Abstract

This articel discusses how the law and status of marriage differs from religion to child according to Islamic law and positive law in Indonesia. Beginning with a lot of polemics about the marriage of different religions and the status of her children. Especially when the government closed the gap through a Constitutional Court ruling and prohibited judges from accepting applications for registration of non-religious marriages. Then it is necessary to reconstruct the law in order to harmonize the Islamic law with the positive law as a solution to the problem. This type of research is empirical normative research with a juridical, normative and sociological approach. Technical data collection through literary studies and interviews with contemporary South Sulawesi scholars. The analysis technique used is qualitative analysis. The results of the study show that marriages between different religions are legally prohibited, while in Islamic law, contemporary scholars have a khilafist status. So, the form of recontextualization is; 1). The law of different religious marriages today in Indonesia should be permitted with a record in emergency, and marriage that has continued can still be cancelled but must take into account the condition of the child; 2). The marriage status of a child of a different religion can only be passed on to a parent of a new religion, except for a child from a marriage of different religion is permitted; 3. The rights of children from marriages of different religions must be fulfilled by the State and the people around them as well as children in general. The implication of this study is that the government should make changes to the Compilation of Islamic Laws which contains the provisions of marriage of different religions strengthened with the PERMA that contains guidelines for judges to approve marriages of different faiths of an emergency nature. As well as revoking SEMA No. 2 of 2023 for indicating discriminatory occurrences in society.

Abstract

Makalah ini membahas terkait bagaimana peran pengurus masjid masyarakat suku Bugis dalam mengelola masjid. Berawal dari fungsi masjid dewasa ini yang semakin sempit maka perlu adanya revitalisasi pengurus masjid sebagai pengelola untuk mengembalikan fungsi masjid sebagai pelopor utama peradaban umat. Revitalisasi ini bertujuan untuk meningkatkan pemberdayaan ekonomi umat sebagai solusi problematika dewasa ini. Jenis penelitian ini adalah penelitian kajian pustaka dengan menggunakan pendekatan Ilmu Tafsir dan Ilmu Antropologi. Serta melakukan kajian lapangan dengan melakukan wawancara kepada tokoh adat. Berdasarkan dari serangkaian tahapan penelitian tersebut. Peneliti dapat menghasilkan kesimpulan bahwa hasil revitalisasi peran pengurus masjid berbasis kearifan lokal melalui dakwah ekonomi kreatif dalam perspektif al-Qur'an adalah melahirkan program pemberdayaan ekonomi yang dikelola oleh pengurus masjid dengan bentuk kkonsep program ekonomi konsumtif dan ekonomi kreatif.. Implikasi penelitian ini yakni hendaknya pengurus masjid mengoptimalkan fungsi masjid sebagai pelopor utama pemberdayaan umat melalui program-program yang berbasis kearifan lokal.

Abstract

This study aims to examine the permissibility of charitable giving (ṣadaqah) in the context of political contests using the al-Umūr bimaqāṣidihā legal maxim approach. The phenomenon of political charity is often equated with money politics, sparking debate among scholars, government authorities, and the public. The discussion explores the concept of ṣadaqah in Islam and the role of intention (niyyah) as the foundation of legal rulings, based on al-Umūr bimaqāṣidihā and its derivative principles. This research employs a qualitative normative method through library research of classical and contemporary Islamic legal sources. The findings indicate that ṣadaqah during political contests is not inherently prohibited, but its legality depends heavily on the giver's intention. If the act is done sincerely for the sake of Allah’s pleasure, it is considered permissible. However, if it is meant to influence voters or gain political support, it is deemed unlawful. In conclusion, government regulations should not impose an absolute ban on political charity, but rather implement strict oversight to ensure that it aligns with sincerity and the principles of fair and honest elections

