Abstract

Mawarith and waqf are two things related to one's property. Waqf which has the characteristics of maintaining the property being waqf, and mawarith is the transfer of ownership rights from the deceased to his heirs who are still alive, whether what is left is property (money), land, or anything in the form of property rights in a shar'i way. The writing aims are to introduce the concept of mawarith and waqf integration in life or in terms known as mawarith linked waqf and show its application at Gontor. This research uses empirical juridical research methods by examining legal norms in the form of mawarith and waqf regulations related to Gontor's practices as one of the sustainable waqf based Islamic boarding schools. The results, Gontor as an educational institution has implemented an mawarith and waqf system that is beneficial for Muslims in general. By waqf system, this boarding school develops and continues to give birth to various benefits for the people. Mawarith linked waqf can increase assets and the potential for equitable distribution of property benefits.

Abstract

The development of e-commerce in Indonesia has also driven the growth of the shipping industry, including J&T Express, which is present with an innovative distribution system and shipping tariff determination based on rounding of the weight of the goods. The method of determining the tariff through rounding of weight creates the potential for a discrepancy between the actual weight of the goods and the tariff charged to consumers, thus potentially creating injustice in transactions. This study aims to analyze the implementation of the contract in the practice of rounding off the scales at J&T Express and to examine its compliance with the principles of Islamic economic law. This study uses a qualitative and conceptual approach. Data collection techniques are carried out through observation, in-depth interviews with the management and customers of the J&T Express Madiun branch, and documentation of the shipping tariff determination policy. The data obtained are analyzed descriptively-analystically using the theory of the ijarah contract in Islamic economic law. The results of the study indicate that the practice of rounding off the weights in the J&T Express Madiun branch delivery service is generally in accordance with the principles of Islamic economic law, because the pillars and valid requirements of the ijarah contract have been fulfilled, the determination of the ujrah is based on an agreement between the service provider (mu'jir) and the service user (musta'jir), the existence of the principle of justice in the implementation of transactions, and the achievement of benefits for the parties to the contract. In addition, consumers did not object to the rounding system, and the ujrah agreement was considered not to contain elements of exploitation.

Abstract

In the field of law enforcement, cases of violence perpetrated by the police often occur within the context of police investigations. Acts of violence during police inquiries are complex and controversial. Police violence in the investigative process, aimed at obtaining evidence or confessions, cannot be justified under any circumstances. In Islamic law, acts of violence by law enforcement officials during investigations are also prohibited, as regulated in the fiqh jinayah which outlines clear penalties for offenders. The objective of this research is to comprehend the occurrence of violence during police investigations and examine the jurisprudential perspective on such cases. This study falls under legal research, particularly normative juridical research, involving an examination of legal principles. It is a literature review where data is obtained from existing literature. The research employs descriptive analysis and an analytical approach to the phenomenon of violence in police investigations. After analysis, it can be concluded that acts of violence in police investigations violate Regulation of the Chief of the Indonesian National Police (Kapolri) Number 8 of 2009 and Regulation of the Chief of the Indonesian National Police Number 14 of 2011. From the perspective of fiqh in criminal jurisprudence, cases of violence during investigations can be categorized as jarimah Qishash and jarimah ta'zir, where perpetrators of violence should receive similar punishment. The application of ta'zir depends on the discretion of the judge imposing the penalty. Recommendations regarding these cases include the necessity for investigations to adhere more closely to established regulations, such as those set by the Chief of Police or fiqh jinayah, concerning the investigative process. Relevant authorities should also conduct stricter oversight of investigative procedures to prevent further violence during investigations.

Abstract

يهدف هذا البحث إلى تحديد طريقة إدارة الوقف في معهد دار السلام كونتور، وتأثير هذه الإدارة في تحسين التعليم في معهد دار السلام ا كونتور. يستخدم هذا البحث طريقة البحث الوصفي النوعي. لمعرفة والحصول على صورة عامة وبيانات عن المؤسسة قيد الدراسة، أجرى الباحثون الملاحظات والدراسات التوثيقية والمقابلات. باستخدام طريقة التحليل النوعي الوصفي، يحاول الباحث تحليل إدارة الوقفل لتحسين المؤسسات التعليمية الإسلامية في بمعهد دار السلام كونتور فونوروكو. تظهر نتائج هذا البحث أن إدارة أصول الوقف يتم تنسيقها من قبل مؤسسة توسيع وصيانة الوقف بمعهد (YPPWPM) بمساعدة المعلمين والطلاب والعمال. ومن هذه الإدارة تنتج دور المهم في تحسين المؤسسات التعليمية الإسلامية في بمعهد دار السلام  كونتور ب فونوروكو، وخاصة في القطاع التعليمي بما في ذلك بناء مساكن الطلاب وغرف التدريس والتعلم وفي القطاع الاقتصادي بما في ذلك توسيع الوقف الأرض وتحسين رفاهية أسر بمعهد.

