Abstract

International armed conflict is defined as a conflict between two or more states or between one state and another party that does not yet have state status. In the world of international law, the Geneva Conventions have been considered the right decision because the results of the convention have been agreed and signed by countries that have been recognized by the United Nations. The essence of the convention is an agreement that protects the safety of military members wounded during the war. In the application of the results of the Geneva Conventions and international human rights law is still not fully applicable. An alliance of countries that gives full support to the Israeli-Palestinian war causes legal defects. The conflict between the two countries has been going on since the early 20th century until now. The Israeli-Palestinian armed conflict is slowly attacking civilians as well. This research is a normative research, which is used to see problems related to armed conflict through legal studies. When viewed from the point of view of the basic state and the principles of the International Law of War, the Israeli-Palestinian war does not follow the existing rules. Several international rules already exist to deal with similar cases, which provide rules and protection. The United Nations here serves to maintain world peace from conflicts between countries.

Abstract

Every five years, Indonesia holds General Elections that are held directly, generally, freely, secretly, honestly, fairly, or commonly known as Luber Jurdil. In the principle of ethics, in politics related to morals, the politics of a country if followed by ethics then a prosperous, just and prosperous nation will be achieved. At this time, campaigns are still widely used to invite commotion by spreading hoaxes. The president has an obligation to maintain neutrality. The president has an obligation to maintain his neutrality during the election campaign. Yesterday's campaign, the President was accused of carrying out a campaign that skewed towards one of the candidate pairs. In this study, juridical normative research was used to see issues related to campaign ethics for the President. When viewed from the context of democracy, the President has the right and freedom as a citizen to participate in the political process, including in election campaigns. As someone who is subject to the rules, the existence of rules regarding the President's right to campaign during the election period, the President must also maintain ethics and moral values outside of the existing legal rules.

Abstract

Menstruation is a biological function that occurs naturally and is important in contributing to reproduction for all women. Even though it is a reproductive function that is experienced naturally by women, the experience of menstruation can vary, from mild symptoms to severe symptoms. As a result of menstrual symptoms on the first and second day experienced by almost all women, this causes their activities, performance and quality of life to be disrupted. This is a consideration for the Government to implement menstrual leave for companies in Indonesia. Menstrual leave was implemented by the government in labor law No.13 of 2003. The creation of labor law regulations was nothing more than a relief to working conditions for female workers. Although the law recognizes the right to menstrual leave, there are many obstacles to exploiting the right which requires a lot of practical activities and a deep understanding of more real situations or actions.

Abstract

Penelitian ini menelaah secara kritis peran World Trade Organization (WTO) dalam membuka akses pasar jasa bagi negara berkembang di tengah percepatan ekonomi digital, dengan menyoroti implementasi General Agreement on Trade in Services (GATS) yang kerap dihadapkan pada kesenjangan struktural, ketimpangan kapasitas negosiasi, dan dominasi negara maju. Metode yang digunakan adalah yuridis normatif dengan pendekatan konseptual dan studi perbandingan, memanfaatkan bahan hukum primer berupa perjanjian internasional dan instrumen WTO, didukung literatur akademik dan riset lembaga internasional sebagai bahan sekunder, serta referensi hukum tersier. Hasil analisis kualitatif memperlihatkan bahwa meskipun WTO menyediakan kerangka hukum dan forum negosiasi untuk liberalisasi jasa, praktiknya masih jauh dari cita-cita kesetaraan substantif: keterbatasan infrastruktur digital, disparitas standar regulasi, dan minimnya dukungan konkret membuat negara berkembang tetap berada di posisi yang rentan, sehingga liberalisasi jasa di bawah WTO lebih sering menghasilkan kesetaraan formal semu ketimbang akses pasar yang benar-benar inklusif dan berkeadilan.

Abstract

Kasus HAM sangat marak terjadi di Indonesia. Undang-Undang Pemberantasan Tindak Pidana Perdagangan Orang mengatur tentang hak asasi manusia yang sangat penting untuk ditegakkan karena memberikan kesetaraan bagi manusia. Namun dalam pelaksanaannya sering berbeda dengan apa yang seharusnya, maka penelitian ini mendalami kasus HAM yang terjadi di Indonesia. Dalam Penelitian ini, metode yuridis normative digunakan untuk melihat persoalan terkait perdagangan orang melalui kajian bahan hukum. Contoh kasus pelanggaran HAM yang terjadi antara lain adalah Perdagangan Manusia. Tujuan Undang-Undang ini memberi sanksi atau menjerat setiap aksi atau perilaku yang dilakukan dalam aksi perdagangan manusia, yang dilakukan di mana saja, kapan saja, dan siapa pelaku aksi tersebut. Praktik perdagangan orang ini sering terjadi pada perempuan dan anak-anak dengan berkedok TKI yang bahkan terjadi di luar negeri, hal ini didasari peristiwa yang baru saja terjadi dengan Ida yaitu korban TKW dari perdagangan manusia di Dubai. Berdasarkan hal yang terjadi pada Korban terdapat beberapa faktornya antara lain, Kemiskinan, pekerjaan dan pendidikan yang rendah dan kurangnya lapangan pekerjaan di Indonesia. Perlindungan hukum terhadap korban tindak pidana perdagangan orang, khususnya perempuan yang melintasi batas negara, diharapkan dapat tercapai. Pemerintah, lembaga pemerintah, presiden, masyarakat, dan keluarga semuanya bertanggung jawab dalam pencegahan dan penanganan tindak pidana perdagangan orang.
