Abstract

This study aims to elaborate on the urgency of establishing People's Mining Areas (WPR) in the governance of tin mining in Bangka Belitung post the centralization of mining authority. Utilizing a juridical-normative research method and a statutory approach, this study examines the reality of das sein with the relevance of das sollen to find legal gaps and replicate strategic solutions. The analysis results in this study indicate that the issuance of Law No. 3 of 2020 and Presidential Regulation No. 55 of 2022 has explicitly separated the central and regional government authorities. One of the regional authorities is in the field of People's Mining License (IPR). Although the IPR mechanism has been regulated since Law No. 4 of 2009, its implementation is still imbalanced and not efficient in Bangka Belitung. From 2009-2020, the number of illegal tin miners continued to increase, while the number of IPRs utilized remained very limited. This condition has not changed significantly from the period 1998-2009 when illegal tin mining began to encroach. Therefore, by delegating the IPR back to the regions, the government needs to prepare mechanisms to optimize mining governance, including through the establishment of WPRs which become the basic condition for granting IPRs.

Abstract

Penelitian bertujuan untuk mengelaborasi pengaturan terkait dengan kewenangan monopoli oleh BUMN sebagai bagian integral dari proyeksi pembangunan kesejahteraan ekonomi di Indonesia. Dengan menggunakan metode penelitian yuridis-normatif dan pendekatan perundang-undangan, penelitian ini berfokus pada latar belakang, dasar hukum, implementasi, dan kelemahan dari praktik monopoli oleh BUMN, terutama dalam skema persaingan usaha. Hasil analisis dalam penelitian ini menunjukan bahwa BUMN merupakan perpanjangan tangan pemerintah dalam mengelola sumberdaya dan sektor- ekonomi strategis yang menguasai hajat hidup orang banyak. Pemberian kewenangan monopoli diorientasikan guna memperkuat kapabilitas BUMN untuk berkompetisi dan mendominasi sektor ekonomi yang penting, meningkatkan penerimaan negara, serta memberi surplus bagi pembangunan nasional. Kendati demikian, pelaksanaan monopoli oleh BUMN masih menemui sejumlah tantangan, diantaranya adalah kurang efektifnya manajemen BUMN yang menyebabkan kerugian dan keuntungan tidak maksimal, serta hambatan bagi perusahaan swasta untuk berkembang dan berkompetisi di Indoneisa. Monopoli yang dijalankan secara tidak efektif menyebabkan stagnasi atau degradasi penerimaan negara, serta membatasi jumlah investasi akibat tidak terdapat ruang kompetisi yang proporsional. Dengan demikian, formulasi perbaikan tata kelola BUMN dan pengaturan monopoli menjadi aspek fundamental guna perbaikan pengelolaan sumber-sumber ekonomi strategis di Indonesia.

Abstract

This study explores the legal intricacies of drug crimes involving substances like Gorilla Tobacco under Indonesia's Narcotics Law, aiming to address disparities in penalty severity. Employing legal normative methods, conceptual approaches, and statutory analysis, it examines key provisions of the law, particularly the proving mechanism for Gorilla Tobacco offenses and the significance of Guideline No. 11 of 2021. Emphasizing the need to standardize evidence calculation and suspect qualifications for a fair legal foundation, the research highlights the complexities in investigating and prosecuting Gorilla Tobacco-related crimes. It underscores the importance of international collaboration and community involvement in addressing these challenges. Through structured analysis, this study provides valuable insights into the evolving mechanism of criminal proof for Gorilla Tobacco offenses, advocating for fairness and effectiveness within the criminal justice system. The incorporation of Guideline No. 11 proves pivotal in this pursuit, offering a balanced response to the dynamic nature of drug-related crimes and the evolving legal landscape in Indonesia.
