Abstract

Inheritance law (erfrecht) is a set of norms or rules that regulate the transfer or transfer of rights and obligations (assets) from people who die (heirs) to people who are still alive (heirs) who have the right to receive them. Or in other words, inheritance law is a regulation that regulates the transfer of assets of a person who dies to one or several other people. Customary inheritance law is customary law which contains provisions regarding the system and principles of inheritance law, regarding the transfer of control and ownership of inherited property from the heir to the heirs. Traditional inheritance law is actually the law of passing on assets from one generation to the next. Distribution of inherited assets in the Karo traditional community, which is different from the way inheritance is distributed in law. In the Karo traditional community, the distribution of inherited assets depends on the family, so inherited assets will be passed on to the family and will not be passed on to individuals. Legal plurality. Karo custom places men and women in an unequal position. Boys as clan bearers receive honors in various traditional events, including in the process of dividing inheritance. Karo men are positioned superior to women in various sectors of life. There is a tendency for parents, both men and especially mothers, to give inheritance to their daughters in two ways, namely gift and will.

Abstract

This study aims to analyze the implementation of community empowerment policies through the Village Development Planning Meeting (Musrenbangdes) in the development process of Sampali Village, Percut Sei Tuan Subdistrict. Musrenbangdes is a participatory forum designed to actively involve village communities in planning both physical and non-physical development. Using a descriptive qualitative approach, data were collected through interviews, observations, and documentation. The research findings indicate that the implementation of Musrenbangdes in Sampali Village has aligned with the principles of participation, transparency, and accountability. The involvement of various community elements demonstrates democratization in the village development planning process. However, challenges remain regarding the quality of participation due to limited access to information and policy literacy. Therefore, the active role of facilitators in providing political education is crucial to enhancing the effectiveness of empowerment. Overall, the implementation of this policy reflects the spirit of the Village Law, which places the community as the main subject of village development.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan serta upaya yang dilakukan oleh perempuan Karo dalam memperoleh kesetaraan hak waris di Desa Bukit Makmur, Kabupaten Karo. Dalam sistem kekerabatan patrilineal Karo, hak waris secara tradisional diberikan kepada anak laki-laki sebagai penerus marga, sementara anak perempuan hanya menerima pemere yang sifatnya tidak pasti dan tidak dianggap sebagai warisan. Kondisi ini sering menimbulkan ketidakadilan serta kesenjangan hak antara laki-laki dan perempuan. Penelitian ini menggunakan metode hukum normatif-empiris dengan pendekatan deskriptif kualitatif melalui studi pustaka, observasi, wawancara, dan dokumentasi. Penelitian ini juga mengkaji pertentangan antara ketentuan adat Karo dan hukum nasional, khususnya Putusan Mahkamah Agung Nomor 179 K/SIP/1961 yang telah di Yurisprudensi Mahkamah Agung No. 03/Yur/Pdt/2018 yang menegaskan kesetaraan hak waris bagi perempuan. Penelitian ini memperoleh data melalui wawancara dengan tokoh adat, perempuan Karo dan pemerintahan desa di Desa Bukit Makmur. Hasil penelitian menunjukkan adanya kesenjangan antara hukum adat Karo dan hukum nasional dalam pembagian warisan, di mana hukum adat masih dominan sehingga hak perempuan belum sepenuhnya setara. Upaya perempuan Karo dalam memperoleh hak waris umumnya dilakukan melalui musyawarah keluarga karena keterbatasan akses dalam forum adat. Kesimpulan penelitian ini adalah kesetaraan hak waris perempuan Karo belum sepenuhnya terwujud dan masih bergantung pada keputusan keluarga, meskipun mulai terlihat adanya perubahan menuju kesetaraan.
