Abstract

This research was conducted because of the background of the use of the Legal Aid Post of the Sukabumi Religious Court which was deemed not fully effective so that the author was interested in examining the services provided by the Legal Aid Post of the Sukabumi Religious Court to the Disadvantaged Community. This research was also conducted to determine the implementation of the service provision of the Legal Aid Post of the Sukabumi Religious Court. The author uses an empirical juridical method that is guided by the Law and examines directly in the field by conducting interviews. The existence of posbakum among the public is still unfamiliar and there are still many people who do not know about posbakum and use the services of advocates who require the public to pay. This results in a lack of information for the wider community about the role of the Legal Aid Post which functions as legal aid for the poor.

Abstract

To become the halal centre of the world, the government requires the implementation of halal certification for all products circulating in Indonesia, one of which is food and beverage products. The halal certification obligation has been carried out from 17 October 2019 to October 2024. The government has prepared strategies to improve the quality and quantity of assistants and simplify the halal certificate registration process. The Sukabumi City Diskumindag has helped facilitate MSMEs in Sukabumi City to register for free halal certification. However, there are still many MSMEs in Sukabumi City that do not have halal certificates. This is certainly detrimental to the community because it does not protect the right to safety and comfort when consuming or using a product. If until 18 October 2024 MSMEs are not halal certified, they will be subject to sanctions in accordance with Article 24 of the Law on Halal. This study aims to examine how the implementation of halal certification is viewed from Law Number 33 of 2014 concerning Halal Product Guarantee for MSME players in Sukabumi City as well as the role of Diskumindag Sukabumi City and what obstacles are faced during the implementation of the Law. The research used in this study is normative juridical which deductively reviews articles and legislation to examine how these regulations are applied in practice. Problems in the implementation of Law Number 33 of 2014 concerning Halal Product Guarantee in Sukabumi.

Abstract

Tujuan penelitian ini untuk mengetahui kendala bagi PT. KAI Argo Parahyangan dalam melaksanakan tanggung jawabnya sebagai bentuk pemenuhan hak- hak konsumen pengguna jasa kereta api berkaitan dengan keterlambatan kedatangan kereta api. Penelitian dalam skripsi ini menggunakan metode pendekatan yuridis normatif, artinya artinya penelitian hukum ini dilakukan dengan cara meneliti bahan pustaka atau data sekunder belaka dan mengkaji undang-undang. Hasil penelitian adalah upaya PT KAI Argo Parahyangan dalam mengatasi kendala internal berupa PT. PT KAI Argo Parahyangan melakukan beberapa hal sebagai pemenuhan hak konsumen pengguna jasa kereta api terkait keterlambatan kedatangan kereta api, yaitu menambah dan memperbaiki sarana dan prasarana kereta api berupa jalur ganda.Penggunaan internet sebagai media sosialisasi pengguna jasa kereta api kepada konsumen mengenai hak-hak konsumen. Diharapkan hal ini akan membuat konsumen. Penggunaan internet sebagai media sosialisasi pengguna jasa kereta api kepada konsumen mengenai hak-hak konsumen. Diharapkan hal ini akan membuat konsumen semakin sadar akan hak-haknya; PT KAI Argo Parahyangan untuk menyediakan sistem pengaduan secara online agar lebih menjangkau konsumen sehingga dapat dihubungi dimanapun mereka berada.

Abstract

This research aims to examine the existence and role of the National Land Agency (BPN) in optimizing the implementation of Electronic Land Rights Certificates and the use of the Touch My Land application in the Outermost, Frontier, and Disadvantaged (3T) areas, especially in Sukabumi Regency, based on the Regulation of the Minister of ATR/BPN Number 3 of 2023 concerning Electronic Certificates. This study uses a normative and descriptive qualitative juridical approach by examining legal documents as well as the results of observations and interviews at the ATR/BPN Office of Sukabumi Regency. The results of the study show that BPN has strategic administrative authority in the land digitization process, but its implementation in the 3T area still faces various obstacles such as limited digital infrastructure, low community legal literacy, and not optimal policy socialization. From the perspective of state administrative law, the principles of rechtmatigheid and doelmatigheid have not been fully fulfilled, resulting in the lack of comprehensive legal certainty. Therefore, it is necessary to strengthen institutional capacity, as well as the integration of inclusive digital services to realize effective, efficient, and equitable land services in the 3T region. This study recommends reformulation of technical policies and acceleration of digitalization with a community participation-based approach.

