Abstract

Dalam melaksanakan fungsi dan tugasnya kepala daerah memiliki wewenang sesuai yang telah ditentukan pada peraturan perundang-undangan. Namun, ternyata tak jarang terjadi penyalahgunaan wewenang oleh kepala daerah yang dapat berupa tindak pidana kejahatan yang berpengaruh terhadap status jabatannya. Tujuan dari penulisan jurnal ilmiah ini adalah untuk lebih memahami mekanisme pemberhentian kepala daerah apabila melakukan tindak pidana yang mempengaruhi status jabatannya dan sistem pemerintahan daerah. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Sumber bahan hukum yang digunakan berupa bahan hukum primer, sekunder, dan tersier. Diubahnya Undang-Undang Pemerintahan Daerah untuk kedua kalinya telah menetapkan mekanisme pemberhentian kepala daerah yang telah terbukti atas putusan pengadilan melakukan tindak pidana kejahatan. Kata Kunci : Kepala Daerah, Tindak Pidana, Mekanisme Pemberhentian.

Abstract

Badan bank tanah diharapkan dapat mengakuisisi tanah secara sistematis terhadap tanah yang belum dikembangkan, tanah terlantar, atau yang ditinggalkan kosong dan dianggap memiliki potensi untuk pengembangan. Namun kenyataannya, upaya membangun Bank Tanah sebagai lembaga yang membantu pemerintah dalam pengelolaan tanah-tanah aset negara dibarengi dengan Penguatan Hak Pengelolaan menimbulkan banyak permasalahan. Penelitian ini menggunakan metode penelitian hukum normatif. Pendekatan yag digunakan dalam penelitian ini adalah Pendekatan perundang-undangan (The statue approach ), Pendekatan Sejarah (The History Approach), dan Pendekatan Konseptual (The Conceptual Approach) Urgensi pembentukan bank tanah pasca terbentuknya UU Cipta Kerja dan PP Bank Tanah adalah karena didorong keterdesakan Indonesia akan permasalahan kebutuhan tanah yang sangat besar, yang nantinya tanah tersebut digunakan sebagai wadah kegiatan investasi. Sehingga norma- norma dalam UU Cipta Kerja dan PP Bank Tanah terkait pembentukan bank tanah belum mampu merepresentasikan urgensi awal pembentukan bank tanah di Indonesia. Implikasi penguatan Hak Pengelolaan dan pemberian Hak Pengelolaan kepada Masyarakat Hukum Adat hanya akan menimbulkan permasalahan, karena dapat melemahkan keberadaan MHA dan Tanah Ulayat disisi lain malah lebih menguntungkan pada pihak investor. Sehingga pasca Putusan MK No.91/PUU-XVIII/2020 dan Putusan MK No. 103/PUU-XVIII/2020, pemerintah harus dapat bertindak tegas untuk menghapus kebijakan penguatan Hak Pengelolaan dan pemberian Hak Pengelolaan pada Masyarakat Hukum Adat

Abstract

The purpose of this study is to examine and describe the urgency of establishing a land bank and the implications of the authority of a land bank in realizing land acquisition for the public interest that is equitable in Indonesia. The method used in this research is normative legal research and the approaches used are the legislative approach, the historical approach, the comparative approach and the conceptual approach. The results of this research indicated that land is driven by Indonesia's urgency to the problem of very large land needs, which will later be used as a forum for investment activities. The implication of the Land Bank's Authority in the Job Creation Act and the government regulation of land banks raises several problems, namely, firstly, overlapping authorities with other land institutions. Second, the strengthening of Land Management Rights related to the authority of the land bank is intended to provide facilities and/or licensing services more aimed at increasing investment than as much as possible for the prosperity of the people, this has a very broad impact including 1) Causing an increase in the number of Agrarian Conflicts; 2) Bringing back the principle of Domein Verklaring; 3) Weakening of the existence of customary law communities and their ulayat lands; and 4) the overlapping authority of the land agency

