Abstract

Legal aid institutions were born to help people who are economically and socially disadvantaged, and whose legal knowledge is minimal. Apart from that, the desire to realize the supremacy of law for all citizens, its existence is also very important in society considering the principle of equality before the law. In this community service, we will discuss the Socialization of Free Legal Aid for the Poor as an effort to maximize the free legal aid program for the poor to fulfill access to justice for the less fortunate. The method used in this activity is a directed discussion with the target community. This discussion is attended by all interested elements. Based on the results of the counseling, it was found that there was an increase in knowledge, understanding and ability of the community in Lanto Village, Batu Poaro District regarding free legal aid procedures for the poor.

Abstract

Penerbitan Izin Kapal Perikanan Dibawah 5 Gt melalui Sistem Informasi Izin Kapal Daerah Di Dinas Perikanan Kota Baubau. Penelitian ini adalah penelitian hukum empiris (sosiologis). Teknik pengumpulan datanya meliputi: untuk data primer melalui wawancara dan observasi lapangan. Sedangkan untuk data sekunder melalui penelusuran terhadap peraturan daerah dan buku-buku yang relevan dengan penelitian ini. Jumlah responden adalah 11 orang terdiri dari Kepala Dinas Perikanan, Kepala Bidang Perizinan dan Pengelolaan TPI, Kepala Seksi Perizinan Usaha Perikanan , Staf Perizinan Usaha Perikanan, dan Masyarakat yang memiliki Kapal Perikanan. Hasil penelitian menunjukkan bahwa Penerbitan Izin Kapal Perikanan Dibawah 5 Gt melalui Sistem Informasi Izin Kapal Daerah di Dinas Perikanan Kota Baubau yaitu a.) Pas Kecil merupakan Tanda Kebangsaan Kapal yang wajib dimiliki oleh nelayan yang mempunyai kapal dibawah 5 Gross Tonage (GT) yang merupakan wewenang Kantor Unit Penyelenggara Pelabuhan Kelas I Baubau dalam penerbitannya. b.) Bukti Pencatatan Kapal Perikanan dibawah 5 Gross Tonage (GT) melalui aplikasi SIMKADA pada Seksi Perizinan Usaha Perikanan. Namun belum optimal ditunjukkan dengan tingkat kesadaran masyarakat nelayan/pemilik kapal daerah dalam pengurusan dokumen kapal perikanan dibawah 5 Gross Tonage (GT) secara mandiri masih sangat rendah yang memiliki tingkat persentase sebesar 2 %.

Abstract

Abstrak Salah satu bentuk hukum yang berperan nyata dan penting bagi kehidupan masyarakat adalah Hukum Perjanjian. Secara yuridis pengertian Perjanjian yang terdapat dalam Kitab Undang-undang Hukum Perdata (KUH Perdata) pada pasal 1313, disebutkan bahwa “Perjanjian adalah suatu perbuatan di mana satu atau dua orang atau lebih mengikatkan dirinya terhadap satu orang lain atau lebih”.PT. Colombus Baubau dalam melakukan perjanjian terhadap konsumen merupakan perjanjian baku atau biasa disebut kebebasan berkontrak hal ini sangat merugikan konsumen disaat terjadinya wanprestasi,perlunya perjanjian sewa beli di PT.Colombus memilih jalan untuk melakukan perjanjian yang disebut fidusia. Metode penelitian yang digunakan adalah yuridis Normatif dan Empiris. Kata Kunci: Perjanjian, Kebebasan Berkontrak, Fidusia Abstract One form of law that plays a real and important role in people's lives is the Law of the Agreement. Juridically, the understanding of the Agreement contained in the Civil Code (KUH Perdata) in article 1313, states that "A contract is an act in which one or two people or more bind themselves to one or more other people".PT. Colombus Baubau in making agreements with consumers is a standard agreement or commonly called freedom of contract, this is very detrimental to consumers when a default occurs, the need for a lease purchase agreement at PT. Colombus chooses to enter into an agreement called fiduciary. The research method used is Normative and Empirical juridical. Keywords: Agreement, Freedom of Contract, Fiduciary

Abstract

Various acts of persecution that often occur in Baubau City, especially serious persecution, are a big task for law enforcement officials of Baubau Police in overcoming them. the problem that will be used as a source of reference to be researched is how to overcome the crime of serious persecution by Baubau Police satreskrim and its inhibiting factors. This type of research is normative empirical with primary and secondary data types and will then be analysed using descriptive qualitative. based on the results of the study it was found that the handling of cases experienced fluctuations in the number where there was a significant increase in the last year. The conclusion is that the process of overcoming crimes of serious maltreatment committed by the Baubau resort criminal police unit in the jurisdiction of the Baubau resort police must build a pattern of cooperation with other agencies in order to overcome the obstacles experienced in overcoming crimes of serious maltreatment influenced by the lack of personnel members of the Criminal Investigation Unit infrastructure facilities, and community culture
