Abstract

Artikel ini bertujuan untuk menginvestigasi tentang pengaruh sistem keputusan dalam kasus pelanggaran kode etik oleh Hakim Mahkamah Konstitusi, yang masih menjadi perdebatan hingga saat ini. Selain itu, artikel ini akan membahas fungsi dan peran Majlis Kehormatan Mahkamah Konstitusi sebagai lembaga penegak kode etik bagi Hakim di Mahkamah Konstitusi. Hal ini sebagai respons terhadap Keputusan Batas Usia Cawapres Pasal 169 Huruf q UU7/2017. Penelitian ini menggunakan metode kualitatif dengan dokumen, buku, dan jurnal sebagai tolak ukur. Penelitian ini mengeksplorasi pandangan dan interpretasinya mengenai pelanggaran kode etik oleh Hakim di Mahkamah Konstitusi, dengan fokus pada perspektif hukum Islam. Melalui penelitian ini, hasil dan implikasinya dapat ditemukan pemahaman yang lebih mendalam tentang pelanggaran kode etik oleh Hakim Mahkamah Konstitusi dan bagaimana hal tersebut diatasi oleh Majelis Kehormatan Mahkamah Konstitusi, khususnya dalam perspektif hukum Islam.

Abstract

This study aims to analyze the validity of hybrid contracts in the Cash Waqf Linked Deposit (CWLD) model regulated by the Financial Services Authority (OJK). The study was motivated by the gap between the potential for national cash waqf and the low rate of its actual collection, as well as the fiqh debate regarding the return of principal funds to customers. The method used is a juridical-normative study with a qualitative approach. Data were obtained through a literature review of primary legal sources, including the OJK’s CWLD Implementation Guidelines, Islamic banking regulations, DSN-MUI fatwas, and fiqh literature from the four schools of thought, as well as secondary legal sources such as scientific articles and academic books. The analysis was conducted using a deductive-coherence approach based on the theory of al-‘Uqūd al-Māliyah al-Murakkabah. The results of the study indicate that the CWLD structure falls under the category of al-uqūd al-mujtami‘ah al-mubāhah, which is valid due to the separation of legal objects between the mudārabah investment funds and the endowed returns. A comparative fiqh analysis also confirms the legality of temporary waqf through the talfiq approach, which accommodates the views of the Maliki and Hanafi schools of thought. Thus, the CWLD is an innovation that aligns with the Maqāṣid al-Syarī‘ah while supporting the mobilization of social funds and strengthening the liquidity stability of Islamic banking.

Abstract

Despite its constitutional role in supporting food sovereignty, Banyuwangi’s agricultural sector remains excluded from formal Islamic finance due to a regulatory gap between rigid banking standards and agricultural risk. This study identifies a Proximity Paradox, in which Islamic banks are structurally disincentivized from financing smallholders. Using Soft Systems Methodology (SSM) as a socio legal approach and drawing on empirical data from farmers, Islamic banks, and Bayt al-Māl wa al-Tamwīl (BMTs), the research formulates an Agricultural Financing Regulatory Model. The model recommends policy reform by the Financial Services Authority (Otoritas Jasa Keuangan, OJK) and the National Sharia Council (Dewan Syariah Nasional–Majelis Ulama Indonesia, DSN-MUI), including hybrid value chain contracts, mandatory agricultural takaful, and a formal Bank–BMT linkage scheme, to align banking compliance with agricultural realities and promote distributive justice (‘adl).
