Abstract

his research aims to find out how the function of controlling and protecting road users in Kab. Pangkep (Siyasah Syariyyah Perspective). The main problem is divided into several sub-problems, namely: How useful is the safety control for road users in the district. Pangkep, what is the public's view of road user safety in Pangkep Regency, and what is Siyasah Syar'iyyah's view of controlling road users in Pangkep Regency. The research method used is data collection in the form of observation, interviews, documentation and reference tracking. The results of this research show that the benefits of road user safety controls are very beneficial for the community because people can pay attention to the direction of oncoming traffic, in order to reduce the occurrence of accidents, so it is necessary to install shock bands so that drivers are careful when driving. The public's view of road user safety is that most drivers obey the rules and there are also those who break them, so the existence of these rules can provide regulations that can be set by the transportation service. Siyasah Syari'iyyah's view of controlling road users is that it is described as a policy requirement to regulate state affairs based on sharia, therefore using public highways for personal gain is prohibited by Islamic law, so it is necessary to have several restrictions, so as to create benefits and prevent losses, which are not contrary to the provisions of Islamic sharia and general principles, which results in the problem of Murlah.

Abstract

  The purpose of this study was to determine the form of service at the Bulukumba Religious Court Office, a study of Siyasah Syar'iyyah and the public's views regarding the quality of public services at the Bulukumba Religious Court Office. The method used in this research is a qualitative field (field research) with a normative theological approach and a fiqh siyasa approach, the data are primary and secondary data obtained through observation, interviews and literature. The results of this study indicate: 1) The forms of services for the Bulukumba Religious Court are court administration services, legal aid services and complaints and requests for information. 2) The public's perception of the performance of the Women and Children Empowerment Service is in accordance with the results of interviews with the public's perception of the performance of the Women and Children Empowerment Office in Kab. Bulukumba has 2 different versions, starting from the performance of the Women and Children Empowerment Service which has not been maximized due to the lack of campaigns/socialization related to empowering women and children so that many local people do not know what the duties and functions of the Women and Children Empowerment Service are and there are also those who think that it is already done. carry out their duties and functions in accordance with Standard Operating Procedures (SOP) well because many repressive efforts have been made to empower women and protect children.

Abstract

The research discusses the impact of trade through electronic systems on business actors and consumers in the view of siyasah syar'iyyah, especially in Makassar City. The research method used is field research with juridical, theological syar'i, and sociological approaches. The results obtained: 1) The positive impact of trade through electronic systems on business actors and consumers is that it is easier to promote goods, easier to obtain consumers, wider market reach, easier shopping, energy and time saving. While the negative impacts can be unilateral cancellations, fictitious orders, defective products, and goods not in accordance with the image; 2) Trade through electronic systems is allowed in Islam, as long as it does not contain elements of usury, gharar, fraud, coercion, maisir and is not a forbidden item.

Abstract

The guarantee of legal certainty of land rights has encountered various challenges, including in the implementation of land registration. The Badan Pertanahan Nasional has a central role in realizing systematic land registration despite the complexity of the problems that come with it. This study aims to determine the role of the Badan Pertanahan Nasional in optimizing land registration in Pangkajene dan Kepulauan Districts. The type of research used is qualitative field research with a normative juridical approach. The results showed that the stages of implementing land registration include the collection and processing of physical data, the collection and processing of juridical data and the issuance of documents proving proof of rights. Optimization of land registration in Pankajene dan Kepulauan Districts is carried out through several strategies, namely: a) responsive, fast and systematic services; b) systematic land program (free land registration), and c) online services. Registration of land rights is part of ijtihad to safeguard property and this effort is in line with one of the principles of al-Maqasid al-Sharia i.e. maintaining property (hifz al-mal) hifz al-mal).

Abstract

This study aims to determine the government system applied in Majananng Village, Parigi District, Gowa Regency. The type of research used is qualitative research with normative juridical and normative theological approaches. The results of this study show that the government system currently implemented in Majannang Village still refers to the system regulated in Law Number 6 of 2014 concerning Villages, both in the process of selecting village heads, authority, finance, and the formation of village regulations, including village government administration tools, such as village heads, village officials, village consultative bodies, and village community institutions. In practice, Majannang Village is still held democratically by involving the community in every decision-making, either directly or through representatives. so that in principle, the Majannang Village government system is no different from the village government system in general.

