Abstract

With the development of increasingly advanced times, the bank continues to make new innovations so that at this time the bank is no longer just an institution that functions to collect and distribute funds, but at the same time also as an intermediary in the payment traffic. However, the Muslim community strives to realize banking based on sharia principles. For this reason, several Muslim countries have slowly begun to establish Islamic Banks. The development of Islamic banking is quite significant in several countries, but of the many countries, Indonesia actually has a different side. The difference lies in the term used to refer to a non-conventional bank. While other countries commonly refer to it as an Islamic Bank, in Indonesia it is actually called the Sharia Banking because the idea of ​​the Islamic Bank is alleged to have contained political and SARA elements. With high stretches owned by several Muslim countries to establish shari'ah banking, Indonesia as the country with the largest Muslim population in the world established the first sharia banking under the name Bank Muamalat Indonesia (BMI) which was officially operated in 1992. From year to year, Sharia banking growth is very fast. Keywords : Banking, Sharia Banking,Indonesia. Abstrak Dengan perkembangan zaman yang semakin maju, bank terus melakukan inovasi baru sehingga pada saat ini bank tidak lagi hanya sekedar lembaga yang berfungsi menghimpun dan menyalurkan dana saja, namun sekaligus juga sebagai intermediasi dalam lalu lintas pembayaran. Namun, komunitas Muslim berusaha untuk mewujudkan perbankan berdasarkan prinsip syariah. Atas dasar alasan inilah, beberapa negara muslim perlahan mulai mendirikan Bank Islam. Perkembangan perbankan Islam cukup signifikan terjadi di beberapa negara, tetapi dari sekian banyak negara, Indonesia justru memiliki sisi yang berbeda. Perbedaan tersebut terletak pada istilah yang dipakai untuk menyebut bank yang nonkonvensional.Di saat negara-negara lain lazim menyebutnya sebagai Bank Islam, di Indonesia justrumenyebutnya Bank Syari’ah karena istilah Bank Islam diduga mengandung unsur politik dan SARA.Dengan geliat tinggi yang dimiliki oleh beberapa negara muslim untuk mendirikan perbankan syari’ah, Indonesia sebagai negara dengan populasi muslim terbesar di dunia mendirikan perbankan syariah pertama dengan nama Bank Muamalat Indonesia (BMI) yang secara resmi beroperasi pada tahun 1992.Dari tahun ke tahun, pertumbuhan perbankan syari’ah sangatcepat. Abstract

Abstrak: Pemilihan umum (Pemilu) adalah salah satu pilar demokrasi yang vital dalam menjaga kesehatan suatu negara. Dalam konteks ini, perlu memperhatikan kelompok unik, yaitu Warga Binaan Permasyarakatan (WBP) yang berada di dalam lembaga pemasyarakatan. WBP sering menghadapi keterbatasan dalam akses terhadap informasi, pendidikan, dan partisipasi politik yang diperlukan untuk menjadi pemilih yang terinformasi dan terlibat dalam proses demokrasi. Hasil kegiatan menunjukkan peningkatan pengetahuan politik di kalangan WBP, meningkatkan partisipasi politik mereka, serta pengembangan keterampilan sosial dan hidup yang berguna setelah pembebasan. WBP menjadi lebih percaya diri dalam berperan aktif dalam proses politik. Hasil kegiatan menunjukkan peningkatan pengetahuan politik di kalangan WBP, meningkatkan partisipasi politik mereka, serta pengembangan keterampilan sosial dan hidup yang berguna setelah pembebasan. WBP menjadi lebih percaya diri dalam berperan aktif dalam proses politik. Kegiatan edukasi di dalam lembaga pemasyarakatan berperan penting dalam mempersiapkan mental dan meningkatkan partisipasi politik WBP. Meskipun memiliki dampak positif, terdapat tantangan dalam hal sumber daya dan akses teknologi yang perlu diatasi. Dengan pengalokasian sumber daya yang tepat dan solusi kreatif, kegiatan edukasi ini dapat memainkan peran penting dalam memperkuat partisipasi politik dan kualitas demokrasi. Kegiatan edukasi di dalam lembaga pemasyarakatan membantu mempersiapkan WBP secara mental dan meningkatkan partisipasi politik mereka, menjaga kesehatan demokrasi, dan menciptakan masyarakat yang lebih inklusif dan demokratis.Abstract: General elections (Pemilu) are one of the vital pillars of democracyin maintaining the health of a nation. In this context, it is important to consider a unique group, namely Incarcerated Citizens (WBP) within correctional institutions. WBP often face limitations in accessing information, education, and political participation necessary to become informed voters and engage in the democratic process. Research results indicate that an increase in political knowledge among WBP enhances their political participation and the development of social and life skills that are useful after their release. WBP become more confident in actively participating in the political process. Research findings also reveal that political education activities within correctional institutions play a crucial role in preparing the mindset and enhancing the political participation of WBP. Despite having a positive impact, there are challenges related to resourcesand technological access that need to be addressed. With proper resource allocation and creative solutions, these educational activities can play a significant role in strengthening political participation and the quality of democracy. Educational activities within correctional institutions aid in mentally preparing WBP and increasing their political participation, thereby safeguarding the health of democracy and creating a more inclusive and democratic society.