Abstract

Perjanjian Pengikatan Jual Beli (PPJB) merupakan instrumen hukum yang lazim digunakan dalam praktik jual beli tanah di Indonesia ketika pembuatan Akta Jual Beli (AJB) belum dapat dilaksanakan. Secara normatif, PPJB diposisikan sebagai perjanjian obligatoir yang tidak memindahkan hak atas tanah. Namun dalam praktik, PPJB justru menimbulkan problematika hukum yang bersifat sistemik, terutama ketika tidak ditingkatkan menjadi AJB. Penelitian ini bertujuan untuk menganalisis kedudukan hukum PPJB dalam perspektif konflik norma antara hukum perdata, hukum agraria, dan hukum perpajakan, serta dampaknya terhadap kepastian hukum pembeli. Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa PPJB telah diakui sebagai peristiwa hukum yang menimbulkan kewajiban Pajak Penghasilan dalam rezim hukum perpajakan, namun belum memperoleh pengakuan sebagai perbuatan hukum publik dalam sistem pendaftaran tanah. Ketidaksinkronan ini menimbulkan kondisi paradoksal, di mana PPJB kuat dalam menarik kewajiban hukum, tetapi lemah dalam memberikan perlindungan hak. Penelitian ini menyimpulkan bahwa problematika PPJB tidak semata-mata persoalan kontraktual, melainkan problem struktural dalam sistem hukum pertanahan nasional yang memerlukan penataan ulang kebijakan hukum untuk menjamin kepastian hukum pembeli.

Abstract

Money politics remains one of the most significant challenges threatening the integrity of democratic elections in Indonesia because it directly affects the independence and authenticity of voters’ political choices. Although elections are constitutionally guaranteed as a mechanism for exercising popular sovereignty, the practice of providing money or material benefits to influence voters continues to undermine the principles of free, honest, and fair elections. This study aims to analyze money politics as a violation of voters’ political rights and examine the legal effectiveness of Article 523 of Law Number 7 of 2017 concerning General Elections as an instrument for preventing and addressing electoral manipulation. This research employs a normative legal method using a statutory approach, conceptual approach, and analytical approach. The study examines primary legal materials, particularly the 1945 Constitution of the Republic of Indonesia and Law Number 7 of 2017 concerning General Elections, supported by secondary legal materials from legal literature and academic studies. The findings indicate that money politics constitutes a violation of political rights because it disrupts voter autonomy, creates unequal political competition, and prevents elections from reflecting the genuine will of citizens. Article 523 of Law Number 7 of 2017 provides an important legal framework by criminalizing the provision or promise of money and material benefits intended to influence voters. However, its implementation faces challenges, including difficulties in proving electoral crimes, limited enforcement mechanisms, and the persistence of transactional political culture. Therefore, strengthening election law enforcement, improving institutional capacity, and increasing political awareness are necessary to ensure effective protection of voters’ political rights and the realization of substantive democracy in Indonesia.

Abstract

Studi ini mengkaji mekanisme perlindungan konsumen dalam layanan teknologi keuangan peer-to-peer (P2P) lending di Indonesia, dengan fokus pada kerangka regulasi yang diatur dalam POJK No. 10/POJK.05/2022 yang diterbitkan oleh Otoritas Jasa Keuangan (OJK). Dengan menggunakan analisis hukum normatif, makalah ini mengevaluasi sejauh mana regulasi tersebut melindungi hak-hak konsumen di sektor fintech yang berkembang pesat. Analisis ini mencakup aspek-aspek utama perlindungan konsumen, termasuk transparansi, privasi data, penyelesaian sengketa, dan efektivitas penegakan hukum. Temuan menunjukkan bahwa meskipun peraturan tersebut menawarkan perlindungan yang komprehensif, tantangan tetap ada dalam implementasinya, terutama di bidang penegakan hukum, pengawasan, dan pendidikan konsumen. Studi ini menyoroti kebutuhan akan koordinasi yang lebih baik antara lembaga pengawas, sanksi yang lebih tegas terhadap platform ilegal, dan upaya yang lebih besar untuk meningkatkan kesadaran konsumen. Penelitian ini berkontribusi pada pengembangan kerangka kerja perlindungan konsumen yang lebih kokoh dalam ekosistem fintech Indonesia.

