Abstract

Dalam dunia kerja sering ditemukan perusahaan mempekerjakan anak sebagai pekerja. Sementara anak seyogyanya masih memerlukan kasih sayang dan pendidikan yang layak dalam satu sisi, sementara disisi lain anak akibat situasi tertentu terpaksa untuk bekerja dalam membantu memenuhi kebutuhan keluarga dan hidupnya.

Abstract

The Presence of maid servants in this modern time are needed very much by a lot of people, especially for the cityzenshios. In working the servants sometimes get the unconfortable teatments like the other workers. The maid servants have to be able to de many houses works, no limit times and get the low wages, and very often are treated as the masters like (the hosts of the houses). These bad conditions are very often hidden result of low loegal protections that are given to the maid servants, mainly that related to the fulfilment of normative rights of workers as being valid usually.

Abstract

Aspek Hukum Dalam Perdagangan Bebas merupakan salah satu mata kuliah yang diajarkan pada Fakultas Hukum. Ada beberapa kendala yang dihadai dalam proses belajar menagajar mata kuliah ini. Bebarapa diantaranya adalah pemebalajaran masih konvensional yang dilakukan dengan strategi sajian presentasi yang monoton dan tidak memberikan kesempatan kepada mahasiswa untuk mengartikulasikan tentang hal yang dipelajari dan cenderung membosankan. Oleh karena itu diperlukan suatu tindakan untuk memperbaiki proses pembelajaran dan diharapkan terjadinya penigkatan hasil belajar. Salah satu model pembelajaran yang dikembangkan sekarang adala Pembelajaran Berbasis Masalah (Problem Based Learning). Pengajaran ini menggunakan masalah dunia nyata sebagai suatu konteks belajar bagi mahasiswa tetang cara berfikir kritis dan ketrampilan pemecahan masalah. Tujuan penelitian ini, meningkatkan proses dan hasil belajar mahasiswa dengan model pembelajaran problem based learning. Penelitian ini merupakan penelitian tindakan kelas (classroom action research) yang dilaksanakan dalam dua siklus. Sikus pertama dimulai dengan identifikasi masalah yang ada didalam kelas, perencanaan berupa penyusunan langkah-langkah pembelajaran melalui penggunaan model pembelajaran problem based learning, pelaksanaan tindakan, observasi, evaluasi, analisis dan refleksi untuk tidakan pada siklus kedua. Subjek penelitian adalah mahasiswa semester V Fakultas Hukum tahun ajaran 2015/2016. Data diperoleh melalui angket efektif dan kepuasan terhadap pembelajaran, ranah psikomotorik diperoleh dengan observasi. Teknik analisis data dengan menggunakan teknik analisis interaktif. Berdasarkan hasil penelitian menunjukkan bahwa penggunaan metode pembelajaran problem based learning (PBL) dapat menigkatkan proses dan hasil belajar mahasiswa semester V Fakultas Hukum t.a 2015/2016. Hal ini terlihat dari meningkatnya kedisiplinan, keseriusan dan kesenangan dalam mengikuti perkuliahan serta keaktifan dan keberanian mahasiswa menyampaikan pendapat dan hasil tes akhir perkuliahan.

Abstract

Mata Kuliah Hukum Hak Asasi Manusia ,erupakan mata kuliah bersifat teoritis dan dogmatis yang sangat membosankan bagi mahasiswa. Apalagi pembelajaran yang digunakannya dengan model ceramah. Akibatnya keterlibatan mahasiswa bersifat pasif sehingga dapat berpengaruh pada prestasi belajar mahasiswa. Model Jigsaw ditawarkan sebagai solusi untuk memotifasi keterlibatan dan prestaasi mahasiswa dalam pembelajaran hukum hak asasi manusia. Penelitian ini merupakan penelitian kualitatif dengan menggunakan analisis dekrptif. Data yang digunakan terdiri dari: data sekunder dan data prmer. Populasi dari penelitian ini adalah mahasiswa semester IV Fakultas Hukum UMSU. Sampel dalam penelitian ini adalah semester IV /D1 dan IV/E1 Fakultas Hukum angkatan 2014/2015, dan respondennya adalah seluruh mahasiswa semeseter IV /D1 dan IV/E1 yang berjumlah 62 (enam puluh dua) mahasiswa.Berdasarkan hasil pdenelitian dapat dinyatakan bahwa 90% mahasiswa menyatakan bahwa model Jigsaw dapat meningkatkan keterlibatan dalam pembelajaran hukum hak asasi manusia. Bahkan 35% mahasiswa yang mengikuti tes ujian dengan membandingkan skor nilai rata-rata mahasisw pada UTS dan UAS menunjukkan peningkatan prestasi nilai dengan rentang nilai 80 – 100.