Abstract

This study aims to find out how the reality of unemployment in Soppeng Regency is and to know the role of the Soppeng Regional Government in dealing with Unemployment in Soppeng Regency. The research method used in this study is field research through an empirical juridical research method and a syar'i method. The effects of this have a look at suggest that, the reality of unemployment that occurs in Soppeng Regency causes the unemployment rate to continue to increase due to uncertain macroeconomic conditions in the region, especially Soppeng so that companies cannot develop their business in Soppeng so that the labor recruitment process is not optimal. The role of the Department of Manpower in dealing with unemployment in Soppeng Regency is to increase the distribution of workforce placement by establishing work connectivity networks, expanding job opportunities, and training & labor productivity in an effort to reduce unemployment. The role of the Department of Manpower and Transmigration in the Siyasa Syar'iyyah, in this case the Siyasa Syar'iyyah is appropriate and does not conflict with the rules contained in the Siyasa Syar'iyyah. That the manpower service is equivalent to a state leader in the context of an Islamic State. Both have the same task, namely to realize the benefit of the people.

Abstract

KPPU is an independent institution, which in handling, deciding or conducting an investigation of a case cannot be influenced by any party, both the government and other parties who haveConflik of Interest, even though in carrying out its powers and duties it is responsible to the President. KPPU is also an institutionQuast Judiciary having executive authority in relation to business competition cases. Makassar KPPU stopped the case of alleged business monopoly in the Makassar sea sand mining project because it was deemed not to have fulfilled the completeness and clarity of the report as stipulated in KPPU regulation No.1/2019. The five pieces of evidence referred to in the regulation are witnesses, documentary evidence, expert testimony, instructions and statements of the reported party. Meanwhile, the reporting party, the Save the Indonesian Sea Coalition (KSLI), was assisted by the Makassar Legal Aid Institute (LBH). The main problem in this study is how the Role and Function of the Makassar City Business Competition Supervisory Commission (KPPU) in creating fair business competition according to Siyasah Syar'iyyah's review. The type of research used is field qualitative (field reseasch). Based on the results of this study, it shows that in an effort to create fair business competition in Makassar City, the Business Competition Supervisory Commission (KPPU) has taken several preventive measures, namely carrying out socialization so that the public can find out and monitor the activities of business actors, hold hearings with several business actors, conduct Advocacy on government policies and activities of business actors in market competition, KPPU holds journalist forums with various media that work together to socialize unfair business competition, holds discussion forums with academics such as public lectures on campuses, conducts policy advocacy to the government that has the potential to result in practices monopoly and unfair business competition, assess agreements that may result in unfair business competition, and supervise companies in Makassar City.

Abstract

The purpose of this research is how women’s leadership is according to Fatima Mernissi from the perspective of Islamic law. The problem in this research is that the existence of women in the political field is being heard again, namely the increasing interest of women in the world of politics. Unfortunately, our country, Indonesia, places women only as second persons. Judging from history, women are often seen as powerless, there is a saying in society that women cannot go to higher education, because their work seems to only be in the well, kitchen and bed. The type of research used in this research is research with a library approach, namely research that is purely library in nature where the data is based on or taken from written materials, whether in the form of books, previous theses, journals or other things related to the topic or theme. Discussion according to the title of this research. The results of this research show that there are women in the world of politics who act as leaders, not to overthrow, demote, or seize power from men. But as equal partners for women and men. At a time when several clerics opposed women’s leadership in the world of politics, Fatima Mernissi as a figure in Islamic feminism thought that a woman could become a leader in the world of politics. Fatima Mernissi strongly opposes the patriarchal culture that exists in society. Because in his view, what has existed in the patriarchal system, namely injustice, discrimination, exclusion and domestication of women, is only the interpretation of scholars who are said to have authority in interpreting religious texts. Indirectly, the existing patriarchal culture is the reason for the low number of seats for women in politics. According to him, women’s participation in politics does not mean they want to compete or compete with men, but as a form of equal rights and justice for women because currently many women have the same abilities and knowledge as men.
