinggir jalan dan segala akibatnya yang sekarang melanda Kabupaten Manggarai, maka Pemerintah daerah Kabupaten Manggarai menetapkan Peraturan Daerah Kabupaten Manggarai Nomor 2 Tahun 2001 tentang Ketertiban Umum. Metode penelitian ini merupakan Penelitian yuridis empiris yaitu penelitian terhadap efiktifitas hukum, yang membahas hukum beroperasi dalam masyarakat. hasil penelitian dan pembahasan sebelumnya Peneliti dapat menyimpulkan bahwa: Satuan Polisi Pamong praja Kabupaten Manggarai telah melaksanakan kewenangannya dalam menertibkan Pedagang Kaki Lima walaupun masih banyak kewenangan yang belum dilakukan secara optimal. Melakukan tindakan penertiban non yustisial terhadap warga masyarakat, aparatur, atau badan hukum yang melakukan pelanggaran atas Perda dan/atau Perkada. seperti melakukan teguran lisan/tertulis serta melakukan pemberhentian sementara kepada Pedagang Kaki Lima yang melanggar Peraturan Daerah. Menindak warga masyarakat, aparatur, atau badan hukum yang mengganggu ketertiban umum dan ketenteraman masyarakat. Melakukan tindakan penyelidikan kepada warga masyarakat, aparat daerah, atau badan hukum yang diduga melakukan pelanggaran atas Perda dan/atau Perkada. Melaksankan kinerja administratif terhadap warga masyarakat, aparat, atau badan hukum yang melakukan pelanggaran atas Perda dan/atau Perkada.

Abstract

Penelitian ini dilatarbelakangi masih banyaknya keluhan masyarakat terhadap pelayanan Administrasi Dinas Kependudukan dan Pencatatan Sipil Kabupaten Rote Ndao antara lain dibutuhkan waktu yang lama untuk mendapatkan dokumen. Sumber penelitian ini penulis menggunakan data primer dan data sekunder. Adapun teknik pengumpulan data dalam Penulisan hasil ini penulis menggunakan teknik wawancara, observasi, dan dokumentasi. Penduduk Kabupaten Rote Ndao sebanyak 147.385 jiwa yang terdiri atas 74.226 laki-laki dan 73.159 perempuan. Tujuan penelitian ini adalah untuk mengetahui Pelaksanaan Tugas dan fungsi dinas kependudukan dan catatan sipil kabupaten Rote Ndao serta faktor yang mempengaruhi pelayanan administrasi kependudukan. Penelitian ini menunjukan bahwa Dinas Kependudukan dan Pencatatan Sipil Kabupaten Rote Ndao telah melakukan Tugas dan Fungsi secara maksimal berdasarkan undang-undang nomor 24 tahun 2013. Adapun faktor yang mempengaruhi pelaksanaan tugas dan fungsi Dinas Kependudukan dan Pencatatan Sipil Kabupaten Rote Ndao Antara lain kurangnya sumber daya manusia, kurangnya sarana prasarana serta kurangnya kesadaran masyarakat akan pentingnya pengurusan Kartu Keluarga dan kartu Tanda Penduduk. Pelaksanaan Dinas Kependudukan dan Pencatatan Sipil Kabupaten Rote Ndao dilakukan secara terpusat sehingga terkadang dipengaruhi oleh gangguan server/jaringan. Berdasarkan data yang diperoleh, Dinas Kependudukan dan Pencatatan Sipil telah melaksanakan pelayanan terjadwal di Dinas Kependudukan dan Pencatatan Sipil Kabupaten untuk 11 kecamatan yang ada di Kabupaten Rote Ndao dan dilakukannya pelayanan secara langsung di setiap desa per kecamatan guna memperlancar pelayanan kepada masyarakat.

Abstract

The purpose of this research is to analyze the supervision of the village consultative body on village financial governance, in Hadakewa Village, Lebatukan District, Lembata Regency. This research uses empirical legal research methods sourced from data obtained directly in the form of opinions from respondents, namely the Village Head, Village Secretary, Village Finance Clerk, Community Leaders, Hadakewa Village Consultative Body. The results showed that (1) the accountability of the Hadakewa village government regarding the management of village funds has a form of transparency with the village fund realization report. This report is not only submitted to the district / city government but also to the community and the Village Consultative Body which acts as a supervisor of the use of the Village Fund. Thus, this action reflects the Village's commitment to implementing the principles of accountability and transparency in the management of the Village Fund (2) shows that the implementation of financial governance supervision based on management principles is running well and all reports on the use of village funds are carefully recorded and reported from village officials to the Village Consultative Body.

