Abstract

Surah At-Thalaq verse 4 explains the iddah period for divorced women. However, the conception of the iddah period for menopausal women still prevails among the society. This research is focused on understanding the community's understanding of the conception of the iddah period for menopausal women in Surah At-Thalaq verse 4. Interviews are the primary means of data gathering in this qualitative approach. The results showed that people's understanding of the conception of the iddah period for menopausal women in Surah At-Thalaq verse 4 is still limited and sometimes misunderstood. Some respondents think that the iddah period for menopausal women is not needed because they cannot get pregnant anymore. However, additionally there are those who argue that the iddah period is still needed because it is a religious provision that must be followed. Therefore, there needs to be better socialization and education regarding the conception of the iddah period for menopausal women in Surah At-Thalaq verse 4 so that people can understand and practice it correctly.

Abstract

Malem Songo marriage  is a unique tradition that lives in the Tuban community, especially in Kedungharjo. The term Malem Songo refers to the 29th night of Ramadan which is believed to be a night full of blessings. This belief encourages tens to hundreds of couples in the region to hold a marriage contract simultaneously that night. This tradition has been passed down from generation to generation and has become an integral part of the cultural identity of the local community. This research is empirical with a qualitative approach and uses a philosophical framework as an analysis knife. Primary data was obtained through in-depth interviews with the perpetrators, officials of the Widang District KUA, and Kedungharjo community leaders. This article examines the Malem Songo marriage tradition  through the perspective  of natural law as  proposed by Thomas Aquinas. According to Aquinas, the law of nature is a manifestation of the lex aeterna (eternal law of God) which is imprinted in the universal order and guides man to his ultimate existential goal, which is true happiness (beatitudo) in union with the Creator. The findings of the study show that these traditions not only contain deep spiritual values, but also serve as a cultural mechanism to overcome customary constraints, such as weton mismatches. From the perspective  of natural law, this tradition reflects the embodiment of lex aeterna and lex naturalis, where human rationality is linked to divine wisdom. Therefore, Malem Songo marriage is  not solely seen as a socio-cultural practice, but rather as a concrete representation of universal moral principles such as rationality, justice, and the attainment of true happiness rooted in the theological dimension and eternal moral law.

Abstract

Abstract

The weton tradition in Javanese culture remains a significant cultural heritage that influences marriage decisions in various communities, including in Kepuh Kembeng Village, Lamongan. This study aims to analyze how local society responds to weton incompatibility in marriage and to what extent such cultural values affect their social life. The research employs a qualitative descriptive method, with data collected through observations and interviews involving community leaders, religious figures, and couples who experienced weton differences. The findings reveal that although weton is still respected, it is no longer viewed as an absolute barrier to marriage. Values of social harmony and collective deliberation serve as key social mechanisms that enable negotiation between cultural traditions and family interests. Using Talcott Parsons’ structural functionalism, the weton tradition is interpreted as a flexible symbolic system that functions to maintain social order rather than as a rigid normative constraint. This study contributes to the discourse on living law and enriches the understanding of the interplay between cultural tradition and religious values in contemporary Muslim Javanese society.

Abstract

The state bears a constitutional obligation to ensure equal access to public services, including marriage registration, for all citizens, including people with disabilities. However, in practice, the accessibility of marriage services at the Office of Religious Affairs (KUA) remains limited. This study aims to examine the inclusivity of marriage services for people with disabilities at four KUAs in Surabaya: Tambaksari, Sawahan, Semampir, and Wonokromo. Using a sociological jurisprudence design, this empirical study collected data through observation and in-depth interviews with KUA heads and penghulus (marriage registrars). The findings reveal significant disparities in physical and non-physical accessibility, with only the Sawahan KUA demonstrating minimal infrastructure readiness. Other KUAs still face structural barriers, a lack of assistive facilities, and the absence of sign language interpreters. In response, marriage registrars employ discretionary practices, such as non-verbal consent mechanisms and family-assisted communication, as survival innovations to ensure the validity of marriage procedures. However, these practices remain partial and non-standardized, potentially leading to legal uncertainty and unequal access to services. From a human rights and Islamic law perspective, these limitations reflect a gap between normative guarantees and empirical reality, particularly regarding the fulfillment of the principles of equality and non-discrimination. This study advocates a paradigm shift from a charitable to a rights-based approach, ideally supported by technical regulations, inclusive infrastructure, and institutional capacity-building, to ensure dignified and equal access to marriage services for persons with disabilities.
