Abstract

The research aims at finding values, principles, and norms of customary law in Indonesia that are necessary to improve the concept of rule of law in Indonesia. One of the customary laws that still exists in Indonesia is Rejang customary law (Hukum Adat Rejang) which applies in Rejang society, Bengkulu Province. The existence of Hukum Adat Rejang as customary law is influenced by values of kinship, community groupings and pattern of traditional Rejang tribes. In order to find and identify such norms, a legal anthropological research with a qualitative research would be used. The research was conducted at the District of Rejang Lebong, Lebong, and Kepahyang. The result of the research shows that kinship system of Rejang is based on patrilineal or matrilineal system. Rejang tribes consist of four tribes, they are Petulai Tubeui or Tubai, Petulai Bemani or Bermani, Petulai Jekalang or Jurukalang, Petulai Selupue or Selupu. There are some norms that could be identified in Rejang customary law, namely Bemaling, Menebo, Tikam, Sigar Kulit, Cucuk Kulit, Mea Bayang Daleak, Iram Coa Badaleak, Iram Badaleak, Tukak Takek Kukuk, Membalew, Cido Celako, Kejujung Tenggak, Mendaur Tenggak, Samun, Upet, Dawa, Sumbang, Johong Permayo, Mbut, Tambang, Pascas Poncong, Tepeket, dan Kerineak.Key words: Rejang customary law, institution of adat Rejang, compilation of adat Rejang

Abstract

This research aims to asses values of local law towards forest in six ethnic communities in Bengkulu related to the strategy of forest preservation. This is a normative legal research in a form of local law inventory purposed to find the mechanism of local law in forest preservation in preventive side as well as representative side through impose sanction to the perpetrator of forest destruction. Local law which is effectively regulate in traditional authority has succeeded in engraving moral values to its member which became its justialbelen, where every person by their own awareness actively participate in preserving forest in ulayat area and act carefully based on local forest law. This research purposed to assess the value of local law in six ethnic communities in Bengkulu. From this research we can obtain idea in finding example of legal protection in accordance with local legislation. Furthermore this research may serve as an example for national forest preservation. This research concludes that; first the model of legal protection on local law in six ethnic community of Bengkulu is conducted preventively. Second, the value of local law in ethnic community of Bengkulu can be adopted into local legislations as one of the models of forest preservation in Bengkulu Province through the formulation of academic draft of local legislation.Key words : Forest, custom, local law

Abstract

This study aims to determine and describe the effect of supervision on the effectiveness of budget use in the Kaliorang District Office in East Kutai Regency. Based on the results of the calculation of data analysis, the value of r count is 0.408 then compared with the price of criticism in table r Product Moment at N = 36 with a significance level of 95%, the price of criticism = 0.329. Thus it is proven: r count = 0.408> r table = 0.329 at σ = 95%, it can be concluded that there is a positive and significant influence between financial supervision on the effectiveness of financial use. So the hypothesis proposed in this study can be accepted, namely the existence of a positive and significant influence between financial supervision of the effectiveness of financial management in the Kaliorang District office in East Kutai Regency.               Based on the calculation of the coefficient of determination obtained R Square or r2 value of 25%. So it can be seen that the magnitude of the effect of supervision on the effectiveness of financial use in the Kaliorang District Office in East Kutai Regency is 25%, and 75% is influenced by other factors not measured in this study.               In general, the achievement of the OPD performance in the Kaliorang District Office of East Kutai District as of December 31, 2018 has been able to fulfill the main tasks and functions that have been charged. This can be reflected in the realization of the budget which reached 98.63%. Therefore, there are no significant obstacles in the implementation of the OPD program / activities in the Kaliorang District Office.

Abstract

Sea turtle populations on the Enggano Island are almost extinct as a result of over exploitation. This article aims to discuss harmonization of conservation values between national law and Enggano customary people in protectng sea turtles. It is found that the Enggano customary law norms have conservation values which stated prohibition of catching sea turtles by any means except for adat grandeur ceremonies (yakadea) use only. Sanctions are imposed to those who break the law with customary fines and a compulsary to apology to the chiefs and other Enggano Island communities. It is also learned that to harmonize conservation values between national law and Enggano customary law in protecting sea turtles can be conducted by implementing the norms of turtle protection in the national laws into the Village Regulation, which is an integral part of the hierarchical systems of laws and regulations in Indonesia. Harmonization of the conservation values of the sea turtles through the integration of legal substance is the best model in optimizing the protection of sea turtles without sacrificing the interests of traditional rituals that are still maintained for generations in the life of the Enggano community

