Abstract

The problems faced by Klinik Keluarga Sakinah -Pimpinan Daerah 'Aisyiyah (KKS-PDA) Team of Malang City are educational background, the majority of which are not legal science, minimal knowledge of legal science, especially regarding mediation, do not knowledge about the duties, roles, and functions of mediators in the mediation process. mediation. Bearing in mind that this mediation is a non-litigation realm, for the KKS PDA team in Malang City this skill is really needed, considering the number of residents in Malang City and law enforcement officers is unequal. So, the role of the KKS-PDA Team of Malang City to contribute to assist in the mediation process is also needed by the community. So, before the KKS-PDA Team of Malang City carries out the mediation process as a mediator (a neutral party), it is necessary to provide counseling to the KKS-PDA Team of Malang City so that they have these skills.   Abstrak Penyuluhan Hukum Peran Mediator Dalam Proses Mediasi Tim Klinik Keluarga Sakinah Pimpinan Daerah Aisyiyah Kota Malang. Permasalahan yang dihadapi oleh Klinik Keluarga Sakinah (KKS) Pimpinan Daerah Aisyiyah (PDA) Kota Malang adalah latar belakang pendidikan yang mayoritas bukan ilmu hukum, memiliki pengetahuan yang minim mengenai ilmu hukum khususnya mengenai mediasi, belum mengetahui mengenai tugas, peran dan fungsi mediator dalam proses mediasi. Mengingat bahw mediasi ini, merupakan ranah non litigasi maka bagi tim KKS PDA Kota Malang skiil ini sangat dibutuhkan, mengingat jumalah penduduk di kota Malang dengan aparat penegak hukum yang tidak seimbang. Maka peran dari tim KKS PDA Kota Malang untuk berkontribusi membantu dalam proses mediasi juga dibutuhkan oleh masyarakat. Maka sebelum tim KKS PDA Kota Malang melakukan proses mediasi sebagai mediator (pihak yang netral) maka perlu dilakukan penyuluhan terhadap tim KKS PDA agar memiliki skill tersebut.

Abstract

Corruption is quite a complicated problem. It has made many countries, including Indonesia, to ratify the United Nations Convention Against Corruption (UNCAC). It is an effort to prevent and to eradicate corruption with international cooperation. Unfortunately, several studies have revealed that Indonesia is experiencing a legal vacuum on corruption because Indonesia only adopts a few points of the United Nations Convention Against Corruption in written regulations. The legal vacuum causes difficulties in the resolution of corruption cases. Compared to other countries, the Indonesia Corruption Perceptions Index is still quite high. It leads to some questions that are addressed in this study. First, why does Indonesia not adopt all articles of the United Nations Convention Against Corruption? Second, how are corruption cases in Indonesia managed after the ratification? Third, how is the comparison of the law to the Malaysia law? To answer the questions, this study used a normative method. It employed the analysis of primary and secondary data assisted using the nVivo 12 application. The study revealed that Indonesia cannot ratify all articles because Indonesia needs some adjustments to meet the required proportions before the new laws are passed. After the ratification, Indonesia seems to have better regulations and adequate existing conditions. Lastly, laws or regulations in Malaysia are more dynamic than Indonesia.DOI: https://doi.org/10.22304/pjih.v10n2.a7

