Abstract

The research delves into the A’matoang customary tradition within marriage from the perspective of Islamic law. Conducted as a field study, it directly engages with subjects to gather pertinent data. Employing a juridical-empirical approach, the study incorporates data collection methods such as observation, interviews, documentation, and subject-object identification. In accordance with the Urf theory (Customary Tradition) in Islamic Law, the A’matoang tradition in marriage has long prevailed in the Jeneponto region. This tradition involves the bride's family visiting the groom's family, presenting various gifts as expressions of gratitude or reciprocation for the dowry given. From the Islamic legal standpoint, A’matoang is deemed an Urf or customary tradition consistently practiced. The Islamic legal perspective emphasizes that this tradition is an established Urf or customary practice, considered valid as it aligns with Islamic teachings and avoids elements of polytheism. The implications of this research underline the importance of preserving the A’matoang Tradition while prioritizing well-being and adherence to Islamic teachings. If this cultural practice potentially brings significant harm to its participants, abandonment is deemed advisable. Ideally, the post-marriage A’matoang Tradition should not merely signify respect or a gift to the groom's family in response to the dowry, but also serve as a prayer for Allah’s blessings in fostering a harmonious marital life (sakinah, mawadah, warahmah).

Abstract

Terdapat ratusan bahkan ribuan keluarga Nabi Muhammad SAW yang tiinggal dan menetap di Indonesia. Salah satu daerah yang banyak terdapat keluarga cucu Nabi Muhammad SAW adalah Kota Palu dan mereka mayoritas berasal dari Hadhramaut (Yaman). Dalam kurun waktu 5 tahun terdapat setidaknya 20 kali pernikahan antara Syarifah dan non Sayyid. Penelitian ini bertujuan untuk mengetahui serta menggambarkan kondisi atau kasus pernikahan antara Syarifah dan non Sayyid di kalangan Habaib Kota Palu mendeskripsikan penerapan kafa’ah dalam aturan pernikahan antara Syarifah dan non sayyid menurut pandangan beberapa habaib yang ada di Kota Palu. Jenis penelitian ini adalah penelitian hukum empiris. Teknik pengumpulan datanya dilakukan dengan metode wawancara,dan study pustaka, yang keduanya mencoba menjawab fenomena yang terjadi tentang implementasi kafa’ah dalam penerapan aturan pernikahan antara Syarifah dan non Sayyid. Menurut Pandangan Mayoritas Habaib di Kota Palu bahwa syarifah tidak diperkenankan menikah dengan non sayyid karena dianggap tidak sekufu ban bagi mereka keturuna Nabi Muhammad SAW memiliki kemuliaan serta keutamaan yang tidak dimiliki oleh semua orang. Oleh karena itu masalah kafa’ah sangat diperhatikan oleh para Habaib di kota Palu.

Abstract

ABSTRACT This study aims to describe the Qur'anic insights on gender and implications for Islamic law. This research is qualitative research, the type of research is library research. The data collection method used is literature study. The results showed that the Qur'anic insights about gender and implications for Islamic law are the transformation of Islamic legal thought related to the issue of equal relations between men and women in the text of the Qur'an and hadith, the transformation of thought in the field of professions such as female judges and other professions that are generally carried out by men, becoming a source of inspiration for the emergence of legislation that favors the interests of women. Keywords: Qur'anic Insights; Gender; Implications; Islamic Law.

Abstract

The study aims to explain the practices of productive waqf management, development, and utilisation by waqf managers in Islamic boarding schools in Maros Regency. This is a qualitative study. The research design is field research. The results of this study indicate that: The management of productive endowments at the Raudaturrasyidin DDI Cambalagi Islamic boarding school is categorised as unproductive with insignificant income growth due to irregular harvests throughout the year. The realisation of the utilisation of profits from productive endowment income at the Raudaturrasyidin DDI Cambalagi Islamic Boarding School. Meanwhile, the management of productive endowments at the Nurul Ikhwan Islamic Boarding School through the boarding school canteen is categorised as productive with a significant increase in income. Meanwhile, the management of productive endowments at the Nahdlatul 'Ulum Islamic Boarding School through the mini market Aminah demonstrates productive management of productive endowments on endowed assets, namely the Mini Market Aminah, which is categorised as moderately productive with significant income growth from May to December 2023 and May to December 2024. Each portion of the income from productive endowments at the three boarding schools has a designated allocation for utilisation. On the other hand, development aspects are not being implemented at the pond managed by the al-Irsyad Foundation.

Abstract

This study discusses the shift in the role of buzzers towards the political arena in Indonesia, causing confusion among the online and offline public. This is likely due to the fact that regulations regarding political buzzers, in particular, are still vague. For example, the ITE Law can ensnare buzzers or those who threaten their existence. Political buzzers often raise identity issues, such as the personalities of candidates and messages with religious themes. They have the ability to shape public perception of certain candidates. The concept of buzzers, which previously had positive connotations, has shifted to become negative. This is because they can divide society by spreading hoaxes and hate speech. This research is qualitative, using library research as the type of research. The data collection method used is literature study, with a hadith ahkam approach. The findings reveal that the term ‘buzzer’ indirectly refers to practices such as gossip, slander, and propaganda in the context of hadith ahkam. These practices are fundamentally prohibited under Islamic law and positive law. However, within the framework of positive law, there are still loopholes that allow political buzzers to evade the legal consequences of their actions.

Abstract

This study aims to explain the regulation of hate speech mitigation in Article 45A(2) of Law No. 1 of 2024 and to examine the criticism of Maqasid Al Syari'ah against the regulation of hate speech mitigation in Article 45A(2) of Law No. 1 of 2024. This study is a qualitative research. The research design is a literature review. The findings of this study indicate that: First, Article 45A(2) of Law No. 1 of 2024 is a legislative effort to address the spread of hate speech based on ethnicity, religion, and race through electronic media. By understanding and complying with these provisions, the public is expected to contribute to creating an inclusive and harmonious digital space. However, the success of implementing this regulation depends heavily on consistent law enforcement, strengthening digital literacy, and collaboration between the government, the public, and social media platforms. With a holistic approach, it is hoped that this regulation can become an effective instrument in creating a safe and inclusive digital space. Second, Maqasid al Syari'ah's criticism of the hate speech mitigation regulation in Article 2 of Section 45A of Law No. 1 of 2024, namely that the regulation is not yet fully considered in line with the preservation of religion (hifz al-din), life (hifz al-nafs), intellect (hifz al-'aql), lineage (hifz al-nasl), and property (hifz al-mal).

Abstract

This study aims to examine the consistency of social reality in the tradition of Uang Panai’ in the South Sulawesi MUI Fatwa Number 02 of 2022 concerning Uang Panai’ with the fifth principle of Pancasila and Maqasid al-Syari’ah. This study is a qualitative research. The research design is a literature review. The results of the study indicate that; first, the concept of Uang Panai’ was originally intended to honour the bride’s family. Uang Panai’ among the Bugis people is used as wedding celebration money or commonly referred to as shopping money, with the purpose of expressing the groom’s respect for the bride. Second, based on the social reality of the Uang Panaik tradition as stated in the MUI South Sulawesi Fatwa No. 02 of 2022 on Uang Panaik, it can be concluded that this social reality is inconsistent with the fifth principle of Pancasila and the Maqasid al-Syariah. Although the initial purpose of the dowry tradition, which is to honour the bride and meet financial needs in the marriage ceremony, is considered consistent with the fifth principle of Pancasila and Maqasid al-Syari’ah.
