Abstract

This study endeavors to conduct a meticulous analysis and comparison of the discretionary policy frameworks employed by India and Indonesia in response to the challenges posed by the COVID-19 pandemic. The research delineates its focus into two primary dimensions: firstly, an examination of the structure and application of discretionary policies formulated by the central governments of both nations; secondly, an in-depth exploration of the challenges and strategic considerations in the local-level implementation of these policies, aligned with the dynamic nature of the pandemic. Employing a rigorous research methodology, this study entails the systematic analysis of pertinent legal and policy documents, a comprehensive review of existing literature, and a nuanced conceptual and philosophical interpretation of discretionary policies in the context of pandemic management. The findings of this research underscore the distinctive approaches undertaken by India and Indonesia in the implementation of discretionary policies. India adopts a more centralized model, whereas Indonesia pursues a decentralized trajectory. Both nations encounter challenges in inter-governmental coordination, with India grappling with the harmonization of central and state policies, and Indonesia contending with disparities between central and local governance. Furthermore, the research underscores the imperative for both countries to reassess and develop legislative frameworks that are adaptive and dynamic, harmonizing legal rigidity with the requisite flexibility to effectively respond to the rapidly evolving conditions of the pandemic. Crucially, the research emphasizes the necessity for enhanced transparency and accountability within the realm of discretionary policy. Both countries are urged to fortify these elements to cultivate public trust and ensure the efficacious and equitable implementation of policies during the ongoing public health crisis.

Abstract

Pedoman dan standar mengenai tata kelola dan tertib adminstrasi kantor notaris di Indonesia belum menjadi fokus perhatian bagi semua pihak, baik pemerintah, notaris, maupun masyarakat pennguna jasa. Belum ada pengaturan hukum mengenai pedoman dan standar tata kelola dimaksud, sehingga dalam kenyataan praktik banyak terdapat pelanggaran yang dilakukan oleh para notaris. Berdasrkan hal itu maka perlu dikaji mengenai pedoman dan standar tata kelola dan tertib adminstrasi kantor notaris. Dengan menggunakan metode penelitian hukum normatif, penelitian ini menemukan bahwa terdapat kekosongan norma hukum (rechtsvacum) mengenai tata kelola dan tertib administrasi kantor notaris. Rumusan mengenai isu dimaksud belum dirumuskan secara utuh dan komprehensif.  Ketentuan mengenai kantor sebagai tempat kedudukan, dan pengaturan mengenai penyimpanan minuta akte dan protokol akte, hanya dirumuskan secara parsial bersifat inkonsisten (saling bertentangan). Oleh karena itu, perlu diterbitkan pengaturan mengenai pedoman dan standar tata kelola dan tertib adminstrasi kantor notaris, sehingga menjadi standar pemeriksaan tahunan bagi Majelis Pengawas Notaris, serta pencantuman pemberian sanksi adminstrasi bagi notaris yang tidak memenuhi atau melanggar standar dimaksud. Pengaturan dimaksud bersifat mendesak untuk diterbitkan guna menjaga kedudukan notaris sebagai pejabat umum, dan menghormati profesi notaris sebagai pekerjaan mulia (nobile officium). Dalam pengaturan dimaksud sekurang-kurangnya memuat standar fisik kantor dan papan nama, standar non-fisik (pelayanan dan kearsipan), standar sumber daya manusia (staf personalia), dan standar pendukung (tata ruang, kenyamanan, dan kebersihan/keindahan).

Abstract

Intellectual Property as the foundation of the creative economy can provide massive economic benefits with the intellectual capacity of the nation, the design and development of intellectual property-based financing schemes. however, the utilization of intellectual property resulting from the creativity of creative economy practitioners in the application of intellectual property-based financing schemes must have record or certificate of intellectual property. The awareness of creative economy practitioner in Indonesia is currently low when it comes to registering intellectual property products. This research is a normative legal study based on primary legal sources consisting of legislative regulation. It is further supported by secondary data obtained through literature reviews and an analysis of various related literature regarding the core issue of this study. Registration and recording of intellectual property in Indonesia remain low because the public, especially creative economy practitioners have limited knowledge about the intricacies of registration and recording. Additionally, the public perceives registering and recording as futile due to the weak enforcement of intellectual property laws. Creative economy practitioners also lack awareness of the benefits of registration or recording as a requirement for obtaining capital through intellectual property-based financing schemes. Efforts made by the government include improving the enforcement of intellectual property laws and simplifying and reducing the cost of intellectual property registration and recording. The support of the intellectual property recording mechanism as collateral for loans can assist creative economy practitioners in obtaining funding.

