Abstract

ABSTRAK Tindak pidana korupsi di sektor peradilan merupakan bentuk penyimpangan paling berbahaya karena merusak integritas kekuasaan kehakiman dan kepercayaan publik terhadap sistem hukum. Tujuan penelitian ini untuk mengkaji pemidanaan terhadap Rudi Suparmono, Ketua Pengadilan Negeri Surabaya, yang terbukti menerima suap dan gratifikasi sebagaimana diatur dalam Putusan Nomor 51/Pid.Sus-TPK/2025/PN.Jkt.Pst. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dan analisis deskriptif. Data dikumpulkan melalui studi pustaka serta dianalisis secara kualitatif. Hasil penelitian menunjukkan tindak pidana korupsi berupa suap dan gratifikasi yang dilakukan oleh Rudi Suparmono selaku Ketua Pengadilan Negeri Surabaya merupakan bentuk judicial corruption yang paling serius. Perbuatan terdakwa terbukti memenuhi unsur Pasal 5 ayat (2) dan Pasal 12B UU Pemberantasan Tindak Pidana Korupsi sekaligus mencederai prinsip independensi kehakiman, kode etik hakim, serta asas penyelenggaraan negara yang bersih. Namun putusan dalam kasus ini yang hanya pidana penjara 7 tahun dan denda Rp 750.000.000 (tujuh ratus lima puluh juta) dinilai belum proporsional dan kurang tegas dengan tingkat kesalahan dan dampak sistemik yang ditimbulkan. Putusan juga tidak menjatuhkan pidana tambahan berupa uang pengganti atau perampasan aset, sehingga tidak relevan dengan prinsip asset recovery yang menjadi bagian penting dalam pemberantasan korupsi. Penelitian ini menyimpulkan bahwa pemidanaan terhadap aparat peradilan harus lebih tegas, proporsional, dan mengutamakan pemberian efek jera guna menjaga integritas lembaga peradilan serta mengembalikan kepercayaan publik terhadap sistem hukum. Kata kunci: Pemidanaan, Penegak Hukum, Suap, Gratifikasi, Ketua Pengadilan.

Abstract

Islam is a rapidly growing religion in Southeast Asia, spreading through trade, proselytization, marriage, and cultural assimilation. This study aims to examine the history of Islam’s arrival in the region, its development across various ASEAN countries, and the differing conditions faced by Muslims in each nation. Using a qualitative approach through literature review, it was found that Islam first entered Southeast Asia in the 7th century CE via Arab, Persian, and Indian traders. Indonesia, as the initial center for the spread of Islam, became the country with the largest Muslim population in the region, followed by Malaysia and Brunei Darussalam. However, the development of Islam in countries like Thailand, the Philippines, and Myanmar has faced significant challenges due to political conflicts, cultural differences, and discrimination against Muslim minorities. In addition to trade and marriage, methods of proselytization such as education, art, and Sufism also played a crucial role in the process of Islamization. This study highlights the differing social and political dynamics influencing the application of Islamic law and the lives of Muslims in each Southeast Asian country. Consequently, this research provides an in-depth understanding of the history and development of Islam and its role in shaping the region's identity.

Abstract

The principle of legality constitutes a foundational doctrine in criminal law, serving to ensure legal certainty and protect individuals from arbitrary punishment. This study examines the legality principle from a comparative perspective between modern criminal law and Islamic criminal law through normative legal research employing comparative and historical approaches. The analysis reveals that both legal systems share a common commitment to legal certainty, accountability, and the protection of individual rights by requiring a legal basis for criminal liability and punishment. However, significant differences emerge in their sources of law and underlying philosophical orientations. Modern criminal law primarily derives legitimacy from statutory regulations and emphasizes formal legality, whereas Islamic criminal law integrates divine revelation, moral values, and the objectives of maqashid al-shari’ah in determining criminal responsibility and sanctions. Consequently, the legality principle in Islamic criminal law encompasses not only procedural certainty but also substantive justice and social welfare considerations. The findings highlight the relevance of Islamic criminal law values in enriching contemporary criminal law reform, particularly within pluralistic societies. Integrating substantive justice principles with modern legal frameworks may contribute to the development of a more humane, balanced, and socially responsive criminal justice system.