Abstract

One important aspect in the process of realizing simultaneous Village Head elections is the role of relevant institutions in carrying out Village Head elections. The institution referred to is the village head election committee at the village level. The election for the head of Mahal Village was marked by the resignation of the village head election committee. This research aims to find out the factors causing the resignation of the village head election committee and to find out the legal implications of the resignation of the election committee. Empirical legal research is a legal research method that uses empirical facts taken from human behavior, both verbal behavior obtained from interviews and real behavior carried out through direct observation. The research results show that the resignation of the Mahal village election committee was caused by internal and external factors. Internal factors include: differences in perception regarding proof of immoral customary acts, deemed not comprehensive in carrying out the requirements research stage, the time limit for immoral acts is under the five years limit, not showing evidence of an open statement of not committing immoral acts, weak supervision by the village head election supervisory team. , does not impose administrative sanctions on prospective candidates suspected of committing immoral acts, threats from BPD Mahal and refusal to sign minutes, and resignation of candidates suspected of committing immoral acts. External factors include the absence of factual verification by the district, a vote of no confidence from the public, no guarantee of comfort for the election committee and their families and pressure from the victim. The juridical implications of the resignation of the Mahal village election committee include: the vacancy of the Mahal village head election committee, the phenomenon of a legal vacuum, the postponement of village head election activities at a later stage, and the formation of a new (replacement) election committee. The mechanism for the resignation of the village head election committee is not expressly included in the legal basis for the technical instructions for village head election. The Mahal Village Consultative Body formed a new (replacement) election committee based on instructions from the district level election committee with letter number B.U140/2031/Dinas PMD/X/2021 to carry out duties and responsibilities at the next stage.

Abstract

Abandoned children are children whose needs are not met in a reasonable manner, whether physical, mental, spiritual or social in accordance with what is regulated in Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection in Article 1 number 6 The aim of this research is to understand the implementation, functions and obstacles of the Social Worker Service Unit in handling the problem of abandoned children in Kupang City. The research method used is empirical research, namely through interviews, then the data is analyzed descriptively qualitatively. The research results show: (1) The duties of social workers can be carried out well by professional officers in accordance with Law Number 14 of 2019 concerning Social Workers. (2) Internal barriers, namely parental education and parents not understanding about children. Meanwhile, external obstacles include the scope of children's problems, coordination between SKPD, combining children's cases with other cases, lack of social worker service personnel and facilities for outreach to children. The researchers' conclusions are: (1) The implementation of duties and functions by the social worker service unit as liaison, educator, facilitator, mediator, counselor, through mentoring, counseling and family support has been carried out well by the social worker service unit. (2) The obstacles faced in carrying out the duties and functions of the social work service unit are internal obstacles and external obstacles. It is hoped that the government, especially social services, can carry out monthly monitoring of parents so that the funds distributed are used properly for children's needs and provide outreach to parents.

Abstract

The issue of waste management in Indonesia, particularly in Ende Regency, remains a significant challenge that threatens environmental quality and public health. Population growth and economic activities that are not balanced with adequate waste management lead to various negative impacts, such as environmental pollution, soil degradation, and health problems. This study aims to analyze law enforcement in waste management at Wolowona Market, Ende Regency, by focusing on the implementation of Ende Regency Regional Regulation No. 8 of 2014 on Waste Management. The method used is empirical research, with primary data obtained through interviews and observations. The results show that law enforcement in waste management at Wolowona Market is still suboptimal, marked by insufficient supporting facilities, low public awareness, and weak legal actions against violations. Efforts such as socialization, community service, and inter-agency collaboration have been carried out, but limitations in human resources, budget, and coordination remain major obstacles. This study recommends enhancing law enforcement, including strict administrative sanctions, provision of adequate facilities, and intensive public awareness campaigns. Collaboration between the government, community, and business actors is also key to creating more effective and sustainable waste management that supports environmentally sound development.
