Abstract

Settlement of criminal cases with a restorative approach has begun to be applied in Indonesia, but its implementation is only related to the settlement of juvenile criminal cases. In practice, a restorative justice approach is often applied to pay more attention to the perpetrators of crimes than to the victims of these crimes. Thus the reconstruction of the principles of restorative justice is currently not fully implemented. Investigators pay more attention to the interests of the perpetrator rather than the interests of the victim. Often victims feel dissatisfied or feel compelled to accept the decision. This was done by involving community leaders and traditional leaders, but the implementation still impressed the perpetrators and impressed that in the process the victims were forced to agree to the agreements that were made. The principle of restorative justice is known as a traditional case settlement model. The case settlement model with a restorative justice principle approach which is designed to resolve criminal cases in the context of modern criminal law, should be processed within the criminal justice system. Indonesia, and the Ministry of Law and Human Rights of the Republic of Indonesia have adopted the principle of restorative justice as a way of settling a criminal case so that conceptually it can produce provisions based on restorative justice.

Abstract

Restorative Justice according to Article 1 number 6 of Law Number 11 of 2012 is the settlement of criminal cases involving perpetrators, victims, families of perpetrators/victims, and other related parties to jointly seek a fair settlement by emphasizing recovery. return to its original state, and not retaliation. The concept of restorative justice is a critique of the concept of the criminal justice system which sees crime as a violation of state rules. As for the results of this study, namely the reconstruction of restorative justice policies in cases of children as perpetrators of crimes, according to Erna Sofwan Syukri, it provides an understanding of punishment as an effort to awaken the perpetrators of crimes so that they regret their actions, and return them to become good, law-abiding citizens. upholding moral, social and religious values, so as to achieve a safe, orderly and peaceful society. So the reconstruction of Restorative Justice in the case of children as perpetrators of criminal acts must be fair. The value of justice is a balance between rights and obligations and receiving rights and carrying out obligations.

Abstract

Perlindungan konsumen adalah perangkat hukum yang diciptakan untuk melindungi dan terpenuhinya hak konsumen. Produk obat-obatan dan makanan diawasi oleh Badan Pengawas Obat dan Makanan atau disingkat BPOM yang bertugas mengawasi peredaran obat-obatan dan makanan di indonesia. Permasalahan dalam penelitian ini adalah pengaturan perlindungan konsumen terhadap peredaran obat yang menyebabkan gagal ginjal akut serta analisis yuridis peredaran obat sirup yang mengakibatkan gagal ginjal akut. Metode penelitian yang digunakan dalam penelitian ini ialah normatif yang dituangkan dalam bentuk analisis kualitatif. Hasil penelitian yang didapat adalah. BPOM juga memiliki tugas Pengawasan Post-Market dan Pre-Market yang bertujuan untuk memastikan bahwa produk obat dan makanan tetap memenuhi persyaratan keamanan, kemanfaatan, dan mutu yang sebelumnya telah disetujui oleh BPOM sebelum produk beredar di pasaran. tersebut seharusnya dapat mencegah terjadinya peredaran obat yang mengandung senyawa berbahaya, sehingga hak konsumen atas kenyamanan, keamanan, dan keselamatan dapat terpenuhi dan terlindungi dari obat sirup mengandung bahan berbahaya penyebab gagal ginjal.

Abstract

Perkembangan teknologi digital memberikan kemudahan dalam transaksi, namun juga membawa potensi penyalahgunaan yang merugikan konsumen, terutama dalam hal perlindungan data pribadi. Penyalahgunaan data pribadi dalam sektor fintech, kesehatan, dan sektor lainnya menjadi masalah serius yang menuntut perlindungan hukum yang kuat. Penelitian ini bertujuan untuk menganalisis efektivitas perlindungan hukum terhadap konsumen serta identifikasi langkah-langkah penegakan hukum dalam menghadapi penyalahgunaan data pribadi. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, menggunakan studi kepustakaan sebagai teknik pengumpulan data. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang Perlindungan Data Pribadi (UU PDP) sudah ada, penerapannya masih menghadapi tantangan dalam hal pengawasan dan penegakan hukum yang efektif. Meskipun sanksi pidana yang tegas telah diatur, banyak kasus penyalahgunaan data pribadi yang tidak mendapat respons yang cepat dari otoritas terkait. Oleh karena itu, perlu ada perbaikan dalam hal pengawasan dan penegakan hukum serta peningkatan edukasi masyarakat mengenai hak perlindungan data pribadi. Kesimpulannya, perlindungan hukum yang lebih kuat dan pengawasan yang lebih efektif sangat penting untuk mengurangi penyalahgunaan data pribadi dan meningkatkan kepercayaan masyarakat terhadap transaksi digital.

Abstract

Abstract: The rapid property development in Indonesia is often followed by issues related to land rights abuse by developers, which harms consumers in property transactions. One of the main problems is the sale of land with unclear legal status or land under dispute, leading to the risk of consumers losing their property rights. This study aims to analyze the impact of land rights abuse by developers on consumer protection and the implementation of the Consumer Protection Law in improving dispute resolution mechanisms in cases of developer default. The study uses a normative legal research method with a descriptive-analytical approach, analyzing applicable regulations, legal principles, and relevant legal theories. Data was collected through library research using primary and secondary data sources and analyzed qualitatively. The results indicate that land rights abuse by developers significantly impacts consumers, both financially and psychologically. Developer defaults related to delays, discrepancies in property specifications, and land legal issues increase consumer distrust in the property sector. The implementation of the Consumer Protection Law through the Consumer Dispute Settlement Body (BPSK) can improve dispute resolution mechanisms, although challenges in consumer awareness and the enforcement of BPSK decisions still need to be addressed. Stronger law enforcement and improved transparency will enhance consumer protection. Keywords: Land Rights Abuse, Developer Default, Consumer Protection