Abstract

This research focused on the restriction of specific commodities from being brought into Indonesia and the implementation of regulations aimed at tackling the illegal activity of importing these prohibited products. Analyses are conducted on secondary sources of information, including statutes, books, and periodicals, in accordance with a juridical-normative research approach and conceptual approach. The research demonstrates that the limitation on importing specific commodities into Indonesia is intended to safeguard the interests of the nation and state. The forbidden goods encompass items that have the potential to disrupt military and security, pose risks to human health, cause harm to the environment, disrupt industry, trade, and finance, and damage cultural products. The Minister of Trade Regulation No. 18 of 2021, along with the Regulation of the Minister of Trade No. 40 of 2022, clearly states the precise commodities that are prohibited. Law enforcement against importing prohibited items uses administrative and criminal penalties. The imposition of import duties and the confiscation of merchandise are examples of administrative sanctions. Criminal sanctions are governed by articles 110 and 112 of Law No. 7 of 2014, which establish the provisions for cumulative criminal sanctions and penalties. Furthermore, these enforcement measures may be harmonized with customs regulation. In general, this research provides insight into the legal mechanisms implemented to enforce the prohibitions on specific imported products in Indonesia, as well as the underlying justifications for such restrictions, to safeguard national interests.

Abstract

Cases of obscenity are currently rife in indonesia. the victims in these crimes are often childrenthe causative factor is that this act of same-sex abuse begins with a sexual deviance experienced by an individual who likes same-sex sexual or in other words is driven by homosexual behavior. (for fellow women to be called lesbians) is emotional attraction (affection, emotional connection) and/or erotically, either more prominently (predominantly) or solely (exclusively), towards people of the same sex. the same, with or without physical (physical) intercourse. the regulation or legal basis governing obscene acts is regulated in chapter xiv of the criminal code (kuhp) concerning crimes against decency, namely in articles 289 to article 296 of the criminal code. article 289 of the criminal code contains obscene acts with violence or threats of violence, while articles 290 paragraphs (2) and (3), 292, 293, and 294 paragraph (1) of the criminal code contain the crime of obscenity with the criminal code contains the criminal act of obscenity with child victims.

Abstract

Some of the values contained in the regulation of the National Social Security System Law (SJSN) and the Social Security Management Agency Law (BPJS) are contrary to constitutional values. The purpose of this paper is to examine the conflict of values. The study was conducted using normative legal research methods, which focused on the statutory and theoretical approach. This study found that social welfare mandated by the 1945 Constitution to the state is developed through the national social security system: (a) as an obligation, (b) to empower the weak and incapable people to develop themselves in accordance with human dignity, and (c) in order to fulfill basic needs, both the right to education, the right to health, and the right to get a job. In addition, although the 1945 Constitution does not specify the pattern of the social security system to be developed, the SJSN Law and the BPJS Law use a mixed model between social insurance from participants and social assistance from the state to the poor. Based on this, it is recommended to adjust the formulation of legal norms of the SJSN Law and BPJS Law contained with constitutional values.

Abstract

This study aims to analyze the effect of service quality and brand image on customer satisfaction of Telkomsel customers in Ternate City. This study is motivated by the tight competition in the telecommunications industry that requires companies to improve service quality and build a strong brand image in order to maintain and improve customer satisfaction. The research method used is a quantitative approach with data collection techniques through questionnaires. The sample in this study amounted to 100 respondents who are Telkomsel service users in Ternate. Data analysis was carried out using multiple linear regression. The results of the study indicate that service quality has a positive and significant effect on customer satisfaction, as well as brand image also has a positive and significant effect on customer satisfaction. These findings emphasize the importance of improving service quality and strengthening brand image in order to increase customer loyalty and satisfaction.
