Abstract

Corruption that still occurs a lot in Indonesia from year to year, even though it is shown in the perception index that has increased from year to year for the better, is still in a harmful situation for the country. At this time can observe, see and feel that law enforcement is in a position that is can not be trusted. The public questioned the performance of law enforcement officials in eradicating corruption, the spread of judicial mafia, violations of the law in assessing the APBN and APBD among bureaucracy. In 2018 the public was dumbfounded by the mass corruption committed by 41 members of the Malang City DPRD (Regional People's Representative Assembly) during 2018. Malang City is considered the ‘general champion' in the corruption category in the number of suspects. 6 of them have been tried at the Corruption Court at the Surabaya District Court and have been decided by the Panel of Judges as in Decision Number 119/Pid.Sus.TPK/2018/PN.Sby with different sentences. How is the application of the principle of equality before the law against perpetrators of Corruption in the jurisdiction of the corruption court at the Surabaya District Court against the Decision Number 119/Pid.Sus.TPK/2018/PN.Sby? The research method used is the normative legal research method. The results of the research show that the judicial process in handling corruption crimes is in accordance with the rules regarding the types of punishment in the Corruption Crime Court and meets the principle of equality before the law. Abstract

Corruption is a crime, just like all other crimes which has existed since a long time ago. The problem is that corruption is like a virus in the society which may spread very quickly. It is difficult to eradicate. The efforts to eradicate corruption has been carried out, but the reality shows that it keeps on increasing along with the increasing welfare, technologies, and development. On 2018, Indonesia stood in the 89th place of the world corruption rank. Thus, there needs to be a reconstruction to the forms of the main and the additional punishments in Indonesia’s positive law, so that it is clear that corruption is a terrible crime which must be fought using extraordinary methods. In Indonesia’s constitution of Corruption Eradication Article 2 clause 2 of the constitution No. 31 of 1999 it states that, “In the case of the crime of corruption as meant in clause (1), when carried out under certain conditions, death penalty may be imposed.” From the explanation of that article, and also from the Constitution No. 31 of 1999 it can be concluded that the forms of existing main punishments are: Imprisonment for some time or life sentence, death sentence, or fine. Meanwhile, the forms of additional punishments are: The revocation of certain rights, the deprivation of certain items, the announcement of the judge’s verdict, the deprivation of tangible movable properties (unmovable and intangible) which are used or are obtained from corruption, the payment of replacement money according to the amount obtained from corruption, the closing of some businesses for the maximum period of one year, and the revocation of all or some rights (the elimination of some privileges. Abstract

Currently we are concerned when witnessing the news about Operation CatchingHands (OTT) or the action of the regional head. As for the case in East Java alone,there were 13 regional heads affected by the KPT OTT. In 2018 yesterday the KPKconducted OTT, as many as 30 times OTT and 20 of them involved regional heads(Kompas, 2/28/2019). Regarding the Eradication of Corruption, Indonesia actually has had regulations since 1971, through Law Number 3 of 1971 concerning Eradication of Corruption. Subsequently in 1999, Law Number 31 of 1999 concerning the Eradication of Corruption Acts became the main rule regarding law enforcement in eradicating corruption in Indonesia, which was later revised through Law Number 20 of 2001 in several articles. Based on the background above, the formulation of the problem in this study is: What is the community's understanding of corruption especially in the city of Malang? The type of data used are primary data, secondary data and tertiary data. Primary data were obtained from interviews with people in Malang who were not legal experts. Whereas Secondary Data is obtained from various sources or legal materials such as Law Number 31 of 1999 Concerning Corruption and other Regulations relating to corruption. While tertiary material is obtained from various corruption cases that occur in the city of Malang. Data is processed based on qualitative analysis. Where the researcher uses secondary legal material sources, namely by examining the elements of criminal acts of corruption, especially in Law Number 31 of 1999 concerning Eradication of Corruption, is it in accordance with the applicable regulations. The process of analyzing the data first is to examine the results of interviews with the community in Malang, then analyzed using Law Number 31 of 1999 Concerning Eradication of Corruption, is it in accordance with the applicable regulations. the results of the study the authors get field data that illustrates that in fact there are already a lot of general public especially in the poor city of Lowokwaru  sub-district who understand about criminal acts of corruption, but about 16% of the people there are less understanding of corruption, they just know the meaning corruption without knowing how and what they have to do if that happens or they know even they fear their security is threatened when showing their active role against corruption.

