Abstract

Artikel tulisan ini bertujuan untuk menganalisa pengaturan tanggung jawab platform e-commerce terhadap penjualan buku bajakan dalam regulasi di Indonesia dan Malaysia. Data-data dikumpulkan melalui penulisan hukum normatif dengan spesifikasi deskriptif analitis dan dianalisis secara kualitatif.  Kajian ini menyimpulkan bahwa platform e-commerce bertanggung jawab pada penyelenggaraan sistem elektronik yang aman. Namun di Indonesia dan Malaysia, penyedia platform e-commerce tidak dapat diminta bertanggung jawab secara hukum jika terbukti ada kesalahan dari penjual yang menggunakan platfromnya untuk kegiatan yang dilarang oleh hukum seperti penjualan buku bajakan. Sebagai gantinya, platform e-commerce dapat melakukan tanggung jawab moral dengan melakukan monitoring dan menegakkan tindakan yang menjadi kebijakan platform e-commerce pada websitenya.

Abstract

Digital developments in the banking system occur not only in conventional banks but also in Islamic banks. The digitalization of Islamic financing transactions is also inseparable from technological developments, especially in the use of electronic contracts. Sharia banks implementation of sharia business activities is regulated in the “Compilation of Sharia Economic Law” (KHES). Electronic Contracts are one of the innovations related to commercial life while navigating the legality of making agreements, even though digitally included by Islamic Banks, thus raising questions about the validity and risks of these electronic contracts. Competence, legal relations, objects, free consent, and jurisdiction are indicators of readiness for treaty legal instruments in the development of the current digitalization era. This study examines the legal readiness of agreements facing the era of digitalization of Islamic banking in financing transactions. This study uses an empirical method to examine the provisions of laws and regulations in detail. This was a normative juridical study. The results of the field study show that the electronic contracts implemented by Bank Mega Syariah and Bank Muamalat through e-contracts meet the legal provisions of the agreements stipulated in positive law in Indonesia. The results of the literature study also show that treaty legal instruments as stipulated in BW, Law 11/2008 juncto PP 71/2019 and KHES have accommodated the development of electronic agreement legal needs as an implication of the digitalization era in banking financing transactions.

Abstract

This paper aims to get an overview of Intellectual Property Rights as waqf in Indonesia and Malaysia. To achieve these goals, the research uses a normative legal writing method with descriptive-analytical specifications. The findings reveal, both Indonesia and Malaysia permit IPR being waqf. Unfortunately, there are no implementing regulation or specific guidelines regarding how and what to waqf from IPR in both states. The absence of implementing regulation or guideline will have implication not only for confusion in the community, but also for the lack of applicability of IPR being waqf in the community.

Abstract

This paper aims to obtain an overview of the validity of electronic contracts, the execution of electronic contract by Shariah banks, and the legal force of proof of the electronic contract in digital shariah banking transactions. To achieve these goals, this research uses a normative legal writing with descriptive-analytical specifications. The findings reveal, first, in the perspective of Islamic law in Indonesia, electronic contracts are valid as long as they comply with the general principles of Shariah. Second, this reserach conducted a Focus Group Discussion with two Sharia banks namely Bank Mega Shariah Deli Serdang and Bank Muamalat Jakarta in order to obtain results related to how the execution of electronic contracts on both shariah banks. The result is that PT Mega Bank Shariah Deli Serdang has performed various consumer services based on digital, but not yet for electronic contracts based on financing. The absence of the electronic contract for this financing because it still needs a direct and face-to-face agreement with a notary. Along with its colleague, Bank Muamalat has not yet implemented electronic contracts for financing. Whenever there is an electronic contract that Bank Muamalat is conducted, namely E-Akad in Hajj planning program and E-akad in the value chain system program.. For the two types of e-contract such, Bank Muamalat has never had a dispute with the customer so these two shariah banks have never experienced proof of electronic contract in the trial. Thirdly, theoretically, electronic contracts have been recognised as legitimate evidence in Indonesian law. However, implementation on the ground shall take into account certain terms and conditions.

Abstract

Based on Law Number 28 of 2014 concerning Copyright (UUHC), architectural works are protected creations and are entitled to moral and economic rights. This protection covers the physical building, plans, technical drawings, and building models. Depending on involvement in the creation process, the architect, service user, or both can have the creator status. However, architectural copyright protection is still not optimal, as marked by the low number of copyright registrations for architectural works. Factors such as minimal UUHC outreach, communal culture, and lack of clear rules regarding copyright infringement contribute to this situation. In addition to protection, this article discusses opportunities for commercializing architectural works through licensing. Licensing agreements, exclusive and non-exclusive, can be a way for Architects to maximize their economic rights by adapting architectural works to other media, such as books, fashion, or toys. This aims to encourage innovation and provide economic benefits for creators.

Abstract

The implementation of cash waqf in Indonesia, with a particular focus on Cash Waqf Linked Deposit (CWLD) as the latest Islamic banking product in the country’s Islamic financial sector. The study adopts a normative legal research method and utilizes primary data obtained through an online interview with PT Bank Muamalat Indonesia Tbk. The data is analyzed using a descriptive-qualitative approach. The findings reveal that although the Indonesian Waqf Board estimates the potential of the cash waqf sector at 180 trillion Rupiah, actual realization remains significantly low, with only 2.3 trillion Rupiah collected as of 2023. In response to this gap, the Financial Services Authority (OJK) introduced CWLD in October 2024 as a strategic effort to strengthen Islamic banking and promote greater public participation in cash waqf. PT Bank Muamalat, as Indonesia’s first appointed Islamic Financial Institution to Receive Cash Waqf (LKS-PWU), plans to implement CWLD as part of its new sharia-compliant investment services. As a recently introduced product, CWLD at Bank Muamalat is expected to attract increasing interest from the Indonesian public in the years ahead.
