Abstract

Environmental-friendly technology plays a crucial role in modern industries, including PT Inalum, a leading aluminum producer in Indonesia. The company has implemented various innovations to minimize environmental impacts, such as utilizing renewable energy sources, waste management systems, and emission reduction technologies. These efforts aim to comply with national environmental regulations, such as Law Number 32 of 2009 on Environmental Protection and Management, and international commitments like the Paris Agreement 2016. This study examines the challenges faced by PT Inalum in implementing sustainable technology. The research employs normative legal analysis and case study methods, focusing on regulatory reviews and corporate sustainability practices. Key challenges include regulatory uncertainty, overlapping government policies, and weak law enforcement mechanisms. Additionally, high investment costs for green technology adoption pose a significant barrier to achieving optimal environmental sustainability. The findings indicate that despite PT Inalum’s commitment to environmentally friendly practices, legal and economic obstacles hinder full regulatory compliance. The study suggests the need for clearer policies, stronger enforcement mechanisms, and financial incentives to encourage sustainable industrial transformation. Enhanced collaboration between government authorities and industry stakeholders is essential to creating a more effective and efficient sustainability framework.

Abstract

Indonesia as a democratic country that emphasizes the rule of law as the main foundation, makes Pancasila as the moral and philosophical foundation for the constitution and laws and regulations. This research aims to evaluate the consistency of Government Regulation Number 28 Year 2022 on the Management of State Receivables with the principles of Pancasila, as well as to assess the extent to which its practical implementation reflects the moral and philosophical values of Pancasila. The method used in this research is juridical-normative with a conceptual and statutory approach, accompanied by qualitative descriptive analysis of relevant statutory documents and legal doctrine. The results of the analysis highlight the importance that Government Regulation No. 28 Year 2022 must comply with the existing legal hierarchy, as well as consistently reflect the principles of Pancasila as a moral and philosophical foundation in the regulation of state receivables. Nonetheless, the addition of new rules concerning liability for state receivables raises debates about consistency and social justice. Therefore, it is important for the government to ensure that the implementation of the rules not only considers the legal and financial aspects, but also the social and humanitarian impacts on the individuals involved. Success in regulating state receivables should be measured by the extent to which the principles of Pancasila are respected and social justice is realized in the process, which will help strengthen the foundations of democracy and the rule of law in Indonesia.

Abstract

In the 21st century, the phenomenon of labor migration is becoming increasingly significant globally. Japan has become one of the main destinations for Indonesian workers. However, legal protection for them in Japan is still a major concern. This study provides an in-depth insight into the challenges faced by Indonesian workers in Japan in obtaining adequate legal protection. Using a qualitative approach and text analysis, this research uncovers important aspects of legal protection for Indonesian workers in Japan. The findings highlight the need for an evaluation of the effectiveness of the legal protection provided, as well as an emphasis on its relation to the principles of human rights and the values of Pancasila. The legal protection provided should be in line with human rights principles, such as the rights to justice, equality and humanity. As a country based on Pancasila values, the practice of legal protection for Indonesian workers in Japan must also be consistent with Pancasila values, such as social justice, unity, and humanity. The recommendations from this research can serve as a foundation for improving the legal protection system for Indonesian workers in Japan, with the ultimate goal of improving their welfare and ensuring that their rights are properly recognized, respected and protected. As such, this research not only provides a better understanding of the challenges faced by Indonesian workers in Japan, but also offers directions that can be taken to improve their conditions in the future.

Abstract

Migrasi internasional, terutama di antara calon pekerja migran Indonesia yang menuju ke Jepang, telah menjadi fenomena sosial yang signifikan dalam beberapa dekade terakhir. Meskipun motivasi ekonomi mendominasi keputusan mereka untuk bekerja di luar negeri, penting untuk mengakui bahwa aspek sosial dan budaya juga berperan penting. Kehilangan akar budaya dan identitas nasional selama tugas di luar negeri adalah masalah yang memerlukan perhatian khusus. Kegiatan ini bertujuan untuk menanamkan rasa nasionalisme dan patriotisme dalam para calon pekerja migran Indonesia, serta mengidentifikasi tantangan yang mungkin mereka hadapi melalui wadah PT Multi Generasi Indonesia yang sangat memperhatikan citra Indonesia di mata dunia terhadap peserta yang diberangkatkan dari perusahaan ini. Perusahaan ini menyadari bahwa nilai-nilai nasionalisme dan pemahaman calon tenaga kerja tentang nilai-nilai nasional dapat memengaruhi citra Indonesia di mata dunia. Hasilnya menggaris bawahi kebutuhan perbaikan dalam kurikulum pelatihan tenaga kerja melalui lembaga penyaluran tenaga kerja, penekanan pada program pendampingan di negara tujuan, peran aktif keluarga dan masyarakat, dan peningkatan fokus pada nilai-nilai nasional. Ini adalah langkah penting untuk memastikan bahwa pekerja migran tetap terhubung dengan budaya dan identitas Indonesia saat berada di luar negeri. Kegiatan ini memberikan landasan bagi perubahan dalam persiapan calon pekerja migran dan memperkuat peran mereka sebagai duta budaya Indonesia di mancanegara.
