Abstract

In this article the author will examine the regulation of underage marriage without parental consent. The author explains through the eyes of Islamic law and positive law. What are the legal consequences for underage marriages without parental consent? While the research method carried out by the author is through a normative juridical approach. That refers to the norms contained in Islamic law and positive law. While the nature of this research is analytical descriptive.The results of the study explain that underage marriage without parental consent in Islamic law and positive law cannot be justified. This means that these two laws prohibit underage marriages from taking place without parental consent. The legal consequences are both null and void. The difference between Islamic law and positive law in terms of marriage is the setting of age limits and the granting of parental consent.

Abstract

In the Mandailing community in Tabagsel, they tend to ignore the element of estrangement when looking for a life partner for their child. Most of those who marry off their sons and daughters without sequencing become households with broken homes, often resulting in divorce. This research is categorized as descriptive qualitative research. The data is taken from predetermined informants (people who marry without kafa'ah, village heads, traditional leaders, and in the form of books, the results of previous research that are relevant to the focus of the study. With data collection techniques through observation, interviews, and documentation.            The findings in the field indicate that the mandailing community in Southern Tapanuli. Not paying attention to the kafa'ah factor in marriage. Many are married without kafa'ah in the household. Often found discrepancies, fights, cornering each other, not even a little lead to a court (divorce) due to not paying attention to the element of kafaah in question. Through this research, it is hoped that in the future the community will consider the kafaah element in marriage. Because with kekufu in a marriage it will be easy to make the family sakinah, mawaddah warahmah, my home is my heaven

Abstract

Mangolat boru is an event to confront the bride and groom before the bride's departure to the namboru's house (in-law) which is carried out by the namboru's son from the bride as a farewell so that there is a pangolat wage or money. Pangolat money will be given by the men to the namboru from the women. the wages or pangolat money given by the groom is not enough, so the namboru child of the bride continues to hold and ask for more mangolat wages to the groom. In addition to slowing down, sometimes the time of the mangolat jam approaches the Maghrib call to prayer, which is where the implementation of this mangolat still continues. The purpose of the study was to find out how Islamic law reviews the mangolat tradition in marriage customs in the Bondar flower family, Sipirok district, South Tapanuli district and to find out the implementation of the mangolat tradition in the community of Bunga Bondar village. This type of research is field research. Research conducted in collecting data on phenomena that occur, is natural and scientific. The data collection of this research uses observational field studies, interviews, as well as documentation and libraries, and uses a systematic discussion. The results revealed in the thesis entitled Mangolat Tradition in Marriage Customs in the Bunga Bondar Village, Sipirok District, South Tapanuli Regency is that the mangolat custom tradition carried out by the community has been carried out for generations in various generations, this mangolat event is the last event in the implementation of the mandatory custom. carried out in a wedding ceremony, with that wages or money pangolat will always be a complement to the implementation of the mangolat pickle, where the mangolat event will take a lot of time so that the departure of the bride and groom will take a long time due to the implementation of this mangolat event.

Abstract

Pandongani is the best man and bridesmaid at traditional Batak weddings. Pandongani has been around for a long time, and the existence of pandongani to accompany the bride and groom is generally known by the Batak traditional community. This research wants to examine the existence of pandongani in the study of Islamic law and customary law. This research method uses empirical juridical methods. In Islamic law there is no problem with the practice of pandongani. And according to Batak customary law, Pandongani are required to be present to accompany Batak traditional wedding ceremonies.

Abstract

This research will analyze according to fiqhiyyah method the repetition of ijab and kabul in marriage. The repetition happened because of a redaction error in the pronunciation of ijab and Kabul. In the rules of fiqhiyyah I'imal al kalam aula min ihmalili (meaning a speech is better than ignoring it). As for the type of this research, it is an empirical legal research that analyzes problems by combining legal materials (which are secondary data) with primary data obtained in the field. As for the results of the research that the repetition occurred in Dolok District due to the repetition of the contract which is clear if linked to the rules of fiqhiyyah it includes wasting a speech, but the repetition is caused to strengthen the first ijab and kabul so that he does not ignore the first ijab and Kabul.

