Abstract

This is a qualitative research about misyar marriage which is largely conducted by many single women in Surabaya. The main case to focus is the background of misyar marriage conducted by many single women in Surabaya as well as how they play two roles-as a single woman and a bride at the same time. This research is conducted by interviewing several women who are directly involved in this type of marriage. The data extracted from the interview is then analyzed through Erving Goffman’s dramaturgical theory. This research concludes two important things: first, the existence of misyar marriage provides solution for the busy women when they do not have time to think about marriage. They, in the busyness, can obtain the pleasure of marriage. It is because in this kind of marriage, husband and wife do not have to live in one house, so a wife can do her activity as she could do before and so can a husband. Second, on the perspective of dramaturgical theory, the practice of misyar marriage in Surabaya concludes that the perpetrators of misyar marriage in Surabaya are an average upper middle women either from the economic or educational aspect. They are smart and agile women to play the two roles at once: when at home, she looks like a single woman, but when at the inn or hotel, she is as a bride. When she is in a quiet place or a bed, she is a bride. However, she claims as a single when doing her activities or joining with other single women.  Tulisan ini merupakan laporan penelitian kualitatif tentang kawin misyar  yang marak dilakukan wanita-wanita single di kota Surabaya. Persoalan utama yang dikaji adalah mengenai hal-hal yang melatarbelakangi (motif) pemilihan kawin misyar bagi para wanita karier di Kota Surabaya serta bagaimana mereka menjalani dua peran –sebagai wanita single dan bersuami-- dalam waktu bersamaan. Penelitian dilakukan dengan mewawancarai beberapa wanita yang terlibat langsung dalam jenis perkawinan ini. Data yang digali dari hasil wawancara itu kemudian dilihat melalui teori dramaturgi Erving Goffman. Penelitian ini menyimpulkan dua hal penting, yaitu: pertama, keberadaan model kawin misyar ini memberikan solusi bagai para wanita yang sibuk dan tidak sempat memikirkan perkawinan. Mereka, di tengah-tengah kesibukan, dapat merasakan nikmatnya perkawinan. Sebab dalam perkawinan ini, suami-istri tidak harus tinggal dalam satu rumah, sehingga istri beraktifitas sebagaimana dia sebelum melakukan perkawinan. Begitu juga dengan sang suami. Kedua, praktik kawin misyar di Kota Surabaya dalam perspektif teori dramaturgi, menyimpulkan bahwa para pelaku kawin misyar di kota pahlawan ini adalah rata-rata para wanita menengah ke atas. Baik dalam segi ekonomi maupun dari segi pendidikan. Mereka cerdas dan lincah dalam memerankan dua peran sekaligus: ketika di rumah layaknya seperti wanita single, tetapi ketika di penginapan atau hotel, maka dia wanita bersuami. Ketika dia berada di tempat sepi atau tempat tidur, maka dia bersuami, tetapi ketika dia berktifitas atau bergabung dengan para wanita lajang, maka dia pun mengaku masih lajang.Kata Kunci: misyar, dramaturgi.

Abstract

Among the sources of Islamic law which is still disputed by Scholars argument is maslahah.  Some scholars reject it, but most agree to make maslahah as one of the sources of Islamic law in matters of ijtihad. Imam Malik considered as a Pioneer Scholar who makes maslahah as one source of his law ijtihad. His view was followed by the other Scholars, one of whom is Najm al-Din al-Tufi, acleric' Hambali.  However, the two leaders of thought are not the same, even in certain cases the difference is very sharp, although in certain parts have in common. In the view of Malik, maslahah serve as a source of  Islamic law in matters which are not discussed formally by nas and ijma ', but must not conflict with the spirit of the passage as a whole. In contrast, al-Tufi used maslahah both in matters discussed by nas/ijma’ or not. As for the area of applying maslahah, both agree that maslahah is only used in the matter of mu'amalah.

Abstract

Islam bukan hanya terdiri dari satu dua aspek saja, tetapi memiliki beberapa aspek, yaitu aspek teologi, ibadah, moral, filsafat, sejarah, kebudayaan, dan lain sebagainya. Semua aspek itu dtulis dan dibahas oleh para ahli sehingga melahirkan berbagai ilmu yang kemudian dikenal dengan ilmu-ilmu keislaman. Semua disiplin ilmu tersebut bersumber pada Al-Qur’an. Dan itu semua ilmu itu terbagi, sbb: ilmu tauhid (teologi), ilmu hukum, ilmu tasawuf, dan ilmu filsafat islam. Semua penjelasan itu sudah ada diatas. Sedangkan aliran-aliran yang ada dalam islam sekaligus berhubungan dalam al-Qur’an, itu sangat banyak sekali. Semua aliran tersebut hasil dari pemikiran orang islam terhadap ajaran-ajaran dasar dalam islam. Pemikiran tersebut merupakan hasl akal manusia karena manusia tidak bersifat ma’sum dan penafsiran ulama itu pun juga tidak bersifat mutalak. Di dalam agama islam, yang terpenting adalah aliran-aliran itu tidak bertentangan dalam ajaran islam yang sesuai al-Qur’an dan hadist.