Abstract

Case Number: 0701 / Pdt.G / 2014 / PA.Mlg is the product of the Malang Religious Court which has permanent legal force. In fact, after the ruling gets permanent legal force, it is known that the parties have a joint debt which causes problems for the parties who are responsible for paying off the joint debt if the decision only regulates the share of each of these assets. The problems in this study are: 1) The judge's decision regarding the division of joint assets in terms of legal certainty and justice in the decision Number: 0701 / Pdt.G / 2014 / PA.Mlg. 2) The implementation of sharing the shared assets 3) The implementation of shared debt division if there is no decision by the judge, in fact there is a joint debt. The author uses an empirical juridical research method located in the Malang Religious Court. Primary data is obtained by interviewing the Head and the Registrar of the Malang Religious Court and the Judge who handled the case Number: 0701 / Pdt.G / 2014 / PA.Mlg and the secondary data is obtained from research and literature review which consisted of laws and other legal materials which are relevant. Regarding the opinion of the Panel of Judges on the decision of 0701 / Pdt.G /2014 / PA.Mlg it can be learned from legal considerations in the a quo decision. In general, the principles of justice and legal certainty must be upheld. Justice must be upheld in accordance with the provisions of Article 35 to 37 of Act Number 1 of 1974 concerning Marriage, Article 85 up to Article 97 of the Compilation of Islamic Law.

Abstract

Latar belakang dilakukan pengabdian kepada masyarakat bermitra dengan Klinik keluarga Sakinah Pimpinan Daerah ‘Aisyiyah Kota Malang karena mitra memiliki kegiatan non litigasi salah satunya adalah konsultasi hukum dan pendampingan hukum. Tujuan dari pengabdian pada masyakat kali ini adalah dapat terbantunya penyelesaian permasalahan hukum yang dimiliki, melalui konsultais hukum maupun pendampingan hukum. Langkah-langkah hukum yang tepat dan pendampingan hukum yang sesuai dengan peraturan perundang-undangan dalam menyelesaikan persoalan hukum dalam masyarakat. Metode yang dilakukan dengan cara konsultasi hukum, yakni konsultan langsung berhadapan dengan klien. Kemudian dilakukan dialog, pemaparan kasus-kasus hak asuh anak oleh klien, pemaparan aturan hukum tentang hak asuh anak/hadhanah oleh konsultan hukum. Pendampingan hukum terhadap klien dalam menyelesaikan permasalahan hak asuh anak/hadhanah baik dalam perkara perdata maupun pidana karena telah dilaporkan ke unit PPA (Perlindungan Perempuan dan Anak) Polres Kepanjen. Dampak serta capaian dalam pengabdian yaitu masyarakat yang memiliki masalah hukum berkaitan dengan hak asuh anak (hadhanah) dapat terselesaikan masalahnya melalui proses pengadilan agama (putusan) namun ada upaya hukum banding yang dilakukan oleh Tergugat.   Legal Assistance Regarding Child Custody (Hadhanah) at the Sakinah Family Clinic for the Regional Leader of 'Aisyiyah Malang City The background is that community service is carried out in partnership with the Sakinah Family Clinic of the Regional Leader of 'Aisyiyah Malang City because partners have non-litigation activities, one of which is legal consultation and legal assistance. This time, the purpose of community service is to assist in solving legal problems that are owned through legal consultants and legal aid—appropriate legal steps and legal assistance by statutory regulations in resolving legal issues in society. The method used is legal consultation, where the consultant is directly dealing with the client. Then there is a dialogue, presentation of cases of child custody by clients, exposure of legal rules regarding child custody/hadhanah by legal consultants. Legal assistance to clients in resolving child custody/hadhanah issues in civil and criminal cases has been reported to the PPA (Women and Children Protection) unit of the Kepanjen Police. The impact and achievements in service, namely that people who have legal problems related to child custody (hadhanah), can be resolved through a religious court process (decision), but there is an appeal by the Defendant.

