Abstract

The legal liability of partners in civil partnerships, firms, and CVs is also an important issue. Each type of partnership has a different liability structure. For example, in a CV, a general partner has full responsibility for the company's debts, while a limited partner is only responsible up to the capital invested. Lack of understanding regarding the limits of each partner's authority can lead to legal disputes that are detrimental to all parties. With their respective characteristics, objectives, and legal consequences, civil partnerships, firms, and commanditaire vennootschap (CV) are very important forms of partnership in Indonesian business law. Because each involves an agreement between parties who want to share the profits of a joint venture, these three types of partnerships are closely related to each other. Each has specific features that can be selected according to the needs and objectives of the company. Civil Partnerships, Firms, and CVs offer a variety of structures that can be tailored to the type of business and the number of tasks desired by the partners.

Abstract

Legal protection for parties harmed by default is an important issue in contract law. Default, referring to the failure of one party to fulfill obligations in a contract, often results in significant losses for the aggrieved party. This study aims to analyze the types of legal protections available for the harmed party and the dispute resolution mechanisms that can be applied. Using a qualitative approach, this research explores both preventive and repressive aspects of legal protection, including the creation of clear and specific agreements as well as legal actions that can be taken after a default occurs. The findings indicate that while various protective mechanisms exist, there are still many challenges in their implementation. Therefore, there is a need to enhance awareness of the importance of legal protection and enforcement of the rights of harmed parties to create justice in contractual relationships.

Abstract

The issue of breach of contract by developers in property sale and purchase transactions through the Mortgage Loan (KPR) scheme has become a significant concern in consumer protection in Indonesia. This research aims to analyze the legal responsibility of developers and the legal protection efforts for consumers who suffer losses due to breach of contract in property sales under KPR agreements. The research method used is normative legal research with a statutory and case study approach. Data collection techniques include literature review, analysis of legal documents, and empirical data from banking reports and relevant cases. The data were analyzed qualitatively by interpreting applicable legal provisions and reviewing their implementation in practice. The results show that in the tripartite legal relationship between developers, consumers, and banks, each party has rights and obligations based on the principle of freedom of contract. When a developer commits a breach of contract, consumers are entitled to legal protection as stipulated in Law Number 8 of 1999 on Consumer Protection and the Indonesian Civil Code. This protection includes the right to compensation, the right to accurate information, and access to dispute resolution mechanisms. Consistent law enforcement is essential to safeguard consumer rights in the KPR system.

Abstract

The misuse of firearms by members of the Indonesian National Armed Forces (TNI) constitutes a serious violation that not only breaches military discipline but also poses a threat to civilian security and public trust. This study aims to analyze the legal considerations in military court decisions involving soldiers who have misused firearms, as well as to assess the effectiveness of verdict implementation, the forms of legal accountability imposed, and the impact of public pressure on judicial proceedings. Using a normative juridical approach and case studies of several military court rulings, the findings indicate inconsistencies in sentencing, the influence of the defendants’ relationships with superiors, and a lack of transparency and internal oversight. Moreover, public pressure plays a significant role in shaping judicial outcomes—both as a driver of justice and as a potential threat to judicial independence. Reform of the military justice system is needed through strengthened oversight mechanisms, improved disciplinary training, and safeguarding judicial independence in order to achieve substantive justice and uphold public confidence