Abstract

This study is intended to explain the legal protection given to elementary school children to get the right to education during the COVID 19 period. Because education for children is a child's right that must be fulfilled as a human right. Moreover, the right to education has been explicitly guaranteed in the Amendment to the 1945 Constitution. For this reason, legal research is carried out with an empirical juridical approach which intends to study and analyze the workings of law in society by using secondary data and primary data. The secondary and primary data collected were analyzed qualitatively, then the results were described. Based on an analysis conducted on research conducted in Firdaus Village, Serdang Bedagai Regency, that the right to education for elementary school children during the COVID 19 period was still being fulfilled despite the prohibition on conducting face-to-face learning processes at schools. The implementation of education is carried out through distance learning meetings in the network and distance learning outside the network. In addition, it was also found that there was limited face-to-face learning. However, the use of this learning method takes into account the development of the COVID-19 situation and also the facilities owned by schools, teachers and the condition of students in participating in learning. Schools and teachers evaluate children's education to determine the learning process that will be used.

Abstract

The purpose of this study was to increase student activity and learning achievement seen from the activities in mastering the material and carrying out the assignments given to achieve the expected learning achievement. That learning is no longer understood as merely a knowledge transfer process but must be practiced by students. As a form of implementation of activities carried out by each law student. The specific target of this research is as an effort to increase student activity and learning achievement, activities carried out by students are doing classroom practice through the gallery walk method. This research is in the form of Classroom Action Research  which consists of three cycles. The approach used in research is qualitative-quantitative to obtain research data. Quantitative data is obtained through giving tests, while qualitative data is based on the results of observations of the activities and achievements of students and lecturers in learning activities. Each cycle includes four stages, namely planning, action, observation, and reflection. The data sources of this research are all personnel who are directly involved in the research, namely first semester law students and lecturers. The tools used in data collection in this study were tests, observations and questionnaires. The types of data to be analyzed are quantitative and qualitative data. Quantitative data were obtained from the results of activity tests and student achievement on Pancasila learning material. Meanwhile, qualitative data in the form of observations of the gallery walk method of students in learning and lecturer activity data on the implementation of the action. Furthermore, the data will be analyzed qualitatively with the model of Miles and Huberman (2007) which includes (a) data reduction, (b) data presentation, and (c) drawing conclusions / verification and quantitative analysis by calculating achievement and activity observation data. learn law students using the Percentage Correction formula

Abstract

Guru memiliki peran sentral dalam peningkatan potensi siswa sebagimana diamanahkan udang-undang. Dalam pelaksanaan tugas kepropesiannya sering dituding melakukan perbuatan yang tidak terpuji terhadap siswanya. Akibatnya guru diperlakukan secara sewenang-wenang oleh berbagai pihak. Untuk meghidarinya perlu diteliti bagaimana perlindungan hukum bagi guru dalam pelaksanaan tugas utamanya. Untuk menjawabannya dilakukan penelitian hukum dengan menggunakan data sekunder (library research) berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Data dianalisis secara kualitatif dengan menggunakan metode deskriptif. Berdasarkan pembahasan ditemukan bahwa guru harus memiliki kopetensi dan memahami akan hak dan kewajiban dalam menjalankan profesinya. Perlindungan Hukum bagi guru masih perlu dipertegas dengan kesepakatan kerjasama antara PGRI dan POLRI, dan Jurisprudensi sebagai pegangan bagi berbagai pihak dalam menangani permasalahan guru.

Abstract

This study aims to analyze the legal certainty of a settlement agreement on a default dispute through negotiation. The desire to resolve the default dispute through negotiations is stated in a peace agreement. In order for the peace agreement to be effective, it is necessary to look at the legal certainty aspect. For this reason, a research was conducted with a normative juridical approach and using secondary data sourced from the literature. Secondary data were analyzed qualitatively and the results were described. Based on the analysis, it was found that the peace agreement in the negotiation is categorized as one type of agreement which is subject to the provisions of the Civil Code and Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. Legal certainty and the legal force of a breach of contract peace agreement through negotiation are obtained from the implementation of Article 1338 paragraph (1) of the Civil Code relating to the principle of pacta sun servanda and Article 1858 of the Civil Code, as well as the formal requirements for a peace agreement to be in writing

Abstract

This article wants to find several styles and models of spirituality in modern society that arise due to inner uncertainty in interpreting life in the modernization era. Modernity has indulged in ease and promised luxury in life as well as worship of science and technology and abandoned religious teachings. This research is of a normative type with a sufistic approach and is descriptive in nature which produces five features and two models namely: 1) heteronomy spirituality, 2) autonomous spirituality, 3) interactive spirituality, 4) extactic spirituality, and 5) constructive spirituality and 1) post-spirituality, and 2) urban sufism.Artikel ini ingin menemukan beberapa corak dan model spiritualitas masyarakat modern yang muncul akibat ketidakpastian batin dalam memaknai kehidupan di era modernisasi. Kemodrenan telah mengumbar kemudahan dan menjanjikan kemewahan dalam kehidupan sekaligus pemujaan terhadap ilmu pengetahuan dan teknologi serta meninggalkan ajaran agama. Penelitian ini berjeniskan normatif dengan pendekatan sufistis serta bersifat deskriftif yang menghasilkan lima corak dan dua model yakni: 1) spiritualitas heteronomy, 2) spiritualitas otonom, 3) spiritualitas interaktif, 4) spiritualitas ekstaktik, dan 5) spiritualitas konstraktif serta 1) post-spiritualitas, dan 2) urban sufism.