Abstract

Efforts to build a Land Bank as an institution that assists the government in managing state asset lands should be accompanied by the assignment of appropriate positions, duties and functions to the Land Bank, but the arrangement regarding the position, duties and functions of the Land Bank in the Government Regulation concerning the Land Bank instead reflects the concept the dichotomy that creates a conflict of norms between the private authority of the land bank which is too broad and open through several business activities and cooperation to seek profit as a source of funds which is contrary to the spirit of public service of the Land Bank. The purpose of this study is to examine and describe the urgency of establishing a land bank and the implications of the authority of a land bank in realizing equitable land acquisition for public interests in Indonesia. The results of this study indicate that the urgency of establishing a land bank after the formation of the Law on Job Creation and Government Regulations regarding the Land Bank is because it is driven by Indonesia's urgency over the problem of a very large need for land, which will later be used as a vehicle for investment activities. The implications of the Authority of the Land Bank in the Law on Job Creation and the Government Regulation concerning the Land Bank raises several problems, namely first, the authority overlaps with other land institutions. Second, the strengthening of management rights related to the authority of the land bank is intended as the provision of facilitation and/or licensing services aimed more at increasing investment rather than maximizing the prosperity of the people, this has very broad impacts including 1) Causing an increase in the number of Agrarian Conflicts; 2) Reappearing the principle of Domein Verklaring; 3) Weakening the existence of customary law communities and their customary lands; and 4) Overlapping authorities of land agencies.

Abstract

Balinese society with a patrilineal kinship system (in Bali it is better known as purusa or kapurusa), is always interesting to provide material for discussion, especially when it is associated with the position of women in the family and society. The existence of Balinese women, in various aspects of life, is felt to be in a position that does not reflect gender equality and justice. The Kapusa system adopted is "cornered" as the main cause of creating an unfavorable atmosphere for Balinese women, especially in the distribution of inheritance. the research used is normative legal research methods, with a statutory approach (The statue approach) and the Conceptual Approach (The Conceptual Approach). Sources of legal materials that will be used to support the discussion of the above issues are primary legal materials, secondary legal materials, and tertiary legal materials. The results of this study are the Decision of the Pesamuhan Agung MUDP (Majelis Utama Desa Pakraman) Bali Number 01/KEP/PSM-3/MDP Bali/X/2010 dated 15 October 2010 concerning the Results of the Grand Assembly III of the Main Council of Pakraman Village Bali can bring changes that are fundamental to the regulation of Balinese customary inheritance law. The decision of the Pesamuhan Agung gave Balinese women inheritance rights over the gunakaya inheritance left by the heir. Although the Decision of the Pesamuhan Agung does not stipulate the distribution of rights for women and men equally as the sense of justice itself, for the people of Bali this is an extraordinary change, and therefore it needs to be socialized more clearly so that it can be fully and comprehensively understood by all levels of society. Abstract

Diaturnya materi mengenai KI sebagai jaminan kredit perbankan secara tidak langsung menjadi landasan motivasi bagi para kreator, pencipta, inventor untuk lebih produktif dalam menciptakan karya-karya baru. Ini berarti juga menjadi dasar adanya pengakuan bahwa negara menghargai karya mereka. Namun dalam penerapannya beberapa regulasi di Indonesia yang mengatur mengenai KI sebagai jaminan kredit dirasa belum optimal, karena masih adanya problematika yang belum terjawab dari peraturan-peraturan tersebut. Penelitian yang digunakan adalah metode penelitian hukum Normatif. Pendekatan yang digunakan untuk memecah permasalahan pada penelitian ini yaitu Pendekatan perundang-undangan (The statue approach ) dan Pendekatan Konseptual (The Conceptual Approach). Sumber Data hukum yang akan digunakan menunjang pembahasan permasalahan diatas adalah bahan hukum primer, sekunder. Urgensi pembentukan PP No. 24 Tahun 2022 tentang Pelaksanaan UU No. 24 Tahun 2019 tentang Ekonomi Kreatif adalah untuk menciptakan dan mengembangkan perekonomian nasional dan meningkatkan daya saing global guna tercapainya tujuan pembangunan yang berkelanjutan. Pengaturan optimalisasi KI sebagai jaminan utang dalam PP No. 24 Tahun 2022 merupakan bentuk kemajuan negara untuk mewujudkan perlindungan hak-hak masyarakat melalui KI, hal ini tentu dilihat dari pengaturan materi pokok dalam PP.

