Abstract

This study examines bribery as a specific form of corruption within the Indonesian legal framework, focusing on its juridical aspects and judicial practice. Bribery, as regulated in Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 on the Eradication of Corruption Crimes, constitutes a criminal act that undermines public trust, disrupts governmental integrity, and damages the state’s administrative functions. This research analyzes the legal elements of bribery, the scope of criminal liability, and the procedural mechanisms used in investigating and prosecuting bribery cases. Furthermore, the study reviews selected court decisions to evaluate judicial consistency, sentencing patterns, and the effectiveness of judicial reasoning in achieving deterrence. The findings indicate that, despite the existence of strong legal provisions, challenges remain in terms of proving intent, uncovering hidden transactional networks, and ensuring institutional independence in bribery cases. The study concludes that strengthening legal clarity, enhancing investigative capacity, and improving judicial transparency are crucial to increasing the effectiveness of law enforcement against bribery as a corruption offense.

Abstract

The recognition of de facto states remains one of the most contentious issues in contemporary international law, creating a complex web of legal ambiguities. This research examines the legal implications arising from the recognition or lack thereof of de facto regimes and its subsequent impact on diplomatic and consular relations. Using a normative legal research method with a statutory and conceptual approach, this study analyzes how the transition from de facto existence to partial or full recognition affects the application of the 1961 Vienna Convention on Diplomatic Relations and the 1963 Vienna Convention on Consular Relations. The findings suggest that while de facto states may exercise effective territorial control, their exclusion from the formal diplomatic community limits their ability to claim sovereign immunities and establish permanent diplomatic missions. Furthermore, this article explores the "legal gray zone" where states engage in "informal diplomacy" through representative offices that function similarly to consulates without formal recognition. The study concludes that the inconsistency in state practice regarding de facto recognition often subordinates legal clarity to political expediency, thereby challenging the stability of international legal frameworks and the protection of individuals' rights within contested territories.

Abstract

This study aims to develop an educational management model based on Recognition of Prior Learning (RPL) to support lifelong learning. RPL is an approach that acknowledges knowledge, skills, and competencies acquired through formal, non-formal, and informal learning experiences. In the context of modern education, the implementation of RPL requires a systematic, integrated, and policy-driven management strategy to enhance accessibility, flexibility, and relevance of education for diverse learners. This research employs a qualitative approach with a research and development (R&D) design, involving needs analysis, model design, expert validation, and limited implementation trials. The findings reveal that the proposed educational management model consists of several key components, including strategic planning, competency assessment and validation systems, adaptive curriculum management, institutional capacity building, and continuous monitoring and evaluation. The model effectively improves the recognition of learners’ competencies, broadens access to education, and strengthens the linkage between education and the labor market. In conclusion, the RPL-based educational management model provides an innovative solution for developing an inclusive, flexible, and sustainable education system that supports lifelong learning in the modern era.
