Abstract

Medical waste management is the responsibility of individuals or organizations involved in activities that generate medical waste. Proper and systematic management is required for medical waste classified as B3 waste, encompassing all stages from processing to disposal. This research aims to investigate and evaluate the implementation of legal penalties for those who negligently dispose of medical waste. This study methodology employs normative legal research, utilizing primary legal sources derived from statute rules and secondary data obtained from library resources. This research employs both a legislative and conceptual approach, utilizing a perspective analysis method. Improper disposal of medical waste can harm the environment and may result in legal penalties. This sanction can be imposed by both judicial and extrajudicial dispute settlement processes. The judges' decision towards the defendant must be carried out as a civil penalty agreed upon by the defendant, and a request for enforcement can be made.

Abstract

Over the past ten years, the environmental law discourse has undergone a paradigmatic shift from a dominant approach of administrative and criminal nature to a stronger integration with civil principles. This transformation is driven by the increasing need for legal mechanisms that are not only repressive, but also restorative and preventive in accommodating the sustainable development agenda. This research aims to analyze the urgency and strategies for strengthening the civil aspect in the Indonesian environmental law system as an effective instrument in promoting ecological responsibility and intergenerational justice. Using normative juridical approaches and analysis of various court decisions, laws and regulations, and international instruments related to the environment, this study finds that civil aspects particularly civil liability, environmental compensation, and class action lawsuits have great potential in encouraging corporate accountability and expanding community participation. The growing practice of environmental litigation, both through citizen lawsuits and the principle of polluter pays, shows a tendency to strengthen the role of civil law in fighting for the right to a clean and healthy environment, as mandated in Article 28H of the 1945 Constitution. However, the effectiveness of the civil approach is still hampered by the limitations of judicial infrastructure, the uncertainty of ecological compensation norms, and the suboptimal role of judges in adopting international environmental law principles such as the precautionary principle and sustainable responsibility. Therefore, policy reformulation and institutional capacity building are absolute prerequisites in making civil law a strategic pillar in sustainable development.

Abstract

Every action taken by humans will always have consequences. If the action taken is a bad action and has an impact on others, then this action will result in sanctions. This results in the need for clear rules made by the government in a country, in order to create harmony in society in the nation and state. Indonesia, although it allows the death penalty for perpetrators of crimes stated in Article 11 of the Criminal Code, including corruption, in fact the death penalty is very rarely carried out in Indonesia, one of the reasons for the rare death penalty is that people still think about human rights. This study aims to analyze the death penalty for perpetrators of corruption of the Covid-19 pandemic funds in terms of human rights. This research is a juridical-normative type of research, namely legal research conducted by the method of reviewing library materials. Giving the death penalty to corruptors is very appropriate because it can be used as shock therapy because psychologically corruptors who are sentenced can be used as an example to influence other parties not to commit corruption. The results of the study revealed a discrepancy between the harsh legal basis and the commitment to human rights principles in the Indonesian legal system. In addition, the failure to apply the death penalty to corruptors of pandemic funds was influenced by various factors, such as the direction of legal policy taken by the government, pressure from the international community, and the low integrity of law enforcement officers. This study concludes that the threat of the death penalty has not been able to function effectively as a deterrent because it is not accompanied by consistent law enforcement. Therefore, this study contributes to the discourse on reforming corruption criminalization policies by emphasizing the need for a balance between the values of justice, humanity, and legal effectiveness.