Abstract

Pembangunan bank tanah merupakan pertama kali dilakukan di Indonesia, sehingga memerlukan perhatian khusus dan kajian mendalam, mengingat konsep ini masih relatif baru di negara ini. Oleh karena itu, penting untuk membandingkan sistem dan praktik bank tanah yang telah lebih dulu diterapkan di negara-negara lain, guna memperoleh wawasan dan pemahaman yang lebih baik dalam merancang dan mengelola bank tanah yang efektif dan efisien. Metode penelitian yang digunakan adalah yuridis normatif dengan menggunakan pendekatan Perundang-undangan dan pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa Urgensi pembentukan bank tanah pasca terbentuknya UU Cipta Kerja dan PP Bank Tanah adalah karena didorong keterdesakan Indonesia akan permasalahan kebutuhan tanah yang sangat besar, yang nantinya tanah tersebut digunakan sebagai wadah kegiatan investasi. Sehingga norma-norma dalam UU Cipta Kerja dan PP Bank Tanah terkait pembentukan bank tanah belum mampu merepresentasikan urgensi awal pembentukan bank tanah di Indonesia. Keberadaan bank tanah bukan pertama kali ada di Dunia, terbukti beberapa negara-negara di Dunia telah lebih dulu membangun Bank Tanah dengan konsep yang berbeda satu sama lain, antara lain Belanda dan Amerika Serikat. Menelaah dari pengaturan pembentukan bank tanah yang akan dicanangkan dibentuk di Indonesia, maka tidak dijelaskan secara jelas konsep/jenis bank tanah yang akan dibentuk. Seharusnya mengenai konsep/jenis bank tanah harus ditetapkan secara tegas sebagaimana negara-negara yang memiliki lembaga bank tanah seperti Belanda dan Amerika.

Abstract

This study aims to reconstruct the LPD as a village-owned financial institution that can play a role in the development and formation of tourist villages in Bali. The research method used in this study is normative method. The research used statute, conceptual, and sociological approach. The existence of tourism village in Bali provides space for LPDs to participate in making their presence knowns amidst increasingly fierce competition between banking institutions. LPD is the main milestone of local wisdom-based capital in the development of tourist village in Bali. Of course, LPD institutions need to cooperate with other local institutions, including Village -Owned Enterprises. This research proves the relevance of Cybernetics theory, which is tailored to the role of the LPD as a traditional village financial institution. This research offers institutional strengthening of LPDs in the development of Tourism Villages in Bali through a cooperation scheme with Village-Owned Enterprises as a village-owned legal entity that can carry out business activities.

Abstract

General background: Tourism plays a significant role in Indonesia’s economic growth, particularly through village-based tourism that integrates cultural sustainability and community welfare. Specific background: Tampaksiring Village, designated as a tourism village under Bali Governor Regulation No. 52 of 2021 and Regent Decree No. 762/E-02/HK/2020, possesses rich natural, cultural, and historical assets. However, its development remains suboptimal, revealing a gap between regulatory mandates and actual implementation. Knowledge gap: Existing studies have rarely examined the legal authority and governance challenges of village administrations in optimizing tourism potential within a sustainable development framework. Aims: This study investigates Tampaksiring Village’s authority in managing local tourism and identifies strategies to enhance its tourism potential. Results: Findings show that the village government exercises attribution and delegation authority but struggles to implement integrative and strategic programs. The study highlights five development efforts: branding a unique tourism identity, expanding partnerships, utilizing social media, empowering community participation, and ensuring cultural-environmental sustainability. Novelty: Unlike prior research focusing mainly on promotion, this study underscores the interplay between legal authority, governance, and community-based management as key drivers of sustainable tourism branding. Implications: Strengthening institutional capacity and collaborative governance can transform Tampaksiring into a model of culturally rooted and environmentally responsible tourism development Highlight: Legal authority and governance are crucial for optimizing village tourism. Branding, partnerships, and social media drive tourism visibility. Cultural and environmental sustainability ensure long-term impact.