Abstract

. This study will analyze the methodology used by classical Islamic scholars in determining the concept and principles of maqāṣid alshariah. This analysis will compare the method of determining Maqasid Shariah by Muslim scholars with current scientific research methods. This research uses qualitative methodology by reviewing classical and modern scientific writings. The collected data is analyzed thematically based on inductive approach. The results of this study show that the formulation of the concept and principles of Maqasid Sharia involves the analysis of textual commands. The inductive reasoning of istiqrā' applied by Muslim scholars has similarities with thematic analysis in modern qualitative research. The results suggest basing ijtihad and fatwa on maqāṣid al-shariah through holistic textual analysis. This makes it possible to respond to new challenges through appropriate sharia laws by avoiding rigid legalism or unbridled rationalism.

Abstract

The implementation of child custody due to parental divorce is a very important legal issue, considering the implications for the child's psychological and social development. This research aims to analyze the implementation of child custody rights in the context of parental divorce, with a focus on the legal process and factors that influence court decisions. In the Indonesian legal system, child custody can be given to one parent or both parents jointly, based on considerations regarding the child's best interests. The research results show that although the law provides clear guidelines, in practice, custody decisions are often influenced by a variety of factors, including the parents' emotional, psychological and financial conditions, as well as the child's age and needs. This research also found that a lack of communication between parents is often an obstacle in reaching a mutual agreement regarding custody. Therefore, it is recommended that the court pay more attention to the psychological evaluation of the child and parents in determining custody rights that are in favor of the child's best interests. This research uses descriptive qualitative research methods. In it, the author collects data from various literary sources.

Abstract

The problem in this study is that mutant musyᾱrakah should be aimed at financing with a productive character such as working capital, not consumptive such as mortgage financing. Because of this, there are several perceptions in the public that there is a discrepancy between fatwa and SEBI/SEOJK regulations. This research is a library research, the problem approach method used, the ushuliyah rule approach and the siyasah syar'iyah approach. The data source comes from everything that has been processed and politicized in the form of official documents, books/books, and scientific journals related to the mutant musyᾱrakah contract as an object of research with a qualitative analysis method with an inductive thinking method. The results of this study found that the implementation of mutant mutakah mutakah contracts, the author found that this is in accordance with the concept of Islamic law even though it has been transformed into SEBI and SEOJK, mutant mutant mutakah is shown to be productive and non-consumptive because in it there are rental activities of capital participation between banks and customers.

Abstract

Fiqih Islam telah menetapkan aturan hukuman untuk tindakan kriminal, baik yang melibatkan hilangnya nyawa, cedera tubuh, atau kerugian materi. Tindak pidana tidak hanya dilakukan oleh orang dewasa, bahkan anak-anak pun juga mampu melakukan berbagai jenis tindak pidana seperti pembunuhan, pencurian, pelanggaran terhadap martabat manusia, dan penganiayaan. Fenomena tindak pidana yang dilakukan oleh anak semakin hari semakin memprihatinkan. Tindakan kriminal yang dilakukan oleh anak ini membutuhkan penanganan yang sangat tegas dari berbagai pihak dan pihak yang berwenang. Dalam Hukum Islam, terdapat pembahasan mengenai hukuman bagi pelaku tindak pidana di bawah umur. Dalam tulisan ini membahas tiga jenis kejahatan yang dilakukan oleh anak di bawah umur, yaitu kejahatan yang berkaitan dengan nyawa manusia, kejahatan yang menyebabkan hilangnya harta benda, dan kejahatan yang berkaitan dengan harkat dan martabat manusia. Dan melalui karya tulis ini, penulis akan membahas metode yang digunakan dalam hukum Islam, dalam menangani kejahatan yang dilakukan oleh anak di bawah umur dari berbagai mazhab fikih

Abstract

This article examines the phenomenon of exchanging rings in the khitbah (proposal) process as part of Muslim wedding traditions in contemporary society. This practice is deeply rooted in local culture, but it still raises questions from an Islamic legal perspective: is it permissible according to Islamic law, or does it contain elements of tasyabbuh (imitation) of non-Islamic cultures? This study uses a qualitative approach with field research methods, conducted in Selawan Village, North Sumatra. Data was collected through observation, in-depth interviews with couples, religious leaders, and traditional leaders, as well as documentation of the khitbah procession in the community. The results of the study show that the tradition of exchanging rings is seen as a symbol of commitment, but it does not have an explicit basis in Islamic law. Some religious leaders view this practice as a custom that is permissible as long as it does not contain elements contrary to Islamic principles, such as extravagance (israf) or deviant beliefs. This tradition reflects the dialectic between culture and religion, and highlights the need for a contextual approach in responding to the symbolic dynamics of modern Muslim life. This study offers an integrative perspective between customary values, fiqh muamalah, and Islamic ethics in understanding evolving socio-religious practices.