Abstract

Abstract This research is a study of international law principle, namely the nationality principle. This principle is generally used to support obligation of state to provide protection to its citizens wherever they may be. As international relations have evolved, the interactions of citizens with other countries have also increased, often resulting in citizens facing legal issues in foreign countries. In line with this, a review of references related to the protection of human dignity as a fundamental aspect of international law through the enforcement of the nationality principle was carried out. The research method used in this study is qualitative, involving an approach to regulations in the form of multilateral, regional, and even bilateral international agreements. This approach is further supported by conceptual interpretations of general legal principles and the resolution of cases related to the application of these principles. The study results show that the enforcement of the nationality principle is one form of human rights protection in international relations. This is based on respect for human dignity and is only applied to specific crimes, different legal systems among countries, and global peace and security within the context of healthy state relations as well. Therefore, this article provides recommendations for improving cooperation among states, including a review of extradition agreements between countries, where its implementation is incapacitated. Abstrak Penelitian ini berupa kajian terhadap salah satu asas dalam hukum internasional yakni nationality principle atau asas kebangsaan. Prinsip ini pada umumnya digunakan untuk mendukung kewajiban negara dalam memberikan perlindungan terhadap warga negara nya dimanapun mereka berada. Seiring berkembangnya hubungan antar negara sehingga interaksi warga negara pun semakin berkembang, seringkali berdampak pada warga negara berhadapan dengan hukum di negara lain. Maka sejalan dengan hal tersebut, dilakukan penelusuran referensi terkait perlindungan martabat manusia sebagai hal yang fundamental bagi setiap individu dalam persepktif hukum internasional melalui penegakan prinsip nationality. Metode yang digunakan adalah metode penelitian kualitatif, dengan melakukan pendekatan terhadap aturan berupa perjanjian internasional bersifat multilateral, regional bahkan bilateral, kemudian didukung dengan penafsiran secara konseptual terhadap prinsip hukum umum serta penyelesaian kasus-kasus yang berkaitan dengan penerapan prinsip-prinsip tersebut. Hasil study menunjukan bahwa penegakan terhadap prinsip kebangsaan menjadi salah satu bentuk perlindungan HAM dalam pergaulan internasional, hal ini didasari pada penghormatan terhadap martabat manusia, hanya diberlakukan pada kejahatan-kejahatan tertentu, system hukum yang berbeda antar negara, dan perdamaian dan kemanan dunia dalam konteks relasi yang sehat antar negara. Maka, artikel ini memberikan rekomendasi pada peningkatan Kerjasama antar negara salah satunya peninjauan Kerjasama perjanjian ekstradisi antar negara yang pada faktanya masih lemah dalam aspek implementasi.

Abstract

Regional heads and Regional House of Representatives (DPRD) are local government. Both institutions were formed in order to support the running of local government within the framework of checks and balances. However, in practice, the relationship between the two institutions tends to be destructive and intrigue each other and result in a convergence of the priorities of the interests of the people. This research departs from questions about what are the factors that cause the fracture of relations between regional heads and DPRD, what are the implications of disharmony between regional heads and DPRD and how to design to prevent disharmony between regional heads and DPRD in the future. This research is qualified into the type of normative juridical research with a statutory approach, a case approach, and a conceptual approach. The results showed that the disharmony between the regional head and the DPRD was caused by the process of directly electing the regional head so that the regional head felt that they did not have a debt of gratitude to the DPRD. At the same time, at the time of nomination, the elected regional heads sometimes come from independent candidates and/or do not come from the majority party in the DPRD. In the future, the disharmony between regional heads and DPRD cannot be allowed to continue considering that the disharmony in relations has caused obstacles to the government. The design that can be taken to prevent disharmony in relations can be pursued by applying sanctions to regional heads and/or taking over temporary authority by superior organizations.