Abstract

Penelitian ini bertujuan untuk melihat perbedaan pendekatan Muhammadiyah dan Nahdatul Ulama sebagai organisasi masyarakat Islam terbesar di Indonesia terhadap krisis lingkungan. Metode penelitian yang digunaikan adalah teologi normatif syar’i dengan pendekatan fiqih siyasah, serta politik ekologi. Data primer diperoleh dari fatwah Majelis Tarjih Muhammadiyah dan Lajnah Bahtsul Masail NU tentang ekologi, kemudian data sekunder diperoleh dari jurnal, buku dan referensi lainnya yang dapat menjadi penunjang penelitian, serta dianalisis secara kualitatif studi pustaka. Hasil penelitian ini menunjukkan bahwa perbedaan mendasar pendekatan Muhammadiyah dan NU dalam merespon krisis lingkungan di Indonesia terletak pada sisi penerapan taqlid. Muhammadiyah yang berdasar pada analisis nash al-Qur’an dan Sunnah, sedangkan NU berdasar pada qauly. Adapun secara gerakan politik Muhammadiyah mengedepankan aspek regulasi normatif yang terkesan modernistik, sedangkan NU mengedepankan kemaslahatan ummat melalui penyebaran di pelosok yang terkesan tradisionalistik. Implikasi perbedaan pendekatan ini terdiri dari gerakan aksi, kbeijakan publik, swacana sosial keagamaan, dan pendidikan serta advokasi. Kesimpulan penelitian ini menunjukkan bahwa perbedaan yang terdapat di antara Muhammadiyah dan NU seyogyanya merupakan sebuah khazanah yang dapat menutupi setiap kekurangan di dalam kehidupan multikultural.

Abstract

This article aims to examine the stories in the Al-Qur'an from the perspective of Al-Qur'an science. Due to space limitations, this article will not discuss in depth the wisdom or lessons contained in each story. However, this article will reveal the general lessons, wisdom, or ibrah from these stories. The results of the study show that the stories in the Koran are often repeated with different emphases and editorials. Around 1,463 verses, or a quarter of the Koran, tell the stories of prophets and historical figures, such as Prophets Moses, Noah, Abraham and Yusuf. These stories are spread across various surahs and are often repeated to emphasize moral and spiritual lessons. Some stories, such as the Prophets Noah and Abraham, are repeated in many letters to connect Muslims with the traditions of previous prophets. The purpose and benefit of Qashash al-Qur'an is to provide lessons and wisdom from the stories of previous people, prophets, and pious people who can guide Muslims and humanity. These stories prove the power of Allah, strengthen the apostleship of the Prophet Muhammad SAW, and strengthen faith and steadfastness in preaching. Qashash al-Qur'an also teaches the creed of monotheism, the importance of knowledge, and provides warnings so as not to fall into error. In addition, these stories provide moral examples and practices that can be applied in everyday life, strengthening the belief that Muslims are a noble people and are given sharia according to their abilities.

Abstract

The global energy crisis, characterized by high dependence on fossil fuels, has created not only a challenge of availability but also a threat to sustainability. Islam views this issue within the framework of humans as khalīfah fi al-ard, who are entrusted with the responsibility to manage and preserve the earth. This study aims to reconstruct Islamic law, particularly fiqh al-bi’ah, as a normative and ethical foundation for renewable energy development in the face of climate change and resource depletion. Using a normative qualitative method with approaches of ushul fiqh, maqāṣid al-sharī‘ah, and contemporary analysis, the research draws from primary sources such as the Qur’an, Hadith, fatwa, and international energy reports, as well as supporting literature. The findings reveal that the continued use of fossil energy aligns with the concepts of isrāf (wastefulness) and ifsād fi al-ard (corruption on earth), thus contradicting the ethical principles of Islam. Meanwhile, renewable energy represents a manifestation of maslahah (public benefit), ‘adl (justice across generations), and amanah (trust), which are fundamental Islamic values. The study concludes that reconstructing Islamic law through maqāṣid and legal maxims such as lā ḍarara wa lā ḍirār provides a solid theological and ethical basis to support the transition from fossil fuels to renewable energy. This reconstruction can be applied at individual, institutional, and policy levels, ensuring that the transition is not only technically feasible but also aligned with Islamic principles of sustainability.
