Abstract

Artikel ini menganalisis Gerakan Studi Hukum Kritis (Critical Legal Studies) melalui kajian aspek ontologi, epistemologi, dan aksiologi sebagai kerangka filsafat hukum yang mengkritisi dominasi paradigma positivisme hukum dalam sistem hukum modern. Penelitian ini berangkat dari asumsi bahwa hukum kerap dipahami sebagai sistem normatif yang netral, objektif, dan otonom, sementara dalam praktiknya hukum tidak dapat dilepaskan dari relasi sosial, politik, dan kekuasaan. Dengan menggunakan metode penelitian hukum normatif melalui pendekatan filsafat hukum dan kritis, serta pendekatan konseptual dan historis, artikel ini mengkaji gagasan utama Studi Hukum Kritis dan relevansinya dalam konteks Indonesia. Hasil kajian menunjukkan bahwa secara ontologis, Studi Hukum Kritis memandang hukum sebagai konstruksi sosial dan politik yang bersifat historis dan kontingen. Secara epistemologis, pengetahuan hukum dipahami sebagai produk relasi kekuasaan yang tidak bebas nilai, sehingga klaim objektivitas dan kepastian hukum perlu dibaca secara kritis melalui metode dekonstruksi dan kritik ideologi. Dari sisi aksiologis, Studi Hukum Kritis memiliki orientasi emansipatoris dengan menempatkan keadilan substantif dan pembebasan kelompok marjinal sebagai tujuan utama hukum. Dalam konteks Indonesia, pendekatan ini relevan untuk mengkritisi praktik penegakan hukum yang masih dipengaruhi ketimpangan struktural serta mendorong reformasi hukum yang lebih responsif terhadap keadilan sosial. Artikel ini menegaskan pentingnya penguatan pendekatan kritis dalam pendidikan dan praktik hukum guna mewujudkan sistem hukum yang demokratis dan berkeadilan.

Abstract

This research discusses the development of policies for the implementation of the hajj in Indonesia that is oriented towards the interests of pilgrims. As the country with the largest number of pilgrims in the world, Indonesia faces various challenges in providing efficient, accountable, and responsive services. The purpose of this study is to analyze the implementation of the Hajj implementation policy based on the regulatory framework, especially Law No. 8 of 2019, as well as evaluate the effectiveness of its implementation in fulfilling the rights of pilgrims. This study uses a qualitative approach with a literature study method. The analysis was carried out on relevant policy documents, regulations, evaluative reports, and academic literature. The theoretical approach of public policy and excellent service is used as a basis for analysis in examining the dimensions of public services, the development of hajj officers, and fund governance by the Hajj Financial Management Agency (BPKH). The results of the study show that although there has been some progress in regulatory and institutional aspects, challenges such as complex bureaucracy, limited human resource capacity, and lack of transparency and public participation are still the main obstacles. However, there is potential for improvement through systemic reforms that emphasize management transparency, increased professionalism of officers, and the involvement of pilgrims in the evaluation process. In conclusion, the policy orientation that is in favor of the pilgrims not only ensures the safe and comfortable implementation of the hajj, but also reflects the state's commitment to fulfilling the constitutional rights of citizens. The strategic recommendations in this study are expected to be constructive input for policy makers in realizing more inclusive and sustainable Hajj governance.

Abstract

Guardianship in marriage law has an important position as one of the conditions for the validity of marriage in the perspective of Islamic law and also received recognition in the Indonesian national legal system. However, the application of guardianship principles in the context of positive law often raises debates, especially regarding the authority of the guardian, the position of women, and the limits of state intervention. This study aims to examine the principles of guardianship in the Indonesian marriage law system and its relevance to the values of justice and legal protection. This research uses a normative juridical approach with a literature study method. Sources of data are obtained from legislation, legal doctrine, and relevant court decisions. The analysis is done descriptively-qualitatively by tracing the concepts of guardianship in Islamic law, the Compilation of Islamic Law (KHI), and Law Number 1 Year 1974 on Marriage. The results show that the principle of guardianship in the Indonesian marriage legal system is based on the strong influence of Islamic law, especially in KHI. The marriage guardian is considered as a representation of honor and protection of women. However, there is also ambiguity in guardianship arrangements between the national legal system and social religious practices, which can lead to legal uncertainty. There is a need for harmonization between religious principles and human rights principles in marriage law, especially regarding women's autonomy in choosing a life partner. Revisions to regulations relating to guardianship are also needed to emphasize the position of women as independent and protected legal subjects.