Abstract

Korupsi adalah tindakan pejabat publik, baik politisi maupun pegawai negeri, serta pihak lain yang terlibat dalam tindakan itu yang secara tidak wajar dan tidak legal menyalahgunakan kepercayaan publik yang dikuasakan kepada mereka untuk mendapatkan keuntungan sepihak. Dalam usaha pencegahan dan pemberantasan tindak pidana korupsi, tri pusat Pendidikan mempunyai hak dan tanggung jawab untuk berperan serta dalam upaya pencegahan dan pemberantasan tindak pidana korupsi. Tri pusat Pendidikan merupakan istilah dalam bidang Pendidikan yang berarti memberdayakan sinergitas lingkungan keluarga, sekolah, dan masyarakat. Kurangnya pengetahuan dan pengalaman mengenai korupsi dan pendidikan anti korupsi (pemahaman tentang materi, konsep, dan cara mengajarkan kepada siswa) di SD ’Aisyiyah Kota Malang dan SD Muhammadiyah 8 Kota Malang. Oleh karena itu, tim pengabdi masyarakat UMM bekerja sama dengan SD ’Aisyiyah Kota Malang dan SD Muhammadiyah 8 Kota Malang untuk mengadakan Focus Group Discussion (FDG) tentang pendidikan anti korupsi. Melalui kegiatan FDG diharapkan permasalahan yang dihadapi oleh SD ’Aisyiyah Kota Malang dan SD Muhammadiyah 8 Kota Malang dapat teratasi dengan baik sehingga kasus-kasus yang terjadi mengenai korupsi, yang sekarang sedang marak di wilayah Malang Raya tidak akan terjadi lagi di masa yang akan dating. Selain itu, tim pengabdi juga melakukan pendampingan pembelajaran pendidikan anti korupsi melalui blue print yaitu Standar Operasional Prosedural (SOP) dan Tata tertib sekolah sebagai tolok ukur keberhasilan pendidikan anti korupsi dalam pembelajaran. Pendidikan anti korupsi memiliki 9 nilai yang ditanamkan kepada anak didik, namun dalam pengabdian kali ini tim pengabdi hanya melaksanakan 3 nilai dari 9 nilai-nilai yang ada dalam pendidikan anti korupsi. Dalam pelaksanaan di lokasi mitra pengabdian yang bisa dilakukan yakni melalui 3 nilai yang ditanamkan kepada anak didiknya yaitu nilai jujur, nilai disiplin dan nilai bertanggungjawab. Nilai jujur memiliki indikator antara lain adalah mengakui kesalahan, tidak melakukan perbuatan curang, tidak berbohong, tidak mengakui milik orang lain sebagai miliknya. Nilai disiplin memiliki indikator yakni terbiasa mengerjakan pekerjaan sesuai dengan aturannya (bangun, tidur, istirahat, belajar, bermain tepat waktu), terbiasa antri secara tertib dalam berbagai hal. Nilai tanggungjawab memiliki indikator yakni selalu menyelesaikan pekerjaan atau tugas-tugas secara tuntas dengan hasil terbaik.

