Abstract

Wage Minimum always gives disparity in political power and lawmaker since it is tough to describe how to determine individual wages. For this reason, the wage minimum is a dilemma for workers and employers. Fairness conception for wage minimum is a solution to this problem. The fairness conception will guide the wage minimum to the supreme law. Although there are so many regulations concerning wage minimum, there are still many problems that arise, including break the law of wage minimum. The rules must consider the balance of interest between workers and employers to reduce disobedience of minimum wage.

Abstract

Abstract In Industrial Relations, disputes often occur between workers and employers, which can be caused due to incompatibility regarding the manufacture, and/or changes to the working conditions applied in work agreements, or company regulations or collective bargaining agreements, or a lack of ability to understand a statutory regulation. Based on this, the author is interested in conducting research on the Implementation of Law Number 11 of 2020 Concerning Job Creation in Making Collective Labor Agreements (PKB). In this study the authors conducted research using normative legal research methods or legal research literature research which mainly used literature or secondary data. The type of data used in this study was secondary data, namely by using primary legal materials and secondary legal materials collected. through library research. In fact, the Collective Labor Agreement is a means for the parties (companies and workers) in building industrial relations, so that problems that occur within the scope of employment can be minimized and can be anticipated.

Abstract

Humans need an activity that can produce many activities that can be carried out by humans, one of which is through work. In the current era, getting a job is not an easy thing, where a prospective worker must have the ability and experience. One of the efforts to get a job is through an apprenticeship program, this is needed to develop work competence, productivity, discipline, attitude, and work ethics at the level of skills and expertise in accordance with the level and qualifications of the position or job. Apprenticeship training is carried out by taking into account the needs of the labor market and the business world, both inside and outside the employment relationship. Apprenticeship training is held based on a training program that refers to work competency standards, and is carried out in stages.The implementation of the apprenticeship must be initiated and based on a written agreement between the apprentice participant and the apprentice organizing company which is recognized and approved by the local District/City Office. Law in society is a means to uphold order so that the interests of society can be maintained in their relations. Laws regarding the protection of human interests are guaranteed through norms or rules. Law, as a general rule and normative rule. In the labor law it has been emphasized that apprenticeship must be made based on a written agreement between apprentice participants and employers, wherein the agreement stipulates the rights and obligations as well as the period of apprenticeship, this is done to protect the rights of apprentice participants. The position of apprentices must be legally protected so that apprenticeship activities can run smoothly according to the functions and objectives of the apprentice itself and to minimize arbitrarines

Abstract

Secara umum, pensiun adalah suatu masa dimana pekerja/pegawai sudah tidak bekerja lagi sehubungan dengan pemutusan hubungan kerja pada instansi/perusahaan karena pekerja/pegawai tersebut telah mencapai batas usia tertentu. Di PT Surya Toto Indonesia Tbk, pengaturan usia pensiun pekerja diatur berdasarkan Perjanjian Kerja Bersama. Pengaturan usia pensiun tersebut berbeda dengan ketentuan usia pensiun dari Pemerintah untuk pekerja yang menjadi peserta program jaminan pensiun Badan Penyelenggara Jaminan Sosial (BPJS) Ketenagakerjaan, yang diatur dalam Peraturan Pemerintah Nomor 45 Tahun 2015 Tentang Penyelenggaraan Program Jaminan Pensiun Penelitian ini menggunakan bentuk penelitian kualitatif yang bersifat yuridis normatif dengan pendekatan peraturan perundang-undangan. Jenis bahan hukum dalam penelitian ini terdiri dari bahan hukum primer dan bahan hukum sekunder. Bahan-bahan hukum tersebut kemudian dianalisa dengan menggunakan teknik penelitian terhadap taraf sinkronisasi secara vertikal. Terdapat perbedaan dan dampak dari pengaturan dan pelaksanaan usia pensiun pekerja di PT Surya Toto Indonesia Tbk dihubungkan dengan Peraturan Pemerintah Nomor 45 Tahun 2015 Tentang Penyelenggaraan Program Jaminan Pensiun. Berdasarkan hasil penelitian maka dapat disimpulkan bahwa: (1) Terdapat ketidaksinkronan peraturan perundang-undangan akibat dari perbedaan pengaturan dan pelaksanaan usia pensiun pekerja di PT Surya Toto Indonesia Tbk berdasarkan Perjanjian Kerja Bersama dihubungkan dengan Peraturan Pemerintah Nomor 45 Tahun 2015 Tentang Penyelenggaraan Program Jaminan Pensiun, menunjukkan bahwa tidak terpenuhinya beberapa kaidah hukum tentang logika ilmu hukum, yaitu: kaidah nonkontradiksi (principle of integrity), kaidah derivatif (derivative principle), kaidah sistem (systemic principle), kaidah reduksi (principle of reductionism). (2) Adanya “masa tunggu” bagi pekerja di PT Surya Toto Indonesia Tbk yang telah pensiun, karena tertundanya pembayaran manfaat jaminan pensiun sebagai peserta program jaminan pensiun Badan Penyelenggara Jaminan Sosial (BPJS) Ketenagakerjaan akibat dari pengaturan usia pensiun dalam Peraturan Pemerintah Nomor 45 Tahun 2015 yang berjenjang, sehingga tidak dapat langsung memperoleh manfaat jaminan pensiun, yang seharusnya dalam konsep jaminan pensiun idealnya adalah bahwa peserta akan mendapatkan hak atas manfaat jaminan pensiun pada saat memasuki usia pensiun.

