Abstract

This research investigates the various impacts of digital transformation on legal culture and societal norms in present-day Indonesia. By examining the convergence of legal changes, technological progress, and cultural shifts, the study underscores the significance of maintaining traditional values in the face of rapid digital advancements. Emphasizing the importance of legal literacy, the paper advocates for innovative educational initiatives, such as those utilizing film and podcasts, to improve public comprehension of legal concepts. The analysis highlights the careful equilibrium needed for Indonesia to embrace digital culture while preserving its diverse cultural legacy.

Abstract

Asas legalitas merupakan dasar fundamental dalam penegakan hukum pidana, sehingga diperlukan pemahaman yang mendasar dan mendalam mengenai hal tersebut. Adapun penelitian ini bertujuan untuk memberikan potret asas legalitas dalam dua sistem hukum utama di dunia, yaitu common law dan civil law. Menggunakan pendekatan hukum normatif, data-data yang digunakan dalam penelitian ini bersumber dari bahan hukum primer, sekunder, dan tersier yang diperoleh melalui studi kepustakaan. Penelitian ini menyoroti perbedaan penerapan asas legalitas di dalam common law dan civil law. Hasilnya, dalam common law, Nulla Poena Sine Lege menjadi rumusan asas legalitas yang pada praktiknya bertumpu pada preseden hasil putusan pengadilan. Sementara dalam civil law, rumusan asas legalitasnya adalah Nullum Crimen, Nulla Poena Sine Praevia Lege Poenali, yang menitikberatkan pada peraturan tertulis dalam berbagai regulasi hukum pidana.

Abstract

Hak maternitas adalah hak asasi manusia yang secara khusus dimiliki oleh perempuan terkait dengan fungsi reproduksi mereka, seperti menstruasi, kehamilan, persalinan, dan menyusui. Di Indonesia, hak maternitas diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan. Penelitian ini dilakukan dengan tujuan untuk mengetahui dan menganalisis konsep dan regulasi terkait hak maternitas, implementasi, serta tantangan atau kendala hak maternitas di tempat kerja. Jenis Penelitian yang digunakan oleh peneliti dalam menyusun penelitian ini adalah jenis penelitian normatif. Adapun pendekatan yang digunakan oleh peneliti dalam menyusun penelitian ini adalah pendekatan perundang-undangan (Statute Approach). Hasil penelitian ini menunjukan bahwa banyak pekerja perempuan masih belum mendapatkan hak maternitas yang memadai, bahkan beberapa perusahaan menghambat pekerja perempuan untuk mengambil cuti hamil atau menyusui kemudian pelaksanaan hak maternitas bagi perempuan yang bekerja di Indonesia menghadapi berbagai tantangan signifikan, salah satunya adalah kurangnya kesadaran dan pemahaman mengenai hak maternitas.

Abstract

This article explores policy strategies necessary to promote a sustainable and eco-friendly nickel mining industry in Indonesia, especially as it relates to the electric vehicle (EV) sector. With Indonesia's substantial nickel reserves, demand is expected to rise sharply, driven by the global shift to EVs. However, nickel production is a significant contributor to greenhouse gas emissions, with one kilogram of nickel generating approximately 13 kilograms of CO₂. By 2035, Indonesia's demand for nickel for EV batteries alone could lead to 773 thousand tons of CO₂ emissions. This paper aims to assess green-oriented policies that could mitigate these impacts, drawing on Mariana Mazzucato’s Mission-Oriented Policies as a strategic framework. The methodology used includes literature review and case study analysis of successful policies in other countries, such as renewable energy integration in mining and efficient recycling methods. Three primary strategies are examined: improving energy efficiency, incorporating renewable energy, and sustainable recycling. Findings indicate that these policies could foster sustainable growth, reduce emissions, and align with Indonesia's green economy goals. This paper concludes that implementing a mission-oriented, environmentally sustainable approach could pave the way for a greener, more resilient nickel industry.

Abstract

The purpose of this research is to find out what efforts are being made by the government to prevent sexual violence against children, understand the existence of legal protection and know what roles can be played by parents and the environment. This study uses normative legal research methods using legal, conceptual and analytical approaches. Documentary research techniques are used in legal material collection techniques, while qualitative analysis methods are used in research analysis methods. The results of this study indicate that the government's role in preventing sexual violence against children is by imposing strict sanctions and giving appropriate punishments, creating a fan base, conducting cyber patrols and combating pornographic content in cyberspace. Regarding the existence of legal protection carried out by the government, namely in law no. 23 In 2002, regarding child protection, the government took steps to implement the TPKS Law and Law no. 39/1999 on human rights. Sex education can be carried out in the role of parents and the environment, while other efforts are made by the Indonesian government, namely the Indonesian government in collaboration with the Ending Child Sexual Exploitation (ECPAT) program in decision-making and solving cases of commercial sexual exploitation of children (ESKA).

Abstract

Marriage law has undergone changes, especially in regulating the minimum age. Before the changes, the law set the minimum marriage age for men at 19 years and the marriage age for women at 16 years. In the amendment of Law Number 1 of 1974 to Law Number 16 of 2019 concerning Marriage, the minimum age for marriage for both men and women is 19 years. In the process, although the minimum age for marriage has increased, currently there are still many marriages of underage children, both legally and not. This is because the marriage dispensation granted by the court is still in force with several strong reasons and evidence submitted by the applicant to the judge so that it can convince the judge to grant a decree. The type of research used is normative with normative juridical research methods. The approach used in this research is a statutory approach (Statute Approach) using secondary data which becomes primary legal material. The results of the research will show the results of the analysis of legal and moral aspects related to disapproval of the underage marriage dispensation and its role in reducing the number of legally illegal early marriages.

Abstract

Tax expenditure policies, such as the 0.5% Final Income Tax rate stipulated by Government Regulation No. 23 of 2018, aim to foster the growth of Micro, Small, and Medium Enterprises (MSMEs) by reducing their tax burdens. These policies have shown positive impacts, particularly in improving tax compliance and alleviating the fiscal burden of MSMEs. However, challenges remain, including low tax literacy, bureaucratic complexities, and geographical disparities that hinder smaller and remote MSMEs from accessing these benefits. This paper examines how such policies align with human rights principles, such as the right to decent work and equitable economic access, while offering recommendations to ensure more inclusive implementation. By enhancing tax literacy, simplifying bureaucracy, and extending incentives to underserved MSMEs, tax expenditure policies can serve as an effective instrument to promote economic justice and sustainable development.

Abstract

The massive development of information and communication technology has accelerated the process of globalization and influenced various aspects of human life, including in the field of criminal law. This study aims to analyze how globalization affects the principle of legality. Using a normative legal approach, the data used in this study are sourced from primary, secondary, and tertiary legal materials obtained through literature studies. The transformation of the era challenges the relevance of the principle of legality in criminal law to protect society from crime. The emergence of various new types of crimes in the era of globalization is a threat to society while criminal law is hampered by the principle of legality to respond to these conditions quickly so that alternative solutions are needed to answer this challenge.