Abstract

The issue of divorce in the Malang Religious Court Class 1A (PA Malang) is still a worrying scourge. The dominating factor in the Annual Report of the Malang Religious Court 2020 is the ongoing dispute due to inadequate financial conditions.  This research aims to identify legal awareness of the purpose of marriage in the community in PA Malang according to Fikih Munakahat and positive law, as well as its relevance to the case of divorce economic factors during Corona Virus Disease 2019 (Covid-19). This research is carried out through a juridical-empirical approach, in which norms in a rule are identified as being present in a particular community. The results of this study argue that the legal awareness of the purpose of marriage in the community in PA Malang during Covid-19 has not been implemented properly, so this is one of the factors of the large percentage of divorce cases economic factors on the pretext of continuous disputes. The influence of legal awareness of the purpose of public marriage in PA Malang on divorce cases during Covid-19 according to Fikih Munakahat and positive law has a great influence in establishing household integrity.   Keywords: Legal awareness; Purpose of marriage; Divorce matters; Fikih Munakahat; Positive Law.   Abstrak Masalah perceraian di Pengadilan Agama Malang Kelas 1A (PA Malang) masih menjadi momok yang mengkhawatirkan. Faktor yang mendominasi dalam Laporan Tahunan Pengadilan Agama Malang 2020 adalah perselisihan terus-menerus sebab kondisi finansial yang tidak memadai.  Penelitian ini bertujuan untuk mengidentifikasi kesadaran hukum tujuan perkawinan pada masyarakat di PA Malang menurut Fikih Munakahat dan hukum positif, serta relevansinya dengan perkara perceraian faktor ekonomi semasa Corona Virus Disease 2019 (Covid-19). Penelitian ini dilaksanakan melalui pendekatan yuridis-empiris, yang mana norma dalam suatu aturan diidentifikasikan kehadirannya pada suatu komunitas tertentu. Hasil penelitian ini berpendapat bahwa kesadaran hukum tujuan perkawinan pada masyarakat di PA Malang semasa Covid-19 belum terimplementasi secara baik, sehingga hal inilah yang menjadi salah satu faktor besarnya persentase perkara perceraian faktor ekonomi pada dalih perselisihan terus-menerus. Pengaruh kesadaran hukum tujuan perkawinan masyarakat di PA Malang terhadap perkara perceraian semasa Covid-19 menurut Fikih Munakahat dan hukum positif memiliki pengaruh yang besar dalam menjalin keutuhan rumah tangga.

Abstract

The As-Sakinah Cooperative in Malang City is a cooperative that is in the process of converting to a sharia cooperative. However, this cooperative does not yet have a new draft of article of association and bylaws. Changes in the contents of the article of association and bylaws need to be made because there are some fundamental changes in the conversion to a sharia cooperative, such as changes to the organizational structure, name and operational activities. The service team tries to help solve the problem through workshops to discuss the contents of the new article of association and bylaws. This draft document, the article of association and bylaws, will be ratified through a meeting of cooperative members.

Abstract

Human Rights (HAM) is a value that is very essential since humans are born into the world which in everyday life has a natural nature attached to every individual whenever and wherever so that concretization through law becomes a repressive and preventive effort to pay attention, respect, appreciate and uphold it. Efforts to uphold human rights have been since 2009 the AICHR Court was formed through the 15th Summit as a human rights commission at the ASEAN level, until now the effectiveness of the performance of AICHR is still far from perfect because there have been cases that occurred in several ASEAN countries such as the Philippines, Indonesia, Malaysia, and Cambodia. This was not responded to at all by the AICHR court itself because the main function of AICHR is to protect and promote it in the form of protection at the ASEAN level so that it cannot assimilate and resolve cases that occur. Therefore the author sets out concretely two perspectives on how far the effectiveness and consequences of establishing the AICHR human rights court at the ASEAN level are. First, what are the causes of AICHR's ineffectiveness in upholding human rights in Southeast Asia? These two problems can be examined doctrinally and normatively conceptually to produce the following findings: firstly the lack of commitment from each ASEAN country to human rights, secondly the principle of non-intervention from each country so that decision making is based on consensus.
