Abstract

By conducting a comparative study, the importance of third-party management of correctional institutions (LPs), with a focus on the comparative practices implemented in Germany, can offer concrete, innovative and evidence-based solutions to overcome various challenges in the management of correctional institutions in Indonesia, while learning from the successes and challenges faced by developed countries such as Germany. Using qualitative research methods, this study analyses the policies and practices of prison management and their impact on prisoner rehabilitation. The research found that the third-party management model was able to improve operational efficiency, transparency, and the quality of rehabilitation programmes offered to prisoners. In addition, the results of the analysis show that the involvement of third parties in the management of prisons in Germany not only improves the living conditions of prisoners, but also contributes to the reduction of recidivism rates and the potential for implementing a similar model in Indonesia to overcome challenges in the correctional system, as well as providing policy recommendations that can support more effective and rehabilitation-oriented prison management.

Abstract

The Supreme Court Decision Number 574 K/Pid.Sus./2018 has generated controversy as it is considered to have criminalized a victim of sexual harassment who was ultimately convicted as a defendant. This decision reflects serious problems in the enforcement of criminal law, particularly in relation to the protection of victims of sexual violence. This study aims to examine the decision from a criminological perspective and to review it based on Law Number 12 of 2022 on Sexual Violence Crimes (UU TPKS). The research method employed is normative legal research using a statutory approach, a case approach, and a conceptual approach. The data are derived from primary, secondary, and tertiary legal materials and are analyzed qualitatively. The findings indicate that the Supreme Court decision has not fully reflected the principles of victim protection and restorative justice as mandated by the UU TPKS. From a criminological perspective, the criminalization of victims has the potential to cause secondary victimization and to reinforce a culture of fear in reporting cases of sexual violence. Therefore, a paradigm shift among law enforcement officials is necessary in handling sexual violence cases to ensure alignment with the spirit of victim protection and respect for human rights as stipulated in the UU TPKS

Abstract

The rapid growth of social media as a digital public sphere has significantly increased the occurrence of defamation offenses with broad and immediate impacts. In Indonesia, defamation is regulated under the Criminal Code (KUHP) as well as Law Number 11 of 2008 concerning Electronic Information and Transactions, as amended by Law Number 19 of 2016 (EIT Law). However, in practice, the enforcement of these legal instruments has generated debate regarding their effectiveness, legal certainty, and the balance between the protection of reputation and freedom of expression. This research aims to analyze the regulation and effectiveness of criminal sanctions imposed on perpetrators of defamation through social media. The study employs normative legal research using statutory and conceptual approaches. The findings indicate that although the existing regulations provide a legal basis for enforcement, there remains potential overlap between the Criminal Code and the EIT Law, which affects legal certainty. Furthermore, the effectiveness of criminal sanctions is influenced by legal substance, law enforcement structures, and legal culture within society. Therefore, regulatory harmonization and a proportional approach are necessary to ensure that criminal sanctions create deterrent effects while safeguarding responsible freedom of expression.

Abstract

This study is a Classroom Action Research (CAR) based on the Kemmis and McTaggart model, conducted over two cycles involving 11 children aged 4–5 years.. The study aims to analyze the effectiveness of implementing reward and punishment methods in improving disciplinary behavior among children. Data were collected through observation using a disciplinary behavior assessment sheet based on TCP (Total Behavior Achievement) indicators—a total score representing the achievement of various established disciplinary behavior indicators. Initial observations during the Pre-Cycle stage showed low levels of disciplinary behavior, with an average TCP score of 18.5, placing the majority of children in the "Not Yet Developed" category. Following the implementation of reward and punishment strategies in Cycle I, the average TCP score increased to 30, with most children shifting to the "Starting to Develop" or "Developing as Expected" categories. A significant improvement continued in Cycle II, where the average TCP score reached 42.2, indicating that most children had achieved the "Developed Very Well" or "Developing as Expected" categories. The results demonstrate that the consistent and planned application of reward and punishment shows effectiveness within the context of the subjects and setting of this study in shaping disciplinary behavior in early childhood.
