Abstract

KPAI is a state institution whose special task is to supervise the implementation of child protection in Indonesia, which is an obligation that must be upheld and implemented by the laws of the Republic of Indonesia. Violence is a mere behavior carried out by someone against another person to cause psychological or physical harm or injury. Punishment is not only expected to provide a deterrent sanction against the perpetrator. This research uses a normative juridical approach because the author only studies and analyzes based on previously existing cases obtained either from books, journals, or online media which are then analyzed according to the data. This writing focuses on legal protection for children in cases of violence in Indonesia. We as a society or parents must protect children from perpetrators who are victims of violence. The perpetrator always has a way to commit a crime. If the perpetrator of a crime of violence is caught, punish the perpetrator as harshly as possible, and for victims who experience violence, here too the victim also experiences mental pressure and severe trauma. You also have to help with treatment so that the child becomes confident again and can carry out the activities they normally do. Violence perpetrated against a child has several impacts, such as the child becoming disturbed in his/her education, the child becoming aggressive and even dying due to the physical damage experienced by the child. To reduce the level of violence against children, it is necessary to raise the age limit for marriage for children. Because the ideal marriage age for women is 21 years and for men 24 years, the data was obtained from the BKKBN campaign so that families grow up.

Abstract

Anak merupakan bagian penting dalam keberlangsungan suatu bangsa dan memerlukan perlindungan baik secara fisik, psikis, sosial, maupun hukum. Namun realitanya masih banyak anak di Indonesia yang menjadi korban perdagangan orang dan kekerasan. Penelitian ini bertujuan untuk membahas secara mendalam pengaturan dan efektivitas penegakan hukum terhadap kasus perdagangan dan kekerasan anak di Indonesia, serta mengkaji secara komprehensif tentang kebijakan dalam melindungi anak dan memperkuat sistem perlindungan hukum anak di Indonesia. Jenis penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif-analitis, membahas gejala dan permasalahan hukum yang ada serta mengujinya berdasarkan peraturan perundang-undangan maupun norma hukum yang berlaku. Hasil penelitian ini menunjukkan bahwa perlindungan hukum bagi anak korban perdagangan dan kekerasan di Indonesia belum sepenuhnya berjalan dengan baik, karena meski substansi dan struktur hukum kuat, namun budaya hukumnya rendah kesadaran sehingga menyebabkan hak korban seperti rehabilitasi dan reintegrasi sering terabaikan. Kebijakan untuk melindungi anak dan memperkuat sistem perlindungan hukum anak di Indonesia dilakukan dalam bentuk kebijakan penal yaitu menggunakan instrumen hukum pidana dalam menindak kejahatan, serta kebijakan non-penal sebagai bentuk antisipasi atau mencegah terjadinya perdagangan dan kekerasan terhadap anak.

Abstract

This study aims to analyze the legal framework and the implementation of handling children in conflict with the law in narcotics crime cases at the Aceh Tenggara Police Resort, including the obstacles encountered in its implementation. The focus of this research lies in examining how applicable legal provisions are applied in practice and to what extent the protection of children can be optimally realized. The research method employed is empirical legal research with a juridical-empirical approach. Data were obtained through interviews with police officers at the Aceh Tenggara Police Resort as primary data, as well as literature studies covering statutory regulations and scientific literature as secondary data. All data were analyzed qualitatively to obtain a comprehensive understanding of the practice of handling juvenile cases. The results of the study indicate that, normatively, the handling of children has been regulated under Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which emphasizes the principles of restorative justice, diversion, and the protection of the best interests of the child. In addition, Law Number 35 of 2009 concerning Narcotics also stipulates the importance of medical and social rehabilitation for drug abusers, including children. In practice, the Aceh Tenggara Police Resort has made efforts to implement these approaches. However, its implementation has not yet been optimal due to several obstacles, such as difficulties in reaching agreements in the diversion process, limited rehabilitation facilities, and a lack of public understanding of the concept of restorative justice. Therefore, it is necessary to enhance the capacity of law enforcement officers, strengthen supporting institutions, and increase public awareness to support the effectiveness of a juvenile criminal justice system that is oriented toward the protection and recovery of children.