Abstract

The purpose of this research is to explain the practice of boycotting products affiliated with Israel and to explain the legality of the boycott movement from the perspective of the Saddu Dzari’ah. This research is a qualitative study with a juridical-normative typology. The data collection method in this research is documentary study. Primary data were obtained from the documentation of several news portals discussing the boycott movement of products affiliated with Israel, as well as Turath books discussing the principle of Saddu Dzari'ah. As for the secondary data, it was obtained from journals and previous research that discuss the principle of Saddu Dzari’ah.

Abstract

Egg freezing is a form of artificial insemination method legally permitted in emergencies. Still, the current phenomenon is that many women use it to postpone marriage and postpone having children at a young age with the desire to have children in their old age. Therefore, the author is interested in studying and discussing egg freezing with sadd dzari'ah analysis. This discussion aims to discover how egg freezing is carried out in women and how to analyze sadd dzaro'i in women who use the egg-freezing method. This research uses normative research that examines document studies using secondary data from legislation and legal theory. This normative research uses qualitative analysis from books, journals, and relevant articles to collect data using literature study techniques to find research results based on the Al-Qur'an and Hadith. As a result of this research, the author examines that egg freezing is permitted with syar'i conditions. However, what happens when it is used is non-shar'i washilah, so the impact on the mafsadah is greater than the benefit. Thus, the author concludes that it is better to abandon egg freezing to prevent greater harm, such as mixing egg cells. So, preventing something is better than bringing about forgiveness.

Abstract

This study explores the differing views of the Maliki and Shafi’i schools on whether breastfeeding using powdered breast milk (ASI Bubuk) establishes a mahram relationship. It also examines how this issue fits within Islam's social and cultural context in the Nusantara region. One of the key questions is whether transforming breast milk into powder changes its essential characteristics: color, taste, and smell. Using a comparative descriptive approach, this research highlights that both schools agree that powdered breast milk can create a mahram bond if its core properties remain unchanged, even when mixed with food, drinks, or medicine. However, they set different conditions. The Maliki school holds that a single feeding session is enough, whether the milk enters through the mouth or nose, as long as it reaches the stomach and provides nourishment. On the other hand, the Shafi'i school requires five separate breastfeeding sessions, all within the first two years of a child's life. Beyond the legal debate, this study also considers powdered breast milk's social and health implications in determining mahram relationships. Given the evolving ways breast milk is processed and used, further research involving other schools of thought could offer deeper insights into how Islamic law adapts to modern developments.

Abstract

This study aims to examine the view of fiqh of marriage (fiqh munakahat) and the principle of ‘urf regarding the prohibition of the siji jejer telu marriage, as well as to understand the community's perspective on this prohibition in Desa Carangrejo, Kecamatan Sampung, Kabupaten Ponorogo. The research method used is qualitative descriptive. The data collected by the researcher comes from interviews, observations, and documentation. The results of the study show that most of the people in Desa Carangrejo, Kecamatan Sampung, Kabupaten Ponorogo still believe in the prohibition of the siji jejer telu marriage with the aim of avoiding several negative consequences that are believed to occur if the prohibition is violated. This belief is based on the source from one of the community leaders, Mr. Sukar. In fiqh munakahat, there is no prohibition on marriage based on birth order, such as the siji jejer telu marriage. Islam stipulates that if the essential elements and conditions of marriage are fulfilled, the marriage is considered valid. However, if any of the conditions are missing, the marriage is considered invalid because it does not meet the necessary requirements. The siji jejer telu marriage tradition falls into the category of incorrect customs or ‘urf fasid, as this belief contradicts and is inconsistent with Islamic law (syariat).
