Abstract

Act number 28 of 2014 on Copyright regulates that the Copyright as a movable intangible objects can be used as fiduciary transfer of ownership. Provisions regarding Copyright as the object of fiduciary transfer of oiwnership will be implemented in accordance with the provisions of the legislation applied. But practically, it is still being debated, both from the holders of copyright, as well as banks and Notaries as the official maker of the Deed of Fiduciary because there is no implementing regulations are clear, so recently there is no party that provides credit with collateral in the form Copyright. This research aims to study the binding mechanism of Copyright as fiduciary transfer of ownership’s object in lending in terms of readiness of the Appraisal authority to determine the economic value of the collateral. This type of research is normative juridical research.

Abstract

The purpose of this community service program are to change the previous paradigm of local people who assumed that waste is a useless material, to a new paradigm which believed that waste can be potential a raw material for handicraft that have economic value, provide skill through training to make handicraft made from plastic waste and change the old pattern of collect-transport-throw away, into 3R patterns, ie reduce, reuse and recycle and also establish a waste management group. The method of this community service program was implemented in 3 (three) stages, Firstly counseling in improving environmental awareness. Secondly, training how to recycle plastic crackle and sachet, and thirdly, assisting garbage management group. The result of this service program are  that there is a change of paradigm of the service program’s partners who previously throw garbage carelessly, recently they are already have awareness of sorting the waste between non recyclable and recyclable, citizens also have the skills to produce handicrafts made from the raw materials of plastic waste. In addition, there is existing group which is expected to be the future “Bank Sampah”. Keywords = waste, recycle, plastic waste.

Abstract

The purpose of this research is to find out that the industrial revolution 4.0 has had a significant impact, especially in the use of technology and the internet in daily human activities, both in personal life and in economic activities. This study used a normative legal research method that examines various legal theories related to financial technology both in Indonesia and other countries. The P2P lending service carries out business activities by providing, managing, and operating money-borrowing services by utilizing information technology as a liaison. Peer to Peer (P2P) Lending in Indonesia is regulated in POJK No. 77/POJK.01/2016 concerning Information Technology-Based Lending and Borrowing Services. This regulation is the basis for the implementation of P2P Lending business activities or online borrowing, which is one type of fintech, including regulations regarding supervision carried out by the Financial Services Authority (OJK) on the implementation of these business activities. However, in practice, lending by P2P Fintech has attracted a lot of controversies because there are still many problems, including interest arrangements, the rise of illegal fintech applications and also the weakness of consumer protection where these things have not been fully addressed and regulated by POJK No. 77/POJK. 01/2016.

Abstract

Pengembang perumahan dalam menjalankan usahanya dapat memperoleh bantuan pembiayaan dari pihak lain. Namun seringkali dalam perjanjian utang-piutang pengembang perumahan atau debitor tidak dapat melunasi utangnya hingga waktu jatuh tempo. Sehingga pengembang perumahan dapat dimohonkan pailit oleh kreditornya. Sehingga rumah yang belum beralih kepemilikannya kepada pembeli akan menjadi boedel pailit dan berada di bawah pengawasan kurator dan hakim pengawas. UUK dan PKPU tidak memberikan kejelasan kedudukan pembeli dalam kepailitan. Posisi ini memberikan kerugian kepada pembeli dalam proses kesepakatan pembayaran piutang. Dalam penelitian ini menggunakan studi putusan Pengadilan Niaga Nomor : 21/Pdt.Sus-Pailit/2020/PN.Niaga Jkt.Pst.Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan hukum terhadap hak-hak pembeli dalam perjanjian jual-beli rumah dengan pengembang perumahan yang diputus pailit dan untuk mengetahui bagaimana Pelaksanaan Pembagian pembayaran piutang kepada para kreditor khususnya kepada kreditor konkuren yang proposional sehingga mewujudkan pembayaran piutang yang adil. Dalam penelitian ini menggunakan jenis penelitian yuridsi normatif, kemudian menggunakan teknik analisis data kualitatif deskriptif. Hasil dari penelitian ini menunjukkan bahwa segera dilakukan pemecahan sertifikat induk. Pemberian hak milik atas rumah bertujuan untuk memberikan kepastian hukum kepada pembeli. Sehingga apabila ditengah jalan pengembang perumahan dinyatakan pailit, status rumah tersebut tidak akan menjadi boedel pailit. Pembayaran kepada kreditor konkuren melalui presentase, yang selanjutnya pembagian menggunakan prinsip pari passu pro rata parte. Yang berarti harta kekayaan debitor merupakan jaminan bersama untuk para kreditor dan hasilnya harus dibagikan secara proposional antara mereka. Dalam UUK dan PKPU memberikan title eksekusi kepada seluruh kreditor yang tagihannya belum dibayar lunas untuk menuntut pemenuhan pembayaran utang dikemudian hari.