Abstract

Pencurian dengan kekerasan (curas) adalah kejahatan jalanan yang mengganggu masyarakat karena mengancam keselamatan jiwa korban. Penelitian yuridis normatif ini mengkaji kewenangan Kepolisian Nasional Indonesia berdasarkan Undang-Undang Kepolisian, hambatan yang dihadapi, dan efektivitas penanganan kasus curas di Polsek Medan Helvetia. Hasil penelitian menunjukkan bahwa Kepolisian memiliki dasar hukum yang kuat dalam menangani curas, namun menghadapi kendala internal berupa keterbatasan personel dan infrastruktur, serta hambatan eksternal seperti minimnya partisipasi masyarakat. Upaya perbaikan melalui penguatan koordinasi dan kepolisian berbasis masyarakat menunjukkan hasil positif. Dukungan anggaran, teknologi keamanan, pelatihan berkualitas, dan partisipasi aktif masyarakat diperlukan untuk mengoptimalkan peran Kepolisian dalam mencegah dan menangani curas.

Abstract

Penelitian ini bertujuan untuk menganalisis tanggung jawab pidana anak sebagai pelaku tindak pidana penganiayaan dalam sistem hukum pidana Indonesia melalui analisis Putusan Pengadilan Negeri Lubuk Pakam Nomor 37/Pid.Sus-Anak/2025/PN Lbp. Kasus tersebut melibatkan seorang anak berusia 17 tahun yang dijatuhi hukuman penjara karena melakukan penganiayaan yang mengakibatkan luka serius pada korban. Metode penelitian yang digunakan adalah yuridis empiris, yaitu dengan meneliti ketentuan normatif dalam KUHP dan Undang-Undang tentang Sistem Peradilan Pidana Anak dan melihat penerapannya dalam praktik peradilan. Sumber data penelitian meliputi undang-undang dan peraturan, putusan pengadilan, literatur hukum, jurnal ilmiah, serta fakta persidangan dan pertimbangan hakim. Hasil penelitian menunjukkan bahwa anak masih dapat dimintai pertanggungjawaban pidana jika telah memenuhi batas usia yang dapat dimintai pertanggungjawaban sesuai dengan peraturan yang berlaku. Namun, jenis dan beratnya kejahatan yang dijatuhkan harus memperhatikan prinsip perlindungan anak, sehingga berbeda dengan sanksi yang dijatuhkan pada pelaku dewasa. Dalam kasus ini, hakim menyeimbangkan aspek kepastian hukum, perlindungan anak, dan keadilan bagi korban. Meskipun Undang-Undang Sistem Peradilan Pidana Anak menekankan pendekatan keadilan restoratif, hakim tetap menjatuhkan hukuman penjara karena tingkat kesalahan dan konsekuensinya sangat berat.

Abstract

Advocates play a crucial role as legal defenders, particularly in upholding children's rights, from the investigation stage to court decisions. This study aims to analyze the role of advocates in the legal assistance process for children accused of drug offenses and to examine the implementation of the principles of legal protection for children as stipulated in Law Number 11 of 2012. The handling of cases involving child drug offenders must prioritize diversion as a means of resolving the case outside the criminal justice process to avoid the negative impacts of detention and harsh sentences. The legal protection provided by advocates extends beyond defense in court, but also includes assistance during the investigation, prosecution, and trial to ensure the best interests of the child. The research method used is a normative juridical approach, examining laws and case studies. The results indicate that advocates' responsibilities extend beyond formal defense to children, including legal education, ensuring fair legal proceedings, and promoting restorative justice as mandated by the Children's Juvenile Justice Law. However, in practice, challenges remain, including a lack of understanding among advocates regarding child protection approaches and a limited availability of advocates with specialized competencies in child advocacy. Therefore, ongoing training and supporting regulations are needed to strengthen the role of advocates in realizing a just and humane juvenile criminal justice system.
