Abstract

Allah SWT. ordered His servants to spend some of their wealth in terms of goodness, such as waqf, zakat, infaq, sedeqah, hibbah and so on. This study uses qualitative research methods, with the type of library research. While the analysis used is comparative inductive. This research produces findings about the management and development of productive waqf, both from the aspect of Islamic law and legislation. In Law No. 41 of 2004 article 15 states that the meaning of waqf is a legal act of a person or group that separates part of his property to institutionalize it forever for the benefit of worship or other public purposes and in accordance with Islamic teachings. Productive waqf can be used for production purposes, be it from agriculture, industry, trade and services whose benefits are not directly on waqf objects but through net profits from the results of waqf development given to entitled people. And the right steps for productive waqf need to be developed a system of management and development of waqf by sharing models and business management to alleviate poverty and prosper the people, nation and state.

Abstract

Kind of this research is literary research, and the metode of this research is qualitative reseach which collecting the data by analyze some refrences especially Tafsir, Fiqh, and another refrence as second data. Based on the data collected and analyezed the get a conclusion. The result of this research is the decision of Islamic law about the using the wealth of an orphan is fobiden and even comes with a threat to those who eat the wealth of an orphan threat for someone who user eat orphan’s property wrongfully and out of religion rule. Those who eat property of orphan actually swallowing fire and then they will go to the hell on the day of resurrection. Because of that the guardian of orphan suggested to not use property of orphan for personal needs. The final result of this reseach is the threat for someone who eat property of orphan, they are threatened by sa’ir hell, destruction in the world and hereafter.

Abstract

In Islamic shari'ah there are two forms of marriage, namely polygamy and monogamy, of which polygamy is the marriage of a man to several women, commonly called "one husband multy wife", and monogamy is an ideal marriage that all women and men want man. Talking about the problem of polygamy, the thing that gets the most attention and debate is the issue of justice in polygamy, Hamka and Teungku M. Hasbi Ash-Shiddiqy are two figures who have different ideas about fairness in polygamy, even though they depart from the same passage namely the Qur'an . In this study, researchers used qualitative research with the type of research used was library research. The data collection method is based on primary and secondary data, and the data analysis is deductive and inductive, while the data processing uses the comparative method. The method the writer uses to describe and analyze the thinking of Hamka and Teungku M. Hasbi Ash-Shiddiqy which includes the concept of fairness in polygamy. From the research conducted, it can be concluded first, that the concept of fairness in polygamy according to Hamka for someone who wants to practice polygamy must be in a state of healthy mind arising from faith and piety. If you are polygamous, a man must be fair, both physically and mentally, but in matters of feelings and affection someone will not be able to be fair. Whereas Teungku M. Hasbi Ash-Shiddiqy bapatapat, polygamy is permissible when in an emergency, that is, if you believe you will do justice, even if someone cannot do justice in feelings and affections that are inner, then that is forgiven. Second, there are factors in equality and differences in the interpretations of the two figures. Among the equations is in the field of methods of interpretation, presentation of interpretations, forms of interpretation and legal basis in polygamy. While the differences between the two figures differ in terms of usage in terms of interpretation, breadth of explanation, background of interpretation and interpretation in QS. Al-Nisa '[4]: 129.