Abstract

Korupsi merupakan kejahatan luar biasa (extraordinary crime) yang memerlukan pendekatan hukum yang holistik dan progresif. Penelitian ini bertujuan untuk menganalisis integrasi prinsip-prinsip Fiqh Jinayah ke dalam UU No. 1 Tahun 2023 (KUHP Nasional) sebagai upaya rekonstruksi sanksi korupsi yang lebih berkeadilan substantif. Dengan menggunakan metode penelitian hukum normatif melalui pendekatan perundang-undangan (statute approach) dan pendekatan perbandingan (comparative approach), penelitian ini membedah Pasal 603 hingga Pasal 606 UU No. 1 Tahun 2023. Hasil penelitian menunjukkan adanya konvergensi signifikan antara sanksi denda Kategori VI dalam KUHP Nasional dengan konsep Al-Mushadarah (penyitaan harta) dalam hukum Islam guna memiskinkan koruptor. Lebih lanjut, rekonstruksi sanksi korupsi berbasis Fiqh Jinayah menawarkan penguatan pada sanksi Ta’zir yang fleksibel namun berat, termasuk publikasi identitas pelaku (Al-Tasyhir), guna menciptakan efek jera sosial. Integrasi ini tidak hanya memperkuat legitimasi yuridis hukum nasional, tetapi juga memberikan dimensi moralitas transendental dalam menjaga amanah harta publik (Hifdz al-Maal). Penelitian ini merekomendasikan penegak hukum untuk menginternalisasi nilai-nilai keadilan Islam dalam implementasi KUHP Nasional demi mewujudkan tatanan negara yang bersih dan berintegritas.

Abstract

The object of research constitutes a fundamental element that determines the direction, scope, and depth of legal research. In the field of family law, determining the research object has become increasingly complex due to social transformation, legal reforms, and emerging contemporary issues related to marriage, divorce, child custody, inheritance, domestic violence, and the protection of family members' rights. This study aims to analyze the concept, scope, and appropriate research approaches to family law research objects in order to produce scientific and applicable legal studies. The research employs normative legal research using statutory, conceptual, and comparative approaches. Legal materials were collected through library research and analyzed qualitatively using legal interpretation methods. The findings indicate that the object of family law research extends beyond written legal norms to encompass judicial practices, social realities, Islamic family law, customary law, and human rights perspectives within family relationships. A well-defined research object significantly influences the quality of legal analysis, the suitability of research methods, and the contribution of research to the development of Indonesian family law. Therefore, research objects should be formulated systematically, reflect contemporary legal developments, and provide solutions to current family law issues.

Abstract

This article highlights the close relationship between research objectives and the formulation of the research problem. Research objectives, which specify the focus and intended outcomes of a study, should be directly derived from the research questions. When these two components are not aligned, readers may struggle to recognize the significance, purpose, and relevance of the study. Moreover, research objectives translate the abstract ideas presented in the research problem into concrete and measurable aims. They provide a practical framework for designing the study, selecting appropriate research methods, analyzing data, and interpreting the findings in the final report. Therefore, research objectives should be formulated only after the research problem has been clearly identified and appropriately delimited, as these stages establish the foundation for defining the objectives. The complexity of the objectives also depends on the nature and complexity of the research problem itself. In addition, the article emphasizes the importance of explaining the benefits of the research in the introductory section. This discussion should demonstrate how the findings may be applied and contribute to various stakeholders, including academic institutions and the broader community. Consequently, well-defined research objectives and a clear explanation of the study's potential benefits are fundamental to producing focused, meaningful, and impactful research.

