Abstract

Kejahatan anak sebagai pelaku kejahatan terus meningkat, pada kasus-kasus tertentu. Oleh karena itu, penegakan hukum harus memberikan perhatian khusus. Keadilan restoratif merupakan salah satu solusi yang dapat diambil dalam penanganan kasus kejahatan anak dengan cara diversi. Menurut Undang-Undang Republik Indonesia Nomor 11 Tahun 2012, Diversi adalah pengalihan penyelesaian perkara anak yang bertentangan dengan hukum dari proses peradilan pidana ke proses di luar peradilan pidana. Diversi terhadap anak pelaku tindak pidana dilakukan atas 3 komponen sistem peradilan pidana di Indonesia, mulai dari Kepolisian RI, Kejaksaan RI dan Pengadilan. Undang-Undang Republik Indonesia Nomor 35 Tahun 2014 tentang perubahan Undang-Undang Republik Indonesia Nomor 23 Tahun 2002 tentang Perlindungan Anak yang menyatakan bahwa pidana penjara dapat diterapkan terhadap anak apabila usahanya tidak diakhiri dan dilakukan secara terpisah dari penjara orang dewasa. Upaya perlindungan anak dilakukan dengan menegakkan keadilan restoratif.

Abstract

In Indonesia, since the beginning of independence, the government has created the 1945 Constitution which includes protection for all Indonesian people and provides welfare for its citizens. The problem of "human trafficking" has now become a public problem that must be immediately addressed by the government, both central and regional, because without any action taken by the government in anticipating and handling this human trafficking case, it is feared that it will continue to extend the series of human trafficking cases. The formulation of the problem drawn in this study is how the criminal sanctions for perpetrators of human trafficking are based on the laws and regulations in force in Indonesia, How is the Author's Analysis of the application of the law for perpetrators of human trafficking crimes based on the study of Court decisions number: 2400 / pid.sus / 2023 / Pn.Mdn The research method carried out in this study is research using descriptive normative studies, namely describing, finding legal facts in full and systematically examining the problems studied. The results in this study, the Author has a different view of the Decision given by the judge, especially regarding the reduction of the defendant's sentence. This article also compares the Human Trafficking Law with Law Number 1 of 2023 which provides several changes in the eradication of human trafficking crimes.

Abstract

Eradication corruption is one of priority main in effort create clean and accountable government . Enforcement law in case taxation become an integral part of more effort wide For build integrity government . The methods used is descriptive analytical with type study law normative , as well as approach studies library . Data sources include material primary, secondary and tertiary law , processed use analysis qualitative . Research show existence relatedness close between act criminal taxation and corruption , where the weakness accountability law can create gap for practice corruption . With matter the enforcement strict and transparent law required For increase accountability perpetrator act criminal corruption and also irregularities in context taxation that is not seldom each other related . Collaboration between agency government and society are very important in supervise and eradicate practice corruption in the field taxation . In conclusion , strengthening accountability law perpetrator act criminal taxation is step crucial in effort eradication corruption in Indonesia, so that capable create system more taxation fair and effective . Improvement accountability taxation correlated direct with effort eradication more corruption effective .

Abstract

Child victims of sexual abuse face serious risks of human rights violations and HIV/AIDS transmission. Child victims of sexual abuse are a highly vulnerable group to human rights violations and various serious impacts, both physical, psychological, and health, including the risk of HIV/AIDS transmission. This condition demands comprehensive legal protection and effective and sustainable HIV/AIDS prevention efforts. This study aims to analyze legal protection for child victims of sexual abuse and the HIV/AIDS prevention policies and mechanisms provided by the state. The research method used is normative legal research with a legislative and conceptual approach, supported by a review of primary and secondary legal materials. The results show that Indonesia has various laws and regulations governing child protection and HIV/AIDS prevention, but their implementation still faces various obstacles. The main problems include limited access to child-friendly health services, a lack of integration between law enforcement processes and medical services, and suboptimal psychosocial support for victims. Furthermore, coordination between relevant institutions is still weak, so that the protection provided does not fully meet the best interests of children. Therefore, strengthening regulations, increasing synergy between sectors, and adopting a child rights-based approach to legal protection and HIV/AIDS prevention for child victims of sexual abuse is necessary.

