Abstract

This research aims to explore the potential for using Online Dispute Resolution as a tool in realizing restorative justice in e-commerce disputes. Through normative juridical research methods, with a statutory approach, this research analyzes secondary data in the form of primary, secondary and tertiary legal materials. The research results show that Online Dispute Resolution can be an effective tool in resolving e-commerce disputes quickly, cheaply and effectively without hampering the parties' business activities. The use of Online Dispute Resolution supports the principles of restorative justice by facilitating broader participation, effective communication, relationship maintenance, process efficiency, and empowerment of all parties involved, helping to create a space conducive to dialogue, understanding, and healing of relationships.

Abstract

Technology development is very influential in many aspects, including credit agreement as the principal agreement that followed by the accesoir agreement or guarantee agreement. Guarantee agreement is aimed for immovable objects, such as land or building, which written on Law number 4/1966 on Mortgage Rights of Land and other related objects or known as Undang-Undang Hak Tanggungan (UUHT)/ Mortgage Law. However, the registration of mortgage rights which done manually is still having some obstacles, such as the long-time duration, slow bureaucracy, and others. Therefore, it is needed to use information technology to make the mortgage service procedure can be integrated electronically, thus it will become effective and efficient. The Minister of Agrarian Affairs and Spatial Planning (APR) or Head of National Land Agency (BPN) has issued a Regulation of Agrarian Affairs and  Spatial Planning/National Lang Agency number 9/2019 about electronically integrated mortgage service since June 21st 2019.  This regulation is related to the Regulation number 3/2019 on the use of electronic system and Regulation number 7/2019 on transformation of certificate form. The issuance of these regulations is one of the way to handle the mortgage registration service. It is hoped it can facilitate people to get the service. The electronic registration is also considered as appropriate service to the situation of covid-19 pandemic nowadays.

Abstract

Pada era new normal yang sedang berlangsung saat ini akibat adanya virus Covid-19 yang melanda dunia maka banyak sekali kegiatan yang beberapa tahun ke belakang tidak berjalan dengan baik salah satunya adalah kegiatan berusaha. Hal ini juga berlaku di daerah Desa Kumpai Batu Bawah Kalimantan Tengah yang dimana usaha rengginang menjadi satu-satunya usaha yang ada di Desa tersebut. Pengabdian kepada masyarakat ini bertujuan untuk membantu mengembangkan usaha rengginang salah satu warga milik ibu Jariyah dan bapak Jaelani agar semakin dikenal oleh masyarakat luas dan menghasilkan keuntungan yang lebih. Kegiatan Pengabdian kepada masyarakat ini dilakukan melalui KKN (Kuliah Kerja Nyata) dengan cara memberikan pengalaman belajar kepada mahasiswa untuk hidup di tengah-tengah masyarakat di luar kampus melalui ilmu yang dimiliki dan diharapkan dapat membantu masyarakat untuk mengatasi permasalahan yang dihadapi. Pelaksanaan kegiatan ini terbagi menjadi 5 bagian yaitu survey, persiapan, pelaksanaan, publikasi dan evaluasi yang dilakukan selama 8 minggu dengan program kerja pendaftaran NPWP (Nomor Pokok Wajib Pajak), pendaftaran NIB (Nomor Induk Berusaha), pendaftaran PIRT (Pangan Industri Rumah Tangga), pembuatan logo, pendaftaran hak cipta logo, pembuatan akun media sosial berupa Instagram, pemasaran secara online dan offline dan pendaftaran BPOM. Pendapatan penjualan Usaha Kecil Menengah (UKM) Rengginang Afil memang selalu meningkat tiap tahunnya, tetapi pada tahun 2012 penjualan Rengginang Afil per unit Usaha Kecil Menengah (UKM) Rengginang Afil menurun. Hal ini mungkin dikarenakan adanya: Faktor internal berupa penurunan promosi penjualan, penurunan komisi penjualan, turunnya kegiatan salesman dan turunnya jumlah distribusi. Kemudian faktor eksternal berupa bencana alam, perubahan pola konsumen dan munculnya saingan baru.

Abstract

Pandemi COVID-19 yang melanda seluruh dunia sejak akhir tahun 2019 telah membawa dampak yang sangat besar, tidak hanya di bidang kesehatan, tetapi juga di berbagai sektor ekonomi, termasuk sektor usaha mikro, kecil, dan menengah (UMKM). Sektor ekonomi lokal masyarakat Kelurahan Sidorejo yaitu sebagai pedagang dan produsen tak jarang pula patut untuk di apresiasi, hal ini menunjukan ada potensi besar pada daerah tersebut, karena UMKM masyarakat berjalan dengan mulus. Tujuan pengabdian masyarakat ini untuk mengimplementasikan IPTEK terhadap pengembangan Ekonomi Kreatif di era new normal. Pengabdian masyarakat ini dilakukan di kelurahan Sidorejo pada Bulan Juli-September 2022. Media pemasaran yang digunakan adalah pemasaran online. Hasil kegiatan yang diperoleh yaitu perubahan logo/label kemasan semakin menarik, peningkatan omset dan penjualan, sudah adanya waktu penjualan.

Abstract

The COVID-19 epidemic has significantly altered the execution of business contracts, especially with regards to the renegotiation of duties and the use of force majeure. In light of the difficulties brought on by the pandemic, this research examines the ways in which Indonesian civil law, as codified in the Civil Code, deals with matters such as contract modifications. Studying both primary and secondary sources of law is at the heart of the normative legal research methodology. It is frequently necessary to renegotiate contracts in order to modify rights and responsibilities, since the study's findings demonstrate that force majeure does not necessarily apply to all contracts in a pandemic scenario. Findings from this research stress the need for more lenient laws to resolve contract disputes in the midst of the epidemic and for more transparent rules to govern the use of force majeure.