Abstract

This article aims to analyze the concepts of philosophy, science, and the relationship between the two in the development of human thought. The study employs a library research method with a descriptive-analytical approach by examining classical and contemporary literature on philosophy and science. The findings indicate that philosophy serves as a conceptual foundation that seeks the essence of reality through rational inquiry, while science develops through systematic, empirical, objective, and verifiable scientific methods. Western philosophers such as Plato, Aristotle, Immanuel Kant, René Descartes, Karl Popper, Thomas Kuhn, and Bertrand Russell have significantly contributed to the development of modern epistemology. Meanwhile, Muslim scholars including Al-Farabi, Ibn Sina, Al-Ghazali, and Ibn Khaldun demonstrate that reason, revelation, and experience complement one another in acquiring knowledge. Therefore, philosophy and science should not be viewed as conflicting disciplines but rather as complementary fields that contribute to the advancement of civilization, the production of rational knowledge, and the theoretical foundation of modern scientific development.

Abstract

This article normatively examines, through a comparative approach, the regulation of terrorism offenses in Indonesian national criminal law and fiqh jinayat, focusing on the concepts and elements of the offense, the structure of sanctions, as well as the underlying principles of punishment and justice. The research employs a normative juridical method with a static comparative approach to Law No. 5 of 2018, Articles 600–602 of the Criminal Code (Law No. 1 of 2023), as well as the constructions of hirabah and al-baghy derived from Qur'an Surah Al-Mā’idah (5):33, Surah An-Nisā’ (4):59, and classical fiqh jinayat literature. The analysis reveals that positive law formulates terrorism as a specific criminal offense characterized by elements of violence and threats, mass terror, widespread victims and damage, as well as ideological and political motives. In contrast, fiqh jinayat classifies it within the categories of hirabah and al-baghy, emphasizing attacks against public security and legitimate authority. Both systems recognize very severe sanctions, including the death penalty; however, positive law tends to be codificative, retributive, and procedural, whereas fiqh jinayat combines strict hudud with flexible ta‘zīr within the framework of maqāṣid al-sharī‘ah. This article recommends a hybrid model that integrates the normative certainty of Law No. 5 of 2018 and the 2023 Criminal Code with the orientation toward the protection of life, property, and public order in fiqh jinayat, while also strengthening deradicalization efforts oriented toward substantive justice and the prevention of recurring harm.Keywords: Terrorism, National Criminal Law, Fiqh Jinayat

Abstract

Restorative justice studies have so far been developed mainly within the framework of modern positive law, while the potential of similar concepts in Islamic criminal law is often narrowly understood as a mechanism of retribution. In fact, Qisas and diyat embody a more comprehensive dimension of justice-oriented towards restoration. The purpose of this study is to analyse Qisas and diyat in Islamic criminal law through the perspective of legal psychology to prove the restorative justice character inherent in them. This study uses a normative legal research method, with a conceptual, theological-normative, and legal psychology approach, examining primary data in the form of the Qur'an and hadith, as well as secondary data sourced from relevant research through library research, to analyse the restorative character of Qisas and diyat. The results of this study indicate that Qisas and diyat not only function as instruments of punishment but also as mechanisms of recovery that acknowledge victims' suffering, encourage perpetrators' moral responsibility, and restore social and psychological balance. The novelty of this study lies in the integration of a legal psychology perspective into the examination of Qisas and diyat as restorative justice inherent in Islamic criminal law. This research is expected to enrich academic discourse and strengthen the relevance of Islamic criminal law in the discourse of modern restorative justice.

Abstract

This study aims to analyze the relationship between the practice of khulu’ and the potential emergence of domestic violence (KDRT) as a criminal act from the perspective of Islamic law and positive law in Indonesia. The phenomenon of khulu’ frequently arises as a consequence of domestic violence, whether physical or psychological, which drives a wife to seek divorce by offering compensation to her husband. In Islamic law, khulu’ constitutes a woman’s right to free herself from a marital bond by returning the dowry or a certain amount of property to her husband. However, in positive law, acts of violence underlying such a case may be categorized as criminal offenses under Law Number 23 of 2004 concerning the Elimination of Domestic Violence. Therefore, examining the relationship between khulu’ and domestic violence is crucial to understanding the correlation between religious norms and legal norms in protecting women’s rights.