Abstract

The government regulates the facilitation of community plantation development as much as 20% of the area of rights by plantation companies. This provision which is the obligation of the company was still not regulated in a clear and firm legal arrangement so that it created multiple interpretations in its application. Based on this matter, the writer was motivated to analyze the legal arrangements for the facilitation of community plantation development by plantation companies and the obstacles encountered in the implementation. The plantation company which was the focus of the research was PT. Pamor Ganda with Business Right (known as HGU in Indonesia abbreviation) Number 16/1989 by studying the HGU extension document. This was a normative research with a statutory approach. The method of analysis performed was content analysis, then the interpretation was carried out to understand the conclusions. The results showed that legal arrangements in the land sector, Micro, Small, Medium Enterprises (MSMEs), and plantations had not been able to solve the problems that exist in the implementation of facilitation of community plantation development by plantation companies. The company's obstacle was that the plasma farmers' plantation area around the companies’ plantation area had not been able to meet the 20% area requirement. While PT. Pamor Ganda had fulfilled its obligation to facilitate community plantation development by releasing its 114 hectare of HGU area.

Abstract

Local government of Ladang Palembang Lebong District has a specific way to managevillage forest and protected forest nearby the village area. Forests are set in theRegulation Village, Ladang Palembang Village Regulation No. 5 of 2009 on VillageProtected Forest, Indigenous Forest, and Green Area of Ladang Palembang. It containsmaterial laws that provide sanctions for any person who violates indigenous forests andprotected forests around the village of Ladang Palembang. However, to enforce the rulesof material law, Kutai assembly faces a lack of procedural law or formal written law thatcan be used as a guide in establishing the Ladang Palembang Village Regulation No. 5 of2009. Problem faced is a concern that skilled human resources are crisis to run Kutaiassembly, which threatens the sustainability of the Kutai assembly judicial system that hasbeen created. The method used in this society service activity is dialogical teaching, beginsfrom focused discussion, in-depth interviews, formulate a draft model of formal legal rulesof customary justice panel of Kutai, the regulation draft of the Ladang Palembang about Proceedings Technical Guidelines on Kutai Assembly Indigenous Justice of LadangPalembang, and testing or socialization. The result of the activities is drafting of formallaw model that governing the guide proceedings in the assembly Kutai, and the draft of theLadang Palembang Village Regulation on guidelines for resolution of cases of violationsinvolving indigenous forest of Ladang Palembang.Key words: forest, indigenous, local law, Kutai assembly

Abstract

This study aims to analyze the arrangement of Village Owned Enterprises in Indonesia and their management in realizing village Sustainable Development Goals. Village Owned Enterprises as socio-economic institutions in villages can realize sustainable development goals in villages. However, most of the existing Village-Owned Enterprises have yet to function optimally in driving the village economy. This is doctrinal legal research with legal, conceptual, and philosophical approaches. This method seeks to discuss the arrangement of Village-Owned Enterprises in Indonesia and the importance of institutional strengthening of Village-Owned Enterprises as socio-economic institutions with legal status in realizing the Sustainable Development Goals in Villages. The institutional arrangement and strengthening of Village-Owned Enterprises, apart from legal and economic aspects, also require social capital support. Rural local customs in the form of local wisdom and customary law norms that are still relevant can be social capital for the institutional strengthening of Village-Owned Enterprises. Based on local wisdom and customary law norms, the institutional management of Village Owned Enterprises can be optimal in realizing the goals of village sustainable development.

