Abstract

Era big data telah membawa perubahan signifikan dalam berbagai aspek kehidupan, termasuk dalam bidang kesehatan. Pengumpulan, pengolahan, dan analisis data kesehatan dalam skala besar memiliki potensi untuk menghasilkan pengetahuan baru dan inovasi dalam pelayanan kesehatan. Namun, penggunaan data kesehatan pribadi dalam era big data juga menimbulkan berbagai tantangan hukum dan kebijakan, khususnya di Indonesia. Oleh karena itu, penelitian ini bertujuan untuk menganalisis tantangan tersebut dan mengeksplorasi solusi potensial. Penelitian ini menggunakan metode deskriptif kualitatif dengan pendekatan yuridis normatif. Data dihimpun melalui studi literatur dan analisis peraturan perundang-undangan yang relevan. Analisis data dilakukan dengan cara membandingkan dan menafsirkan peraturan yang ada. Masalah utama dalam penelitian ini adalah tantangan dalam perlindungan data kesehatan pribadi di era big data di Indonesia. Secara khusus, tantangan tersebut mencakup pemahaman publik dan tenaga kesehatan yang rendah tentang regulasi perlindungan data pribadi, infrastruktur teknologi yang belum memadai untuk mendukung pengolahan data skala besar, serta perlunya sinkronisasi dan integrasi antar berbagai peraturan dan kebijakan. Hasil penelitian menunjukkan bahwa meski Undang-Undang Republik Indonesia Nomor 27 Tahun 2022 Tentang Pelindungan Data Pribadi telah menjadi langkah maju dalam perlindungan data pribadi, masih ada tantangan signifikan yang perlu diatasi. Solusi potensial termasuk penyesuaian dan peningkatan regulasi yang ada, peningkatan infrastruktur teknologi, dan upaya untuk meningkatkan pemahaman masyarakat dan tenaga kesehatan tentang pentingnya perlindungan data pribadi.

Abstract

This research explores the legal aspects related to the implementation of the Informed Consent System in patient health practice. This system is a crucial ethical foundation in the relationship between medical personnel and patients, ensuring thorough understanding before patients consent to medical procedures or research. The research focus includes analysis of legal requirements, authority rights, and legal consequences related to Informed Consent. Additionally, this research investigates recent developments in health law, such as data protection and patient privacy regulations, and explores legal cases that can shape the framework for practice. By detailing the legal aspects involved, this research aims to provide a holistic view of the implementation of the Informed Consent System, strengthen regulatory compliance, and encourage a better understanding of rights and responsibilities in healthcare practice. It is hoped that the implications of this research will provide solid guidance for health practitioners and researchers in ensuring legal and ethical compliance in administering Informed Consent.

Abstract

Implementing a medical record system in a hospital plays an integral role in managing patient health information. This article analyzes the ethical and legal aspects involving medical record management, and their impact on patient health practices in hospitals. Findings regarding breaches of confidentiality, inaccurate information, inappropriate access, delays in patient access, and non-transparency of information are the main focus. Ethical implications involve the risk of losing patient trust and the establishment of a positive doctor-patient relationship, while legal implications include potential lawsuits by patients and administrative sanctions against medical record system administrators. Thus, improvements in regulatory compliance, increased ethical awareness among health workers, and implementation of best practices are recognized as crucial steps in maintaining the integrity of the health system and ensuring ethical and legally compliant health practices. In conclusion, collaboration between stakeholders and a holistic approach are needed to achieve the implementation of a medical record system that prioritizes patient rights and interests, strengthens trust, and improves the quality of health services in hospitals.

Abstract

Health services are a fundamental right of every citizen as guaranteed by Law Number 17 of 2023 on Health. However, disparities in access to health services still persist, particularly in remote areas and among low-income populations. Religious institutions such as Vihara Avalokitesvara Stabat play an important role in expanding access to healthcare through social health service activities. This study aims to analyze the implementation of Law Number 17 of 2023 in the conduct of social health services at Vihara Avalokitesvara Stabat, particularly in terms of Standard Operating Procedures (SOP) and informed consent. The research employs a normative juridical approach using secondary data consisting of primary, secondary, and tertiary legal materials, which are analyzed through qualitative descriptive methods. The results indicate that the implementation of social health services has a strong legal basis in Article 14 and Article 35 paragraph (1) of Law Number 17 of 2023. The implementation of SOPs and informed consent at Vihara Avalokitesvara Stabat shows substantial compliance with healthcare service standards, with the SOP structure covering eight comprehensive components and the informed consent form containing the essential elements of medical ethics. The social service activity conducted on October 26, 2025 served 50 participants from various regions. The challenges encountered include limited understanding of regulations, resource constraints, and coordination issues. The recommendations include the development of technical guidelines, regular training programs, strengthened coordination, and the development of an online reporting system to improve the quality of community-based healthcare services.

Abstract

Informed consent is one of the fundamental aspects in medical practice, emphasizing the patient's right to give consent based on full understanding of the medical procedures they are about to undergo. The proper implementation of informed consent is crucial to safeguard the patient's rights and ensure that medical actions are performed ethically and professionally. The Health Law No. 17 of 2023 provides a clear legal foundation regarding the obligations of hospitals and medical personnel in carrying out informed consent. Article 56 of this Law states that "every medical professional conducting medical procedures must provide sufficient information to the patient to obtain written consent before performing the medical procedure." This regulation aims to protect the patient's rights and improve the quality of healthcare services in hospitals. This research aims to analyze the role of law in enhancing the quality of informed consent implementation in hospitals, referring to Health Law No. 17 of 2023. The research method used in this study is normative legal research with a descriptive-analytical approach. This approach is used to examine the regulations related to informed consent, as well as its implementation in medical practice in hospitals. The research findings indicate that although Health Law No. 17 of 2023 provides a strong legal foundation, the implementation of informed consent in hospitals still faces various challenges. The main obstacles identified include the lack of understanding by both patients and medical professionals regarding the correct procedures, as well as insufficient oversight in the implementation of this policy. This study recommends enhancing training for medical personnel and implementing stricter supervision of informed consent practices in hospitals. of your findings.
