Abstract

Handling Children in Conflict with the Law (ABH) cannot be done like adults. Through its role, the Correctional Center (BAPAS) plays an essential role in the judicial process of ABH, following applicable laws and regulations. This paper will present the implementation of the role of Bapas in understanding, appreciating, and carrying out all the mandates contained in the SPPA Law because, with the SPPA Law, there are many changes in the system, mechanisms, and procedures for Bapas in carrying out their duties and functions in handling ABH. The purpose of this study was to determine the role of Bapas class II Merauke in the settlement of criminal cases by children and the obstacles faced by Bapas class II Merauke in the settlement of criminal cases by children. The method used in this study is a juridical-empirical research method whose writing nature is descriptive with a qualitative approach to observe behavior, actions, social environment, and other aspects related to the implementation of the role of Bapas Class II Merauke at each stage in the judicial process undertaken by ABH, namely at the stage in the judicial process conducted by ABH, namely at the pre-court stage (post-adjudication, court stage (adjudication), and post-court stage (post-adjudication). The results showed that Bapas has obstacles in resolving criminal cases by children, among others: Large working area, lack of coordination among law enforcement officers, lack of quantity of human resources in Correctional Center Class II Merauke, lack of adequate facilities and infrastructure, families of juvenile clients who are not cooperative with Bapas officers, absence of LPKA and LPAS budget allocation and very minimal funds. Nevertheless, the function of Bapas in handling ABH can be carried out according to the stages set. Following the legislation, Bapas Class II Merauke can function as an institution that handles ABH differently from how adults are handled.

Abstract

Pekerja di lokalisasi seperti di Lokalisasi Yobar, Kabupaten Merauke, menghadapi kerentanan multidimensional, meliputi aspek sosial, ekonomi (informalitas, eksploitasi), dan kesehatan (khususnya risiko IMS/HIV). Meskipun telah ada kerangka hukum seperti Peraturan Daerah Nomor 3 Tahun 2013 yang relevan untuk perlindungan IMS (Pasal 32 ayat 2), implementasi di lapangan dan pemahaman pekerja terhadap kebermanfaatannya masih memerlukan evaluasi. Guna mengatasi kerentanan ini dan meningkatkan kesejahteraan pekerja secara holistik, dilakukan intervensi melalui pendampingan perizinan usaha sebagai upaya formalisasi ekonomi dan evaluasi partisipatif terhadap implementasi Perda Perlindungan IMS dari perspektif pekerja. Pendekatan partisipatif dipilih untuk memastikan pendampingan sesuai kebutuhan riil dan evaluasi mencerminkan pengalaman langsung penerima kebijakan. Pendampingan perizinan usaha bertujuan membuka akses ekonomi dan stabilitas, sementara evaluasi Perda bertujuan memahami efektivitas perlindungan kesehatan dan mengidentifikasi hambatan. Kombinasi kedua pendekatan ini diharapkan dapat mengurangi berbagai lapis kerentanan dan meningkatkan kesejahteraan pekerja di lokalisasi.

Abstract

Kebijakan Lembaga Permasyarakata (LAPAS) tentang perlakuan terhadap narapidana wanita termasuk kebijakan akses layanan kesehatan, hak untuk mendapatkan pelayanan kesehatan yang memadai, serta hak untuk mendapatkan informasi tentang kesehatan dengan jelas dan transparan.  Identifikasi kebijakan dan regulasi yang berkaitan dengan perlindungan hak narapidana wanita di LAPAS dalam konteks hukum kesehatan melibatkan penelusuran terhadap peraturan yang mengatur hak-hak kesehatan di dalam sistem perundang-undangan yang berlaku. Peran petugas LAPAS menjadi dapat bertindak sebagai pendukung dan fasilitator dalam penyuluhan hukum kesehatan dengan memberikan akses untuk mendapatkan perlindungan hak pada narapidana Wanita. Tujuan dari kegiatan pengabdian ini adalah Menghasilkan program  penyuluhan hukum kesehatan pada petugas LAPAS tentang perlindungan hak pada narapidana wanita Metode yang digunakan pada kegiatan pengabdian ini yaitu penyediaan Informasi tentang hak-hak kesehatan dan perlindungan hukum narapidana wanita melalui penyuluhan dan sesi diskusi interaktif pada narapidana Wanita. Pengabdian masyarakat ini dapat menjadi dasar untuk merumuskan rekomendasi dan regulasi yang bertujuan untuk memperbaiki atau memperkuat perlindungan hak-hak narapidana wanita melalui peningkatan peran petugas LAPAS Kelas II B Merauke.

Abstract

Papua, with Indonesia's richest biodiversity, faces significant climate change challenges. Sustainable policies require synergy among stakeholders, including indigenous communities with their local knowledge and traditional practices. The forest, seen as "Mama" by Papuans, is crucial for their livelihood and customs. Despite their efforts to protect it, indigenous communities remain vulnerable to climate impacts. Their limited participation in planning and decision-making often leads to ineffective climate solutions. This research explores policies by regional and central governments and the active role of indigenous communities, focusing on climate change due to the conversion of customary forests into oil palm plantations and the marginalization of indigenous communities from losing their ancestral forest rights and access. The qualitative study shows that collaboration between the government and indigenous communities can enhance climate policy effectiveness. Indigenous participation enriches local knowledge and strengthens environmental commitments. The article highlights partnership challenges, such as differing perspectives and the need for flexible policy adaptation. The main recommendations are to strengthen communication and build capacity at both government and indigenous community levels for effective climate change mitigation in Papua. This collaboration could serve as a model for other regions facing similar challenges.