Abstract

The environmental crisis is characterized by climate change with an increase in the earth's average temperature of 1.50 - 2.00 Celsius. Climate change can increase the risk of hydrometeorological disasters by 80% of the total disasters that occur in Indonesia. Overcoming the impacts of climate change requires a lot of money. One form of funding instrument to overcome the impact of climate change is green sukuk. Research Objective to critically analyze the trend of green sukuk research in Indonesia. This type of research is a literature review using PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analysis) through four (4) stages, namely identification, screening, eligibility and included. The results showed that the green sukuk trend has dominated in the development of SDGs over the past 3 years. The issuance of green sukuk has contributed to the achievement of the Sustainable Development Goals (SDGs) Framework. From the maqāṣid al-sharī`ah framework through the interrelated hierarchy of the system of Islamic law approach, green sukuk used for eligible green projects fall into the urgency of al-ḍarūrīyah, al-ḥājīyah and al-taḥsīnīyah. The benefit created is maqāṣid al-khāṣṣah which is in line with QS. From these two (2) verses, there is a basic objective of sharia, namely hifẓ al-bi`ah. It is necessary to expand uṣūl al-khamsah by adding one component of hifẓ al-bi`ah (becoming uṣūl al-sittah). So that maqāṣid al-sharī`ah can accommodate universal benefits in response to increasingly severe environmental damage. Green sukuk has the scope of hifẓ al-bi`ah within the framework of maqāṣid al-sharī`ah including mitigation (al-ḍarūrīyah), adaptation (al-ḍarūrīyah), environment (SDGs) (al-ḥājīyah), social - economic (SDGs) (al-taḥsīnīyah), and governance (al-taḥsīnīyah).

Abstract

This study aimed to develop a new model for MSME growth and identify key factors influencing the increase in halal market share among MSME through empirical testing of the Unified Theory of Acceptance and Use of Technology (UTAUT-3). A mixed-method sequential explanatory approach was employed. The sample was selected using purposive sampling, resulting in 70 respondents. Quantitative data were analyzed using the Partial Least Squares Structural Equation Modeling (PLS-SEM) method, while qualitative data were examined through triangulation and the Analytical Network Process (ANP) method. The findings revealed that all independent variables—including performance expectancy, business expectancy, social influence, facilitating conditions, hedonic motivation, price value, habits, and personal innovation—had a significant positive effect on behavioral intentions to use QRIS among MSME actors in Lhokseumawe City. These results highlight the need for more intensive and comprehensive utilization of digital technology to achieve optimal business performance. The adoption of QRIS, strengthening of halal branding, product innovation, and increased competitiveness are strategic steps toward building partnerships with various stakeholders and developing a sustainable halal MSME ecosystem. Supportive government policies and programs are essential for fostering an ecosystem that promotes technology adoption and the growth of halal products in the 5.0 era.

Abstract

Banking companies experienced fluctuations in average profitability during the 2019-2023 period. This study aims to analyze the effects of Capital Adequacy Ratio (CAR), Non-Performing Loan (NPL), Loan to Deposit Ratio (LDR) and Firm Size on profitability. The research employs a quantitative method using secondary data collected from the Indonesia Stock Exchange and Bank Indonesia websites. The population of the study includes banking sub-sector companies listed on the Indonesia Stock Exchange from 2019 to 2023. The sample was selected using a purposive sampling technique, resulting in 20 companies as the sample. Hypothesis testing was conducted using multiple linear regression analysis with the assistance of the Statistical Package for the Social Sciences (SPSS) software. The findings reveal that the Capital Adequacy Ratio (CAR) and Firm Size (FS) have no effect on profitability, while Non-Performing Loan (NPL) and Loan to Deposit Ratio (LDR) significantly influence profitability.