Abstract

Mediation Skill Improvement in Special Branch of ‘Aisyiyah in Malaysia for Effective Dispute Resolution Law counsel for mediators aims to resolve legal issue faced by the cadres and Indonesian citizens who stay in Malaysia. In contrast, the heads of ‘Aisyiyah Special Branch Leaders (PCIA) do not possess a particular skill that can be used as an alternative in resolving disputes out of court, which is mediation. Mediation is used to bring bargaining value closer to an agreement. Mediators tend to be more focused on the problems or the positions claimed by parties. The counseling method is implemented by arrangement, mediator’s role and function review, tasks division, and dialogue session. During this agenda, all participants participate in experience simulations, which are carried out by each group. The role of the third party, in this case, the mediator, in completing the task is to become a middleman between parties resolving disputes. As a middleman’, it means that mediators must position themselves as neutral parties and must choose nobody's side while resolving disputes. Through this law community service, participants deliver their reviews during dialogue sessions, they reveal that there is a significant improvement in understanding concepts of mediation’s key such as the mediator’s role, negotiation technique, and how to constructively overcome legal issues.   Abstrak Peningkatan Keterampilan Mediasi di Pimpinan Cabang Istimewa ‘Aisyiyah Malaysia dalam Penyelesaian Sengketa yang Efektif Penyuluhan hukum bagi mediator ini bertujuan membantu menyelesaikan masalah hukum yang dihadapi oleh para kader dan warga negara Indonesia yang tinggal di Malaysia. Namun disisi lain, para pimpinan di Pimpinan Cabang Istimewa ‘Aisyiyah (PCIA) belum memiliki keahlian khususnya mengenai alternatif penyelesaian sengketa diluar pengadilan, yaitu mediasi. Mediasi dimaksudkan guna mendekatkan perbedaan nilai tawar atas suatu kesepakatan. Mediator hanya terfokus pada permasalahan atau posisi yang dinyatakan para pihak. Metode penyuluhan ini dilaksanakan dengan persiapan, pemaparan peran dan fungsi mediator, pembagian tugas, hingga tanya jawab. Dalam agenda ini seluruh peserta menyaksikan simulasi mediasi yang dilakukan setiap kelompok. Peranan pihak ketiga, dalam hal ini sebagai mediator, dalam menjalankan tugasnya yaitu menengahi para pihak dalam menyelesaikan sengketa. “Berada di tengah” memiliki arti juga bahwa mediator harus berposisi sebagai pihak yang netral atau tidak memihak dalam menyelesaiakan sengketa. Melalui pengabdian hukum ini, peserta memberikan pesan-kesan dalam sesi tanya jawab bahwa terjadi peningkatan pemahaman yang signifikan tentang konsep-konsep kunci mediasi, seperti peran mediator, teknik negosiasi, dan cara mengatasi konflik secara konstruktif.

Abstract

This article aims to analyze stone mining which has positive and negative impacts on the community. In Kasengan village, stone mining is managed by individuals or legal entities who own the land. The people can fully utilize this but still maintain it well or manage it as well as possible. Therefore, the author is interested in researching the concept of mining management and analyzing it from the perspective of Islamic law and mining law. This research is empirical research with a statutory and Islamic law approach. Data and information collection was obtained by interviews, observation, and documentation. Apart from that, there are also supporting references available in the library, such as: books, magazines, articles, or other manuscripts related to the research title. Meanwhile, the nature of the research is descriptive analysis. The results of the research reveal that the mining practices in Kasengan Village, Manding District, Sumenep Regency are not permitted according to Islamic law because they cause harm to the survival of local communities, such as floods, landslides and so on due to ex-mining. Meanwhile, according to the law, it is permissible if you obtain a mining business permit and take steps to prevent natural disasters from occurring.

Abstract

In the Disruption Era, the revision of criminal wrongful convictions is vital to the protection of human rights. Moreover, it has a wide and profound impact on judicial credibility with complex mechanisms for shaping such impact. This commitment to rectify errors and uphold justice through criminal revision, while commendable, is overshadowed by a prevailing public perception that attributes such revisions to systemic deficiencies such as corruption, misuse of authority, and biased judicial decisions. This study delves into the intricate landscape of rectifying wrongful convictions by introducing the nuanced perspective of the Cocktail Party Effect (CPE), a sophisticated acoustic theory. The CPE's impact unfolds in three distinct stages—aptly termed "Screen-Mask-Polarize"—as the public navigates through the revision process. At its core, this study elucidates how signals emanate from wrongful conviction revisions to undergo automatic screening, influenced by the public's subjective preferences, thereby establishing a biased negative cognitive context. This cognitive bias, in turn, possesses the potential to erode public trust in the legal system and diminish confidence in the judiciary. Consequently, this comprehensive research offers insightful recommendations for judicial organs, the news media, and the public, complemented by two instrumental measures: the implementation of a state compensation system and the establishment of an accountability framework for wrongful convictions. The overarching goal of this study is to empower the public with the tools needed for a more objective and logical analysis of wrongful conviction revisions, fostering a nuanced understanding and trust in the criminal justice system.