Abstract

ASEAN has agreed to run a single market through the ASEAN Economic Community (AEC). The consequence of this free flow of goods and services is the emergence of new business competition, new relevant markets and potential contact amongst business actor of ASEAN member and it is possible to create unfair business competition. The implementation of the AEC also has consequences in the field of regulation, specifically the need for harmonization of regulations on competition law in ASEAN member to overcome the problems of cross-border transactions and the absence of competition law in several ASEAN member. This study uses a normative juridical method and aims to examine harmonization of competition law, a research on the transplantability of EU’s law into ASEAN. Results of this research shows that ASEAN can only adopt the European Union's supranationalism system only for cases of violations of cross border competition law, whereas for cases of violations of national competition laws, each country is given sovereignty to apply its own law. This is because the economic characteristics and legal characteristics of business competition vary between ASEAN member countries.

Abstract

Technology has become an essential part of human activities, people's needs and demands for it are significantly increased. People have become dependent on technology because they use it to travel, communicate, learn, do business and simplify human life. Currently, technology-based companies are growing rapidly all over the world, as we can see how Google, Facebook, Twitter, Microsoft, Apple, and various other companies dominate the market. Likewise in Indonesia, people's activities cannot be separated from various products from technology-based companies, such as Gojek, Tokopedia, Shopee, Grab, Traveloka, etc. Recently, Gojek and Tokopedia officially merged to become the GoTo Group and are claimed to be the largest technology group in Indonesia. This merger is usually carried out by business actors to seek more profit and to become a company that wins the market both on a national and international scale and in fact has a significant impact on changes in structure and control over the market so that there is a potential for abuse of dominant position to occur by limiting the choice of both products, quality, and price. Based on this case, this normative research using the case approach and statute approach aims to analyze how Indonesian competition law regulates technology company mergers, by comparing it with European Union competition law. The conclusion of this research is, lesson learn from European Union, Indonesian Competition Law needs to adapt the Data Protection Law in reviewing tehcnology company mergers in Indonesia.

Abstract

Di era globlalisasi yang semakin modern memunculkan adanya fenomena influencer yang kini mulai mencuri perhatian publik sebagai metode pemasaran yang efektif dalam menjangkau target pasar, strategi promosi produk yang digunakan yaitu dengan melibatkan para influencer untuk mempengaruhi masyarakat agar membeli produk yang mereka promosikan melalui media sosial. Promosi melalui influencer endorser ini dianggap efektif dalam meningkatkan niat beli di era digital. Dalam penelitian ini bertujuan untuk mengetahui pertanggungjawaban beberapa influencer, terhadap promosi produk melalui media sosial Instagram. Fokus penelitian ini adalah untuk menganalisa praktik tanggung jawab dan transparansi influencer dalam mempromosikan produk kepada audines mereka, meliputi analisis promosi produk melalui Instagram, yang menjadi platform paling banyak digunakan dalam praktik promosi influencer saat ini. Jenis penelitian ini yaitu penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendeketan konseptual, Data yang digunakan yaitu data sekunder yang didapatkan melalui studi pustaka dan literatur yang berkaitan dengan permasalahan. Bahan hukum yang digunakan yaitu bahan hukum primer dan bahan hukum sekunder. Data yang didapatkan kemudian dianalisis secara kualitatif dengan menggunakan metode teknik analisis data deskriptif analitik.

Abstract

This community service is to optimize product marketing through assistance in creating a BUMDes digital platform called belanjadesa.id. There are four stages in implementing this program: problem identification, program conceptualization, program implementation, and monitoring and evaluation. The results of the program's performance show that the conceptualization designed two programs that will be implemented: training in operationalizing digital platforms as a marketing method and assisting in creating a digital platform for belanjadesa.id. To carry out the service, all training involves all BUMDes Katon margo Sembada administrators actively. Second, several feature designs in belanjadesa.id provides convenience to buyers, such: as first, there is a login menu to enter the digital platform Belanjadesa. Id to find out the buyer's biodata; second, there is a product type feature to make it easier for buyers to know the type of product being sold; Third, there is product information in the form of descriptions, prices, categories, and product weights to provide information related to the products sold. The output target is expected to increase business and revenue and create a digital culture at BUMDes Katon Margo Sembada to accelerate the economic recovery affected by the Covid-19 pandemic in Margokaton Village.

Abstract

In the era of globalization, the protection of personal data has become a critical issue in Indonesia, especially within the e-commerce sector. Cases of this nature underscore the significance of safeguarding personal data and enforcing stringent legal measures. This research employs a normative juridical legal study that integrates two primary approaches: the legislative approach and the comparative approach. The research data sources comprise primary, secondary, and tertiary legal materials obtained through a comprehensive literature review. The data analysis process is conducted using a descriptive method and applying deductive logic. The growth of e-commerce users in Indonesia has witnessed a significant increase. Law Number 27 of 2022 regulates the principles of personal data protection, encompassing the rights of data owners, transparency, and meticulous data management. While considered positive, a comparison with Malaysian regulations, such as the Personal Data Protection Act 2010, reveals fundamental differences that warrant attention. The implications of the regulation on the transfer of personal data in Law Number 27 of 2022 play a crucial role for e-commerce companies. They must ensure the security of consumers' personal data and adhere to legal principles to maintain consumer trust in an increasingly competitive market.