Abstract

Penelitian ini mengkaji implementasi Peraturan Pemerintah Nomor 5 Tahun 2021 (PP No. 5/2021) tentang Perizinan Usaha Berbasis Risiko di Indonesia, dengan fokus pada dampaknya terhadap Usaha Mikro, Kecil, dan Menengah (UMKM). Peraturan tersebut, yang memperkenalkan sistem klasifikasi berbasis risiko untuk kegiatan usaha, bertujuan untuk menyederhanakan proses perizinan usaha, mengurangi hambatan birokrasi, dan menciptakan lingkungan yang lebih kondusif bagi UMKM. Melalui analisis hukum normatif, penelitian ini mengevaluasi kerangka hukum, implikasi praktis bagi UMKM, serta tantangan potensial dalam implementasi peraturan tersebut. Temuan menunjukkan bahwa meskipun peraturan tersebut menawarkan manfaat signifikan dalam hal efisiensi regulasi dan kepastian hukum, tantangan tetap ada dalam hal desentralisasi, akurasi klasifikasi risiko, dan aksesibilitas digital. Studi ini diakhiri dengan rekomendasi untuk meningkatkan koordinasi antara pemerintah pusat dan daerah, memperkuat infrastruktur digital, serta memastikan penegakan hukum yang konsisten di seluruh wilayah.

Abstract

Background. The Tax Court, basically, has been regulated in Law Number 14 Year 2002 on Tax Court. However, there is an issue relating to the ambiguous position of the Tax Court. Purpose. The purpose of this is to show that the position of the court is not independent, as it plays a role in both judicial and executive functions, which may result in a lack of independence in case decision making. Therefore, this study aims to determine the position of the tax court in the current judicial system in Indonesia. Method. This research uses normative juridical research method by reviewing secondary data obtained. Based on the results of the research, it was found that the latest Constitutional Court Decision Number 26/PUU-XXI/2023 has determined that the Tax Courts must transfer their organizational, administrative, and financial development responsibilities to the Supreme Court before 31 December 2026. Results. The consequence of this decision is that the organizational structure of the Tax Court will be directly under the supervision of the Supreme Court and no longer under the Ministry of Finance. Although the Tax Court will be transferred to the Supreme Court, it is important to maintain this situation as the transition requires adjustments in terms of organizational structure, employee status, and career opportunities for tax judges. All of these matters must be studied and solutions found by the Tax Court as the independence of tax judges means a lot to taxpayers seeking justice in their tax disputes. Conclusion. In addition to independence, the public also expects competent expertise and knowledge from tax judges as enforcers of justice in tax disputes.

Abstract

Law enforcement against online fraud in Indonesia continues to struggle with inconsistency in applying Law Number 1 of 2024 on the Second Amendment to the Electronic Information and Transactions Law (the EIT Law). Within the jurisdiction of Bandung City, only about 31.4% of 312 online fraud reports filed between 2021 and 2024 resulted in final and binding decisions, and the legal provisions applied varied considerably. This study analyzes the concrete application of the EIT Law at the indictment, evidentiary, and adjudication stages and identifies the factors driving such inconsistency. Adopting an empirical juridical (socio-legal) method with statutory and case approaches, the research draws on in-depth interviews with investigators, prosecutors, and judges, and on three Bandung District Court decisions examined through triangulation. The findings show that the application of the EIT Law is inconsistent: three substantively similar cases produced three distinct decision patterns, namely the sole application of the Criminal Code, the independent application of the EIT Law, and cumulative application. This inconsistency arises from four interacting factors: normative dualism between the Criminal Code and the EIT Law, the limited technical capacity of officials, weak institutional coordination and inadequate digital forensic infrastructure, and a legal culture favoring the Criminal Code. The study concludes that normative harmonization, technical guidelines from the Supreme Court and Attorney General's Office, strengthened digital forensics, and an objective and measurable model for determining the legal basis are required; the last constitutes the novelty of this research.