Abstract

The regulation of witchcraft under Article 252 paragraph (1) of the 2023 Criminal Code represents a criminal law response to a social phenomenon that continues to exist within Indonesian society. Witchcraft is often associated with supernatural practices that may generate fear, social conflict, and potential violence; therefore, the state considers it necessary to establish legal norms to regulate such practices. This study aims to analyze the juridical basis of the article, the elements of the criminal offense as formulated, and its implications for legal certainty and law enforcement practices. The method employed is normative legal research using statutory and conceptual approaches through a literature review. The results indicate that the criminalization of witchcraft in the new Criminal Code does not focus on proving the existence of supernatural powers, but rather on the act of a person who declares or offers services by claiming supernatural abilities that may cause suffering, illness, or death. This formulation categorizes Article 252 as a formal offense, thereby directing proof toward the perpetrator’s observable actions. This regulation is intended to protect society from fraud, psychological manipulation, and social conflict. However, the norm still has the potential to create multiple interpretations if not accompanied by clear interpretative guidelines, particularly in distinguishing between personal beliefs and criminal acts.

Abstract

Perkembangan teknologi informasi telah mengubah pola interaksi sosial anak dan membuka peluang terjadinya berbagai bentuk eksploitasi melalui ruang digital. Meskipun Indonesia telah memiliki berbagai regulasi, seperti Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak, Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik, serta peraturan perundang-undangan lainnya, implementasi perlindungan hukum terhadap anak di ruang digital masih menghadapi berbagai tantangan akibat perkembangan modus kejahatan berbasis teknologi yang semakin kompleks. Penelitian ini bertujuan untuk menganalisis fenomena eksploitasi anak di ruang digital, mengidentifikasi bentuk-bentuk eksploitasi yang berkembang pada era reformasi digital, serta mengkaji model perlindungan hukum yang ideal dalam memberikan perlindungan kepada anak. Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Data diperoleh melalui studi kepustakaan terhadap bahan hukum primer, sekunder, dan tersier yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa eksploitasi anak di ruang digital telah berkembang dalam berbagai bentuk, meliputi eksploitasi seksual daring, eksploitasi ekonomi, eksploitasi data pribadi, serta berbagai bentuk kekerasan digital lainnya. Walaupun kerangka hukum nasional telah tersedia, masih terdapat kesenjangan antara pengaturan normatif dan implementasi penegakan hukum, terutama terkait tanggung jawab penyelenggara sistem elektronik, perlindungan data pribadi anak, serta kapasitas aparat dalam menangani kejahatan digital. Oleh karena itu, diperlukan reformasi kebijakan yang mengintegrasikan pembaruan regulasi, penerapan prinsip safety by design, penguatan koordinasi antar lembaga, serta peningkatan literasi digital bagi anak, keluarga, dan masyarakat sebagai upaya mewujudkan perlindungan hukum yang efektif terhadap anak di era digital.

Abstract

Tindakan kekerasan adalah bentuk pelanggaran nilai-nilai kemanusiaan yang dilakukan secara sengaja oleh seseorang terhadap individu lain, yang mengakibatkan penderitaan baik fisik maupun spiritual. Tindakan ini dimotivasi oleh berbagai faktor, termasuk kondisi ekonomi pelaku, ketidakstabilan emosional pelaku, pengaruh eksternal dari lingkungan sekitar, serta berbagai faktor lain yang menyebabkan tindakan tersebut terjadi. Insiden kekerasan yang dilakukan oleh Mario Dandy Satrio telah menarik perhatian publik, di mana sikap arogannya sangat kejam dalam menyiksa dan bahkan merayakan setelah melakukan kekerasan terhadap Cristalino David Ozora, yang dipicu oleh perselisihan asmara semata. Penelitian ini menggunakan pendekatan normatif, yaitu jenis penelitian hukum yang berfokus pada studi norma hukum dan peraturan perundang-undangan melalui bahan pustaka. Analisis data dilakukan dengan menggunakan pendekatan kualitatif, dengan mendeskripsikan dan menafsirkan isu-isu hukum yang relevan secara sistematis dan komprehensif. Berdasarkan hasil analisis dan diskusi, menunjukkan bahwa dalam konteks perlindungan saksi dan korban dalam kasus kejahatan penyerangan terhadap Cristalino David Ozora, peran LPSK sangat penting. Hal ini sejalan dengan tugas dan fungsinya sebagaimana diatur dalam Undang-Undang Perlindungan Saksi dan Korban sebagaimana diubah menjadi Undang-Undang Nomor 31 Tahun 2014. Berdasarkan hal tersebut, dalam keputusannya, majelis hakim menjatuhkan hukuman 12 tahun penjara kepada Mario Dandy dan menetapkan kewajiban untuk membayar restitusi kepada korban sebesar Rp25.000.000.000,00.

