Abstract

Abstract Buying and selling is one of the forms of mumalah allowed based on the Qu'ran, Al-Hadith, and Ijma of the Ulama. To obtain goods and simultaneously sell them, it is necessary to have an Akad, this study aims to analyze the perspective of sharia economic law on buying and selling transactions in the social context through the implementation of the Istishna contract. Within the framework of Islamic law, buying and selling transactions have an important social dimension to note. Akad Istishna' is a form of transaction that can be used in a social context, where buyers and sellers interact with each other with the aim of achieving welfare and social justice. This study uses an analytical approach of Islamic economic law to understand the legal basis, legal requirements, and social implications of buying and selling transactions through the Istishna contract. The results showed that the implementation of the Istishna contract in buying and selling transactions can make a positive contribution in achieving socio-economic goals in Islam, such as wealth redistribution and community empowerment. However, it is important to ensure that the execution of the Istishna' contract is carried out in compliance with the provisions of Islamic law and the principles of social justice. This research provides valuable insights for practitioners and academics in understanding the relevance and social implications of buying and selling transactions using Istishna' contracts in the context of Islamic economic law.

Abstract

Penelitian ini menganalisis kajian tafsir ahkam tentang kedudukan akad muamalah pada lembaga keuangan syariah di Indonesia. Sebagaimana Industri keuangan syariah menjadi semakin penting dalam perekonomian global, termasuk di Indonesia, di mana lembaga keuangan syariah memainkan peran utama. Akad muamalah, sebagai dasar hukum transaksi ekonomi syariah, memiliki kedudukan yang penting dalam operasional lembaga keuangan syariah. Penulis menggunakan metode kualitatif dengan anaisis data sekunder dan pendekatan metode analisis maudhu'i dengan mencoba mencari jawaban al-Qur'an dengan mengumpulkan tafsir ayat-ayat al-Qur'an untuk menemukan kedudukan akad tersebut. Hasil dari penelitian ini adalah bahwa pentingnya menyediakan komitmen dan perjanjian dalam transaksi ekonomi, kecuali jika melanggar hukum syariah. Prinsip ini menciptakan landasan etika dan moral bagi bisnis dan transaksi ekonomi, yang mencerminkan integritas dan keadilan. Berdasarkan beberapa ayat Al-Qur'an, akad juga memegang peran penting dalam mengikat individu dalam menjalankan perjanjian dan komitmen mereka, dengan tanggung jawab moral dan spiritual yang kuat. sebagaimana telah dijelaskan dalam tafsir ahkan Quran surat Al-Maidah ayat 1 dan surat Al-Isra ayat 34 dan di pertegas lagi dalam Qur’an surat An-Nissa ayat 29 agar setiap perencanaan transaksi dan pelaksanaannya didasarkan atas niat baik, sehingga segala bentuk penipuan, kecurangan, dan penyelewengan dapat dihindari. Artikel ini memberikan kontribusi bagi praktisi, sejarawan, dan regulator di bidang perbankan syariah di Indonesia, yang memiliki peran penting dalam pertumbuhan dan perkembangan berkelanjutan lembaga keuangan syariah di negara ini. Abstract

This research aims to examine the concept of Ulil Amri as described in the Quran and Sunnah, and how obedience to Ulil Amri is applied in the context of nationhood, particularly within modern political systems. The research uses a qualitative method with a descriptive-analytical approach, focusing on the interpretation of religious texts and related literature. Primary data sources include the Quran, Hadith, and the commentaries of classical and contemporary scholars, such as Ibn Qayyim, Al-Tabari, and Yusuf Al-Qaradawi. The main findings indicate that obedience to Ulil Amri has clear limitations, particularly when leaders do not govern in accordance with Islamic law. Additionally, the concept of Ulil Amri faces challenges in the modern era, especially in countries that do not fully implement Sharia law. The role of scholars in ensuring that leaders' policies remain aligned with Islamic values has become increasingly significant. The research concludes that obedience to Ulil Amri remains relevant; however, Muslims must balance this obedience with constructive criticism through the principle of Amar Ma’ruf Nahi Munkar when necessary. Consequently, this study suggests that the concept of Ulil Amri in Islam can be dynamically applied within the framework of modern governance.

Abstract

Zakat has great potential to improve the welfare of people in Indonesia, including in Garut Regency. The professional and accountable management of zakat by the National Zakat Agency (BAZNAS) of Garut Regency is expected to encourage an increase in the economic welfare of the community. However, the performance of BAZNAS Garut in this case is not optimal, so the impact on improving public welfare is also not optimal. This gives rise to a critical perspective in society. This study aims to analyze the governance, distribution system, and the impact of Zakat mal and Zakat fitrah distributed BAZNAS Garut in improving the economic welfare of the community. The method used is descriptive analysis with empirical juridical approach and graphic simulation. The results showed that: 1) conceptually and empirically, zakat can increase economic growth and welfare; 2) distribution of zakat Mal BAZNAS Garut consists of consumptive and productive programs; 3) zakat mal has a positive impact on improving economic welfare; and 4) zakat al-Fitr also has a positive impact on improving the economic welfare of the community. However, this study concludes that the management of zakat by BAZNAS Garut is not optimal, so it is necessary to improve performance to realize better welfare.