Abstract

Penelitian ini membahas perlindungan hukum dalam penyelesaian masalah lingkungan berkelanjutan di Indonesia, dengan meninjau Undang-Undang No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup serta Paris Agreement sebagai instrumen hukum internasional. Fokus utama penelitian ini adalah menganalisis efektivitas regulasi dalam mencegah dan menangani dampak lingkungan yang ditimbulkan oleh kegiatan industri, termasuk melalui mekanisme perdagangan karbon sebagai salah satu solusi kebijakan. Penelitian ini menggunakan metode yuridis-normatif, dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach). Data diperoleh dari studi kepustakaan terhadap peraturan perundang-undangan, dokumen kebijakan, serta literatur ilmiah yang relevan. Hasil penelitian menunjukkan bahwa meskipun UU No. 32 Tahun 2009 telah mengatur tanggung jawab lingkungan bagi pelaku usaha, implementasinya masih menghadapi berbagai tantangan, seperti lemahnya penegakan hukum, kurangnya mekanisme insentif, serta keterbatasan pemantauan dan verifikasi lingkungan (MRV). Sementara itu, Paris Agreement mendorong upaya pengurangan emisi global, termasuk melalui mekanisme perdagangan karbon, tetapi implementasi di Indonesia masih terbatas karena regulasi yang belum matang serta rendahnya partisipasi industri dalam skema ini.

Abstract

The local cattle crossbreeding program with exotic cattle was developed as a result of the high demand from farmers for artificial insemination of exotic cattle. The number of local cattle is expected to decline over time and may be threatened with extinction. These artificial inseminations have been distributed through ordering, direct sales and distribution systems. The problems are (1) How is the mechanism of the sale and purchase transaction of artificial insemination seeds in cattle carried out in sharia? (2) What is the view of Sharia Economic Law on the practice of buying and selling artificial insemination seeds in cattle? The type of this research is qualitative with a field approach (Field Research), the data collection methods used are observation, interview, and documentation methods. The results of this study are (1) The mechanism of the practice of buying and selling artificial insemination seeds in cattle has been running in sharia is known to use tabarru` contracts based on service turnover, namely the wakalah contract that the mechanism of buying and selling artificial insemination practices only focuses on operational payments for orderlies' services in helping and helping farmers. (2) The view of sharia economic law on the practice of buying and selling artificial insemination seeds in cows using a tabarru` contract based on the replacement of the services of the wakalah contract which contains elements of help, so that this buying and selling practice is permissible according to the principles of sharia economic law, namely the benefit of hajjiyah.

Abstract

Indonesia as a democratic country that emphasizes the rule of law as the main foundation, makes Pancasila as the moral and philosophical foundation for the constitution and laws and regulations. This research aims to evaluate the consistency of Government Regulation Number 28 Year 2022 on the Management of State Receivables with the principles of Pancasila, as well as to assess the extent to which its practical implementation reflects the moral and philosophical values of Pancasila. The method used in this research is juridical-normative with a conceptual and statutory approach, accompanied by qualitative descriptive analysis of relevant statutory documents and legal doctrine. The results of the analysis highlight the importance that Government Regulation No. 28 Year 2022 must comply with the existing legal hierarchy, as well as consistently reflect the principles of Pancasila as a moral and philosophical foundation in the regulation of state receivables. Nonetheless, the addition of new rules concerning liability for state receivables raises debates about consistency and social justice. Therefore, it is important for the government to ensure that the implementation of the rules not only considers the legal and financial aspects, but also the social and humanitarian impacts on the individuals involved. Success in regulating state receivables should be measured by the extent to which the principles of Pancasila are respected and social justice is realized in the process, which will help strengthen the foundations of democracy and the rule of law in Indonesia.

Abstract

The crisis of law formation and enforcement in Indonesia stems not merely from procedural shortcomings but from a deeper collapse in legal values and morality. This paper examines the relevance of legal philosophy, particularly through its ontological, epistemological, and axiological dimensions, in analyzing and reconstructing Indonesia’s legal system. Ontologically, law must be understood as an embodiment of society’s moral values, not merely a written statute; Bernard Arief Sidharta emphasizes that law expresses a nation’s fundamental values. Epistemologically, the Indonesian legal system remains overly positivistic and insufficiently reflective, as criticized by H.L.A. Hart through his concept of the internal point of view. Axiologically, the law must not only pursue formal legitimacy but must realize justice as a foundational value. Gustav Radbruch famously argued that in extreme cases, justice must prevail over legal certainty. It is within this philosophical framework that law can be reshaped to align with the ideals of Pancasila. The Pancasila principles, ranging from humanity to social justice, must form the ethical and normative foundation of all legal policies. This article affirms that legal philosophy is not only a tool for reflection but a normative framework to build a moral, just, and emancipatory legal order in Indonesia.