Abstract

In Islamic teachings, there are five main objectives of Islamic law that appear. One of the five goals is maintenance of the mind. Therefore, in order to maintain the purity of the mind, it is forbidden to consume food or drink that damages the health of the human mind. Like narcotics, methamphetamine, and all kinds of other illegal drugs. However, this law does not apply to people who are sick and can only recover by consuming the drug. In other words, illegal drugs may be consumed when needed in order to achieve one's health. One of the uses of Narcotics for health reasons in Indonesia is legalized as contained in the law of the Republic of Indonesia Number 35 of 2009 concerning Narcotics, especially in article 7. Treatment is a step that is always related to society, where people always need treatment. Drugs containing narcotics are drugs that require special supervision from the pharmacy and are supervised by the government so that their use and circulation are not misused. The definition of narcotics is a substance or drug derived from a plant, both synthetic and semi-synthetic, which can cause a decrease or change in consciousness, relieve pain, and even cause dependence on the user. However, it is different for medical needs, narcotics can still be used. However, the use of narcotics in Indonesia must refer to the rules set by the Ministry of Health.

Abstract

This community service activity through KKN aims to develop a strong religious culture in society, such as increasing worship practices, religion-based social activities, and other religious cultural activities that strengthen the community's Islamic identity. The devotional method is carried out by encouraging cooperation between families in the community in practicing religious values, such as through family study, development of religious human resources, and support between households, as well as developing a strong religious culture in the community, such as increasing the practice of worship, religion-based social activities, and other religious-cultural activities that strengthen the community's Islamic identity. The results of this activity show an increase in the understanding and practice of Islamic teachings in society.

Abstract

Linguistically, Islamic education has the equivalent of Arabic words in the form of tarbiyah, ta'lim, and ta'dib. After reviewing the meanings of the three languages, each of them has a characteristic that has consequences on different target fields. Tarbiyah is more directed to the physical- material aspect; ta'lim leads more to cognitive-intellectual aspects ; ta'dib is more directed towards moral-spiritual aspects. In the study of Naquib al-Attas, in fact the Arabic language which is more appropriate to be used as the equivalent of Islamic education is ta'dib, because ta'dib contains words that focus on the formation of a moral-affective domain, where it is the essence of the goals of Islamic education. However, the study of al-Attas was not automatically agreed upon by other Muslim scientists. Many of them are pro, but not a few contra. Ijtihad al-Attas about ta'dib, although it produced a monumental finding, tarbiyah is still popularly applied in pointing out the language of Islamic education.

Abstract

Studi ini berupaya untuk meninjau dasar-dasar teoretis yang digunakan oleh Abdullah Saeed dan M. Quraish Shihab dalam melakukan studi Tajdid dalam interpretasinya. Meninjau dua landasan teoritis tajdid populer menjadi menarik karena masih ada paradigma sastra dalam memahami teks agama pada umat Islam. Dengan demikian membuat mereka membangun argumen kuat untuk melegalkan tajdid dalam interpretasi mereka. Namun, karena alat ukur yang digunakan berbeda, secara otomatis batas ukuran tajdid yang dihasilkan juga berbeda. This study seeks to review the theoretical foundations used by Abdullah Saeed and M. Quraish Shihab in conducting Tajdid projects in their interpretation. Reviewing their two theoretical foundation of tajdid stretchy to be interesting because there is still a literary paradigm in understanding the text of religion in Muslims. Thus making them first build strong arguments in order to legalize tajdid in their interpretation. However, because the measuring instrument used is different, automatically the size limit of the resulting tajdid is also different.

Abstract

Insemination of donor sperm is an interesting subject to study. There is a chance that the child from the donor's sperm will not be recognized by the parents if it is different from expectations. Therefore, in terms of recognition, both in terms of positive law and Islamic law, it is an interesting problem to study.The aims of this study are: (1) to find out Islamic criminal law views on donor sperm insemination; (2) to find out the form of sanctions insemination of donor sperm according to Islamic criminal law. The design used in this study was normative legal research with a (statute approach) from the perspective of Islamic criminal law. In this study, documentation data collection techniques were used. Analysis technique normative legal research,used was descriptive-analysis with evaluation, interpretive, construction, and content analysis.Islamic criminal law views on donor sperm insemination is haram (forbidden) in Islamic perspective. The law is the same as adultery and children born from this kind of insemination have the same status as children born outside of a legal marriage. Perspective of Islamic criminal law on perpetrators. Artificial insemination with donor sperm cells is not restricted as is the law of fornication in adultery, however, artificial insemination with donor sperm is ta'zir on the grounds that the elements in the hadd of adultery are not fulfilled because there is no direct sexual intercourse.
