Abstract

This study aims to know and understand the policy of implementing restorative Justice in the judiciary. As well as to know and understand the model of implementing restorative Justice from the perspective of the customary Justice of the Trong Yowari tribe, Jayapura Regency. The method used in this study is empirical juridical research that takes place in the Trong Yowari tribe, Jayapura Regency, with secondary data types with primary, secondary, and tertiary legal data sources, the population of the entire Trong Yowari tribe and samples in Yongsu Desoyo village, data collection techniques through literature study or documents with data analysis techniques using descriptive qualitative data analysis. The results of the study indicate that the policy of implementing restorative Justice in the prosecutor's office is the authority of the public prosecutor to stop prosecution if a case has been settled outside the court provided that: (a) for certain matters of crime, the maximum fine is paid voluntarily or (b) has recovery occurs back to its original state by using a Restorative Justice approach

Abstract

Pengawasan terhadap peredaran produk makanan impor merupakan isu penting dalam menjamin keamanan dan mutu pangan di Indonesia, terutama setelah ditetapkannya Peraturan BPOM Nomor 28 Tahun 2023 sebagai dasar hukum pengawasan. Penelitian ini bertujuan untuk menganalisis bentuk pengawasan yang dilakukan terhadap produk makanan impor di Kota Jayapura serta mengidentifikasi kendala yang dihadapi dalam penerapan regulasi tersebut. Metode penelitian menggunakan pendekatan normatif dan empiris dengan studi survei yang dilaksanakan di Balai Besar Pengawas Obat dan Makanan (BBPOM) Jayapura. Data dikumpulkan melalui observasi, wawancara dengan informan kunci, serta dokumentasi dari berbagai dokumen resmi, kemudian dianalisis secara kualitatif melalui tahap pengumpulan, klasifikasi, dan penyajian data. Hasil penelitian menunjukkan bahwa pengawasan dilaksanakan melalui dua tahap utama, yaitu pra-peredaran dan pasca-peredaran, dengan sistem berbasis risiko serta pemanfaatan instrumen digital seperti e-BPOM dan Indonesia National Single Window (INSW). Namun, implementasi di lapangan masih menghadapi tantangan berupa keterbatasan sumber daya manusia, sarana laboratorium yang belum memadai, koordinasi antarinstansi yang belum optimal, rendahnya pemahaman pelaku usaha, serta adanya multitafsir terhadap ketentuan teknis. Penelitian ini menyimpulkan bahwa penguatan kelembagaan, penyempurnaan regulasi, optimalisasi sistem pengawasan digital, serta pembinaan dan edukasi pelaku usaha menjadi langkah strategis agar tujuan utama peraturan ini dalam menjamin keamanan dan mutu produk makanan impor dapat tercapai secara efektif.

Abstract

Sexual Violence Crime based on number: 36/PID. B/ 2024/ PN. JAP. In its decision, the Jayapura District Court has sentenced the defendant as regulated and threatened with criminal punishment in Article 285 of the Criminal Code and Law Number 8 of 1981 concerning the Criminal Procedure Law and other relevant laws and regulations, a legal review of the case is very necessary because for the case Article 6 letter b Jo Article 15 of Law Number 12 of 2022 concerning the Crime of Sexual Violence Jo Article 64 paragraph (1) of the Criminal Code can be applied. The purpose of this study is to examine the extent to which the verdict has fulfilled the principles of good justice, as well as the consistency of the application of the law to the crime of sexual violence. There is also a method used, namely normative-empirical legal research, which is a research method that combines or combines normative research methods with empirical research methods as part of the improvement of legal knowledge. The specification of this research is descriptive analytical, which reveals laws and regulations related to legal theories that are the object of research. The conclusion reached was that the Jayapura District Court's Decision on the Crime of Sexual Violence in the case of Decision Number: 36/PID. B/ 2024/ PN. JAP determined that thedefendant, who had been legally and convincingly proven, was guilty of committing the crime of "Rape". This decision is in accordance with Article 285 of the Criminal Code and Law Number 8 of 1981 concerning the Criminal Procedure Law and other relevant laws and regulations. Suggestions that can be conveyed include that law enforcement officials must always continue to develop their knowledge that will be needed when searching for the legal basis of a criminal event.