Abstract

This paper discussed the development of State Administrative Law in the field of employment from the New Order era to the era of digitalization and the Industrial Revolution 4.0. The paradigm shift of the night watchman state to field-based functions, such as Homeland Security and Administrator Welfare, affects state intervention in the private lives of citizens. The HAN aims to regulate government activities and create welfare for its people. The loss of the governor's authority in setting sectoral minimum wages was a result of the Job Creation Law, which led to a number of lawsuits in the State Administrative Court. During the New Order era, the Minister of Manpower set the wage policy, while the reform era brought significant changes in the government order, including the governor's authority in setting sectoral minimum wages. However, in the era of digitalization and Industrial Revolution 4.0, the Job Creation Law gives the governor full authority to set minimum wages, with direct impact on administrative decisions. In conclusion, HAN in the field of labor has not shown significant progress in developing the interests of citizens. In the reform era, the silence of state administrative officials is interpreted as approval, while the concept of omnibus law in legislation has an impact on the limited authority of government agencies and officials. State Administration Law Number 30 of 2014 is the legal basis for state administration in a substantive sense, while labor laws have a close relationship with HAN, especially regarding the determination of minimum wages.

Abstract

The migration of foreign workers (TKA) is a global phenomenon, not exclusive to Indonesia. Since the prophetic era, the role of foreign workers has been documented. In Indonesia, opposition to foreign workers persists because of the perceived threats to domestic employment. This study aimed to discuss the legal status and protection of foreign workers' rights in Indonesia based on Indonesian and Islamic laws. This study used a juridical-normative approach with a comparative law methodology. The findings revealed that Laws 13 of 2013 and 6 of 2023 acknowledge and protect foreign workers' employment in Indonesia, considering necessity, expertise, competence, and scientific advancements. The employment of foreign workers in Islamic jurisprudence is a novel legal challenge. The legal argument used was the Maslahah mursalah, which considers higher Islamic law principles. Islamic law permits foreign workers' employment, based on universal brotherhood, when benefiting from humanity. The recognition of foreign workers in Indonesia has implications for legally protecting their rights, which are aligned with human rights principles in labor law, including rights to facilities, wages, health care, religious freedom, political participation, and sociocultural engagement

Abstract

Kegiatan usaha mendorong tumbuh kembangnya perekonomian suatu negara, maka peningkatan pembangunan perkonomian nasional perlu didukung dengan penerapan Good corporate governance (GCG), hal ini mendesak untuk semua perusahaan, baik dalam skala besar maupun menengah sehingga dapat menjamin iklim dunia usaha yang kondusif. Penelitian ini bertujuan untuk dapat mengkaji dan menganalisis Audit Hukum dari sisi penerapan Good Corporate Governance melalui standard audit hukum Indonesia. Selama ini audit kinerja perusahaan lazim diawasi oleh dewan komisaris dan dilakukan secara internal atau internal audit, namun oleh karena berbagai kepentingan, hasilnya kurang objektif dan belum memenuhi tujuan pelaksanaan audit. Penelitian ini dilakukan dengan Metode Juridis Normatif dan kajian kepustakaan, dengan meneliti pentingnya Audit Kinerja perusahaan, khususnya yang berkaitan dengan pemenuhan dan ketaatan perusahaan dalam menjalankan undang-undang dan peraturan yang berlaku. Hasil penelitian menunjukkan hasil kerja internal audit belum sepenuhnya siknifikan memperbaiki kinerja perusahaan, sehingga perlu Auditor Independen yang memiliki standard audit yang teragreditasi dan bekerja objektif, sehingga laporan audit dapat dipakai sebagai pedoman dalam melakukan langkah-langkah perbaikan kinerja perusahaan, dan tujuan perusahaan menuju terciptanya Tata Kelola Perusahaan yang Baik/ Good Corporate Governance dapat dicapai