Abstract

Marriage in Islam is a social and spiritual institution that has a strong legal dimension. Islamic law regulates marriage comprehensively, starting from the pillars and conditions, objectives, to the annulment of marriage. Understanding the concept of Islamic marriage law is very important to ensure the continuity of family life in accordance with Islamic law and moral values. This research uses a qualitative-descriptive approach with a library research method. Data were collected through a review of primary and secondary sources, such as the Qur'an, hadith, classical and contemporary fiqh books, as well as Islamic legal literature and relevant legislation, including the Compilation of Islamic Law (KHI). It was found that the law of marriage in Islam includes five kinds of laws based on individual conditions: obligatory, sunnah, permissible, makruh, and haram. A valid marriage according to Islam must fulfill five main pillars, namely the prospective husband, prospective wife, guardian, two witnesses, and ijab qabul. The rights and obligations of husband and wife are regulated proportionally to maintain family harmony. Islam also establishes prohibitions on marriage in order to maintain the sanctity of the relationship and accommodate the resolution of household conflicts through divorce, khulu', and fasakh. The concept of marriage law in Islam emphasizes the importance of justice, responsibility, and protection of the human rights of each partner. These values have high relevance in the dynamics of modern life and become a strong normative foundation in the formation of a sakinah, mawaddah, wa rahmah Muslim family. In addition, the flexibility of Islamic law in responding to social situations makes it relevant to be applied in pluralistic national and international legal systems.

Abstract

Child marriage is a violation of human rights that has a systemic impact on aspects of reproductive health, education, economy, and social participation. This article conducts a comparative-critical analysis of the construction of child marriage law in three dominant legal systems: Islamic Law (based on maslahah mursalah), Continental European Law (codification-based), and Anglo-Saxon Law (precedent-based), using the theoretical framework of legal pluralism Santos (1987) and the concept of best interest of the child (CRC 1989). The research method combines a normative-doctrinal approach with a critical discourse analysis of primary legal texts and court decisions in 15 representative countries. The findings reveal three paradigms: (1) Contemporary Islamic law has undergone a transformation from classical fiqh through the reinterpretation of maqashid shari'ah with an age limit of 18 years (Law No. 16/2019 in Indonesia and the Child's Rights Act 2003 in Nigeria); (2) The Continental European System implements legal paternalism through the harmonization of EU Directive 2019/51 with the minimum age standard of 18 years without dispensation; (3) The Anglo-Saxon system developed judicial activism through progressive precedents (the Re Marriage Act 2015 in the UK and Obergefell v. Hodges in the US). This study contributes to the theory of global legal convergence by recommending an integrated legal reform model that synthesizes the legal certainty of the European system, Anglo-Saxon flexibility, and Islamic maslahah values.

Abstract

Sharia Economic Law develops in line with the development of Sharia Economics in Indonesia. This is certainly with the support of various stakeholders who handle it. It is interesting to discuss how DSN-MUI as an authority that issues fatwas related to sharia economics, especially in the field of financing, is able to balance the needs of Sharia Financial Institutions and customers until now the existence of Sharia Financial Institutions is getting better. This study is intended to examine the dynamics of sharia economic fatwas by DSN-MUI using analytical descriptive methods. It was found that DSN-MUI uses various methods and approaches in compiling fatwas that are in line with the needs of Sharia Financial Institutions while still adhering to the principles of Islamic law in the field of economics.

Abstract

This study aims to compare the concept of inheritance in three different legal systems: Islamic law, Anglo-Saxon law, and Continental European law. The main objective of this study is to analyze the differences, similarities, and social and legal implications of these different inheritance systems. The methodology of this research involves a literature review and analysis of relevant laws and regulations regarding inheritance law in the three legal systems studied. Data is collected from reliable primary and secondary sources, including Islamic legal texts, relevant laws and court decisions in Anglo-Saxon law, as well as legal regulations and precedents in Continental European law. The findings of this study reveal that Islamic law regulates inheritance based on Sharia principles, which divide inheritance proportionally according to family relations and religious provisions. Anglo-Saxon law adheres to the principle of intestate succession, whereby property is distributed to heirs based on lineage and special rules in law. On the other hand, the Continental European legal system bases the distribution of inheritance on the concept of a broader lineage, encompassing more distant relatives as heirs. The social implications of these findings highlight differences in the way societies manage inheritance and inheritance rights, which can affect justice and harmony in the family. From a legal perspective, the implication is the comprehensive variation in the protection of inheritance rights and the legal process that applies in each legal system.

Abstract

This study examines the comparison of the divorce legal system in three main legal traditions, namely Islamic Law, Continental European Law (civil law), and Anglo-Saxon Law (common law). Divorce as a legal event not only has implications for the breakdown of civil relations between spouses, but also has significant social, psychological, and economic consequences. Each legal system offers a different normative, procedural, and philosophical approach to regulating divorce, both in terms of terms, implementation mechanisms, and protection for vulnerable groups such as women and children. This study uses a comparative legal approach by utilizing Kelsen's theory of legal norms, Pound's theory of the social function of law, and Rawls and Dworkin's concepts of substantive and procedural justice. This analysis aims to describe the differences and similarities in divorce legal approaches in the three systems, as well as evaluate the effectiveness of each system in realizing justice and protection of rights in the context of divorce. This research also emphasizes the importance of harmonizing the principles of justice in divorce regulation in the era of globalization.