Abstract

The aim of writing this paper is to find out the importance of learning English at school. Writing the paper uses the literature review method (library research). From the discussion it can be concluded that learning English at school is very important. The learning method that is very often used is CLT because it is effectively used as a method in the English language teaching and learning process. This is based on the communication skills obtained by students, not just mere knowledge, students will be motivated and feel that something they have learned can be useful and used in language. English is a universal language because it is used by most countries in the world as the main language. Apart from that, English is an international language that is important to master or learn. Several countries, especially former British colonies, place English as a second language that must be mastered after their native language. Moment This, aged child early faced with media digital Which based Language English. So strategies are needed so that young children's English language skills develop more optimal. Method study in matter This is descriptive qualitative, subject study amount 14 child from class A1, 12 child from A2 And 1 Teacher Language English in R.A Arrosyidiyah Sampang. Collection data done with observation, interview, And documentation. The results of research at RA Arrosyidiyah Mambaul Ulum Sampang developed English language learning in the teaching and learning process and providing stimulation to students from an early age school. Strategy learning Language English with method sing, play, ask answer, and make use of the items available in class. Through this strategy, children succeed develop ability Language English with Good. Tujuan penulisan makalah ini adalah untuk mengetahui pentingnya pembelajaran bahasa Inggris di sekolah. Penulisan makalah menggunakan metode tinjauan pustaka (library study). Dari pembahasan dapat disimpulkan bahwa pembelajaran bahasa Inggris di sekolah sangatlah penting. Metode pembelajaran yang sangat sering digunakan adalah CLT karena efektif digunakan sebagai metode dalam proses belajar mengajar bahasa Inggris. Hal ini didasarkan pada kemampuan komunikasi yang diperoleh siswa, bukan sekedar pengetahuan belaka, siswa akan termotivasi dan merasa bahwa sesuatu yang dipelajarinya dapat bermanfaat dan digunakan dalam berbahasa. Bahasa Inggris merupakan bahasa universal karena digunakan oleh sebagian besar negara di dunia sebagai bahasa utama. Selain itu, bahasa Inggris merupakan bahasa internasional yang penting untuk dikuasai atau dipelajari. Beberapa negara, terutama negara bekas jajahan Inggris, menempatkan bahasa Inggris sebagai bahasa kedua yang harus dikuasai setelah bahasa ibu. Saat ini, anak usia dini dihadapkan pada media digital yang berbasis bahasa Inggris. Maka diperlukan strategi agar kemampuan bahasa Inggris anak usia dini berkembang lebih optimal. Metode penelitian pada materi ini adalah deskriptif kualitatif, subjek penelitian berjumlah 14 anak dari kelas A1, 12 anak dari A2 dan 1 orang Guru Bahasa Inggris di R.A Arrosyidiyah Sampang. Pengumpulan data dilakukan dengan observasi, wawancara, dan dokumentasi. Hasil penelitian di RA Arrosyidiyah Mambaul Ulum Sampang mengembangkan pembelajaran bahasa Inggris dalam proses belajar mengajar dan memberikan stimulasi kepada siswa sejak usia dini di sekolah. Strategi pembelajaran Bahasa Inggris dengan metode bernyanyi, bermain, bertanya jawab, dan memanfaatkan item-item yang tersedia di kelas. Melalui strategi ini, anak berhasil mengembangkan kemampuan Bahasa Inggris dengan Baik.

Abstract

Penegakan hukum terhadap pelanggaran Peraturan Daerah Kabupaten Rejang Lebong Nomor 08 Tahun 2012 tentang Rencana Tata Ruang Wilayah Kabupaten Rejang Lebong Tahun 2012-2032. Menurut Pasal 32 ayat (2) Perda No.8 Tahun 2012, lokasi yang dijadikan kegiatan pertambangan batu dan pasir PT. Ryu Putra Perkasa, merupakan kawasan budidaya tanaman pangan. PT. Ryu Putra Perkasa beroperasi sejak tahun 2017, setelah berlakunya Perda RTRW Rejang Lebong. Wilayah penambangan PT. Ryu Putra Perkasa, berada di dalam kawasan budidaya tanaman pangan. Ini melanggar ketentuan RTRW RejangLebong. Hal ini lah yang melantar belakangi penulis untuk melakukan penelitian. Penelitian ini merupakan penelitian hukum empiris. Data yang digunakan meliputidata primer dan data sekunder. Kemudian data dianalisis secara yuridis kualitatif. Berdasarkan hasil penelitian dapat dikemukakan, bahwa upaya penegakan hukum terhadap pelanggaran Perda Kabupaten Rejang Lebong Nomor 8 Tahun 2012 dalam kasus pertambangan Batuan di Kelurahan Talang Benih Kecamatan Curup pada tahun 2022 sudah dijatuhkan sanksi administratif berupa yaitu pemberian teguran tertulis, yang tindaklanjuti dengan sanksi penghentian sementara kegiatan. Pemerintah Rejang Lebong memasang portal untuk membatasi masuknya mobil truk ke lokasi pertambangan. Penutupan berlangsung sekitar 8 bulan. Setelah itu PT. Ryu Putra Perkasa beroperasi kembali sampai sekarang dengan dasar izin No. 114/1/IUP/PMDN/2022 yang diterbitkan pemerintah pusat. Sejak PT. Ryu Putra Perkasa beroperasi kembali dengan izin No. 114/1/IUP/PMDN/2022, pemerintah Rejang Lebong belum melaksanakan penegakan Perda RTRW, pihak penegak Perda (Pol PP Rejang Lebong), mau menindak, namun belum ada perintah dari Bupati. Faktor penghambat penegakan hukum terhadap pelanggaran Peraturan Daerah Kabupaten Rejang Lebong Nomor 8 Tahun 2012 dalam kasus Pertambangan Batuan di Kelurahan Talang Benih Kecamatan Curup, terutama disebabkan bahwa PT.Ryu Putra Perkasa, sudah memiliki izin No. 114/1/IUP/PMDN/2022 yang diterbitkan pemerintah pusat melaluisistem perizinan online, sehingga Pemerintah Daerah Rejang Lebong tidak dapat bertindak cepat menyelesaikan pelanggaran tersebut, karena harus berkoordinasi dengan pemerintah pusat/Gubernur wakil pemerintah pusat di daerah, yang menerbitkan izin tambang bagi PT. Ryu Putra Perkasa.
