Abstract

Hak Cipta sebagai benda bergerak yang tidak berwujud memiliki aspek Hak Ekonomi dan Hak Moral yang dapat dialihkan melalui pewarisan. Namun Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta tidak menjelaskan dan mengatur secara rinci tata cara pengalihan Hak Cipta melalui pewarisan. Adapun pengalihan Hak Cipta termasuk Hak Cipta atas Karya Buku harus diajukan dengan permohonan pendaftaran pada Direktorat Jenderal Kekayaan Intelektual (Dirjen KI) dan diumumkan dalam Berita Resmi pada Dirjen KI. Permasalahannya adalah bagaimana pengaturan hukum tentang Hak Cipta atas karya Buku dan bagaimana kajian yuridis tentang pengalihan Hak Cipta atas karya Buku ditinjau menurut Hukum Waris Perdata di Indonesia. Sedangkan tujuan penelitian adalah untuk mengetahui pengaturan hukum tentang Hak Cipta atas karya Buku dan untuk mengetahui kajian yuridis tentang pengalihan Hak Cipta atas karya Buku ditinjau menurut Hukum Waris Perdata di Indonesia. Penulisan artikel ini menggunakan jenis Penelitian Hukum Normatif dengan metode pengumpulan data Penelitian Kepustakaan dan jenis data dari Data Sekunder, yang berasal dari dokumen resmi, buku, jurnal ilmiah, internet dan peraturan perundang-undangan. Pengalihan Hak Cipta melalui pewarisan dapat dilakukan setelah Pencipta atau Pemegang Hak Cipta meninggal dunia dan warisan secara otomatis diberikan kepada Ahli Waris. Sistem Hukum Waris yang digunakan dalam pengalihan Hak Cipta adalah melalui Hukum Waris Perdata. Pengalihan Hak Cipta atas karya Buku ditinjau dari sudut Hukum Waris Perdata di Indonesia dapat dilakukan berdasarkan Surat Wasiat, Perjanjian Tertulis dan ditetapkan berdasarkan Golongan Ahli Waris. Kesimpulannya diundangkannya Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yang mengatur tentang Ciptaan atas karya Buku dan peralihan Hak Cipta dapat dilakukan dengan cara Surat Wasiat, Perjanjian Tertulis dan berdasarkan Golongan Ahli Waris yang diatur dalam KUH Perdata dan Buku dapat dijadikan warisan dalam bentuk lisensi atau royalti yang diatur dalam UUHC. Diharapkan pemerintah memberikan penyuluhan kepada masyarakat mengenai Hak Cipta khususnya karya Buku dan Pencipta Buku dapat mengalihkan ciptaannya dengan mengajukan Permohonan Pendaftaran pada Direktorat Jenderal Kekayaan Intelektual (Dirjen KI) di Jakarta atau melalui Kantor Wilayah Kementerian Hukum dan HAM di daerah.

Abstract

A fiduciary guarantee certificate or deed is required for the execution or withdrawal of cars, according to Law Number 42 of 1999 respecting Fiduciary Guarantees. The question that this essay seeks to answer is: How are fiduciary guarantees governed in Indonesia? What factors lead to creditors forcibly retaking motorcycles? Regarding PT. Adira Dinamika Multifinance Branch 0601 Medan Graha Niaga's Law No. 42 of 1999 concerning Fiduciary Guarantees, how well-protected are debtors against attempts to forcibly withdraw motorized vehicles? This study employs a descriptive interviewing method in conjunction with an empirical research design. Primary, secondary, and tertiary legal sources are used as secondary data in qualitative research, and the research site is the PT office. Branch 0601 of Adira Dinamika Multifinance, Medan Graha Niaga The Fiduciary Guarantee Law, the Housing and Settlement Law, and the Copyright Law all regulate fiduciary guarantees in Indonesia. Aspects of Debtor Default, The creditor may withdraw the object of fiduciary collateral in order to transfer fiduciary objects and prevent them from being freely surrendered. The inference drawn is that fiduciary promises must underpin all commercial agreements in order to provide debtors with fair and transparent legal certainty. The government and police have been advised to keep offering debtors legal protection when it comes to carrying out fiduciary guarantees.

Abstract

Intellectual Property Rights (IPR) are rights to property that arise and are born from human intellectual abilities. Whereas Communal Intellectual Property (KIK) is the result of copyrights, works, and cultural traditions that have been passed down from generation to generation by a group of people. Communal Intellectual Property includes Traditional Knowledge (PT), Traditional Cultural Expressions (EBT), Genetic Resources (SDGs), and Geographical Indications (GI). The purpose of this study is to study of Intellectual Property Rights in Indonesia and to determine the role of the Regional Government in protecting and guaranteeing the Communal Intellectual Property of the Batak Toba ethnicity. This type of thesis research uses normative legal research with a qualitative approach method, the research method used, namely Library Research, with data collection techniques using Secondary Data which is divided into Primary Legal Materials, Secondary Legal Materials and Tertiary Legal Materials. The efforts to know about the Batak Toba KIK are based on a statutory regulation, namely Law Number 28 of 2014 concerning Copyright and the efforts of the Regional Government to protect and develop the Batak Toba KIK by registering it with the Directorate General of Intellectual Property (DJKI). Suggestions from researchers are that Batak Toba KIK can be protected by establishing separate KIK laws and regulations, forming a KIK handling group in the midst of society and changing the concept of Batak Toba people's thinking about preserving and protecting Batak Toba ethnic KIK

Abstract

The execution of assets by creditors often raises disputes, especially in terms of debtors' rights that are not always well protected. Civil Law regulates the contractual relationship between the Creditor and the Debtor, but in the execution of execution, it is often found that the rights of the Debtor are neglected, especially in the execution of Land and Buildings which are important assets for the Debtor. There are three problems discussed in this Journal, namely, (1) What is the general view of Land and Buildings in Indonesia?, (2) What are the factors that cause Land and Buildings to be executed according to Civil Law? and (3) How to legally protect creditors for the execution of Land and Buildings according to the perspective of Civil Law based on Decision No.355/Pdt.G/2023/PN. Terrain. The type of research is Normative Law, with the nature of Analytical Descriptive Research, The research method used is literature research or document study. The types of data used are primary data and secondary data. In the perspective of Civil Law, the relationship between the Creditor and the Debtor is contractual, where both parties have rights and obligations regulated by the Laws and agreements.Enforcement regulations in the Civil Law in Indonesia need to be strengthened to prevent abuse of rights by creditors, as well as to protect the rights of debtors, especially in terms of land and building execution.