Abstract

Advocates play a crucial role as legal defenders, particularly in upholding children's rights, from the investigation stage to court decisions. This study aims to analyze the role of advocates in the legal assistance process for children accused of drug offenses and to examine the implementation of the principles of legal protection for children as stipulated in Law Number 11 of 2012. The handling of cases involving child drug offenders must prioritize diversion as a means of resolving the case outside the criminal justice process to avoid the negative impacts of detention and harsh sentences. The legal protection provided by advocates extends beyond defense in court, but also includes assistance during the investigation, prosecution, and trial to ensure the best interests of the child. The research method used is a normative juridical approach, examining laws and case studies. The results indicate that advocates' responsibilities extend beyond formal defense to children, including legal education, ensuring fair legal proceedings, and promoting restorative justice as mandated by the Children's Juvenile Justice Law. However, in practice, challenges remain, including a lack of understanding among advocates regarding child protection approaches and a limited availability of advocates with specialized competencies in child advocacy. Therefore, ongoing training and supporting regulations are needed to strengthen the role of advocates in realizing a just and humane juvenile criminal justice system.

Abstract

This study examines how robbery crimes impact society and online motorcycle taxi drivers in Indonesia from a criminological perspective. The increase in street crime, particularly robbery, indicates a lack of legal protection for informal sector workers who work in public environments. This study uses normative law, employing a legislative and conceptual approach. The results of the study show that regulations protecting online motorcycle taxi drivers do not fully ensure their safety at work. Robbery causes material losses, emotional trauma, and a sense of insecurity in the community. From a criminological perspective, economic pressure, social inequality, and a lack of social bonds are the main causes of robbery. To prevent similar cases from recurring, the government and law enforcement agencies must strengthen law enforcement, improve social protection, and increase surveillance in crime-prone areas.

Abstract

Women with disabilities are part of vulnerable groups who also play an important role in sustainable development. In Indonesia, the protection of women and persons with disabilities is a crucial aspect of guaranteeing human rights; however, various forms of violence and discrimination continue to occur, including rape against women with disabilities. This study formulates two main issues, namely: (1) how the implementation of Law of the Republic of Indonesia Number 8 of 2016 on Persons with Disabilities functions as formal criminal law in Indonesia, and (2) how legal protection is provided to female victims of rape with disabilities based on the study of Court Decision Number 250/Pid.Sus/2023/PN Pbm. This research employs a normative legal approach with a case study type. Data were collected through library research on statutory regulations, court decisions, legal literature, and reports from official institutions. The analysis was conducted descriptively, juridically-normatively, and critically, with an additional juridical-sociological approach to assess the implementation of the law in judicial practice. Data sources include court decision texts, relevant laws and regulations, legal literature, journals, and supporting documents. The findings indicate that the implementation of Law of the Republic of Indonesia Number 8 of 2016 in formal criminal law remains partial, although it has begun to move toward an inclusive justice system. Law enforcement officers are obliged to provide reasonable accommodation for persons with disabilities, including interpreters, psychologists, and legal companions. The case study of Decision Number 250/Pid.Sus/2023/PN Pbm demonstrates adequate repressive legal protection, reflected in the aggravation of punishment for the perpetrator and empathetic treatment of the victim; however, rehabilitative and preventive dimensions still need to be strengthened. In conclusion, Law of the Republic of Indonesia Number 8 of 2016 provides a legal basis for the protection of women with disabilities, yet its implementation remains inconsistent. Strengthening inter-agency coordination and improving the capacity of law enforcement officers are necessary to ensure comprehensive, fair, and equitable legal protection in accordance with the Constitution and international human rights standards