Abstract

This study examines the implementation of green budgeting in Batu City in supporting sustainable development that includes environmental, social, and economic objectives. Many previous studies have explained green budgeting at the national level, focusing on budget policy alignment with sustainable development issues. Meanwhile, the focus of this research study is to review regional budgeting aimed at understanding local government budget policy alignment with green development issues in Batu City. Data were obtained through document analysis, in-depth interviews, and observations, and analyzed using NVivo to identify key themes, issue linkages, and policy priorities. Findings indicate that budgeting policies in Batu City have integrated strategic issues such as sustainable environment, agriculture, tourism, energy, and waste management. However, there is a gap between program/activity priorities and budget allocation, where important sectors such as sustainable plantations receive inadequate budget support. Public participation plays an important role in policy formulation, with primary attention to urban planning, traffic congestion, and environmentally friendly practices in the plantation sector. Waste management through TPS3R (Reduce, Reuse, Recycle) is recognized as a best practice, but budget inconsistencies indicate the need for better integration between policy vision and its realization. This research concludes that regional budgeting in Batu City has addressed several issues directly related to green development, including energy, waste management, tourism, agriculture, and sustainable environment. Nevertheless, there is a gap between planning and budget allocation, so that budget policies do not yet reflect a bias towards important issues related to the green economy. Therefore, public participation becomes the main key to realizing budget policies that support green development. The main recommendation of this research is that the Batu City government needs to seriously consider the consistency of planning and budget allocation so that budget policies align with important issues of green development. In addition, public participation needs to be increased and expanded to ensure that the budgeting process accommodates public issues related to green development. Penelitian ini mengkaji penerapan anggaran hijau di Kota Batu dalam mendukung pembangunan berkelanjutan yang mencakup tujuan lingkungan, sosial, dan ekonomi. Banyak penelitian terdahulu menjelaskan penganggaran hijau pada level nasional yang berfokus pada keberpihakan kebijakan anggaran terhadap isu-isu pembangunan yang berkelanjutan. Sementara fokus kajian penelitian ini, yaitu mereview penganggaran daerah yang bertujuan untuk mengetahui keberpihakan kebijakan anggaran pemerintah daerah terhadap isu-isu pembangunan hijau di Kota Batu. Data diperoleh melalui analisis dokumen, wawancara mendalam, dan observasi, serta dianalisis menggunakan NVivo untuk mengidentifikasi tema utama, keterkaitan isu, dan prioritas kebijakan. Temuan menunjukkan bahwa kebijakan penganggaran di Kota Batu telah mengintegrasikan isu strategis seperti lingkungan berkelanjutan, pertanian, pariwisata, energi, dan pengelolaan sampah. Namun, terdapat kesenjangan antara prioritas program/kegiatan dan alokasi anggaran, di mana sektor penting seperti perkebunan berkelanjutan mendapatkan dukungan anggaran yang kurang memadai. Partisipasi publik berperan penting dalam perumusan kebijakan, dengan perhatian utama pada perencanaan kota, kemacetan lalu lintas, dan praktik ramah lingkungan di sektor perkebunan. Pengelolaan sampah melalui TPS3R (Reduce, Reuse, Recycle) diakui sebagai praktik terbaik, tetapi inkonsistensi penganggaran menunjukkan perlunya integrasi lebih baik antara visi kebijakan dan realisasinya. Penelitian ini menyimpulakn bahwa penganggaran daerah di Kota Batu telah membahas beberapa isu yang berkaitan langsung dengan pembangunan hijau, di antaranya energi, pengolahan sampah, pariwisata, pertanian, dan lingkungan yang berkelanjutan. Kendati demikian, terdapat gap antara perencanaan dan alokasi anggaran sehingga kebijakan anggaran belum mencerminkan keberpihak terhadap isu-isu penting yang berkaitan dengan ekonomi hijau. Karena itu, partisipasi publik menjadi kunci utama untuk mewujudkan kebijakan anggaran pro pembangunan hijau. Rekomendasi utama penelitian ini, yaitu pemerintah Kota Batu perlu memperhatikan secara serius konsistensi perencanaan dan alokasi anggaran sehingga kebijakan anggaran selaras dengan isu-isu penting pembangunan hijau. Disamping itu, partisipasi publik perlu ditingkatkan dan diperlus untuk memastikan proses penganggaran mengakomodir isu-isu publik yang berkaitan dengan pembangunan hijau
