Abstract

This article seeks to explain Islamic thought related to the relationship between Acehnese Islam and Turkish Islam both through political and religious sectors that the author adopted as more dominant. The relationship between the two was harmonious even though it was said that Aceh and Turkey had such a long distance, so the argument about the harmonious relationship was so evocative of the treasure of thought to be followed up. This study aims to find out how the history of Thought relates to the Islamic Relations of Aceh and Turkey in Islamic politics. The method used in the study is a literature review (library research). So in this study the authors found that in the political field when the Kingdom of Aceh was in the Dutch colonial hegemony barrier, the kingdom of Turkey helped Aceh both from helping logistics related to military weaponry and even participated in sending troops to Aceh. Then, on the other side of the relationship with religion, the author found related to the jihad of the Acehnese people as a spirited and very tempestuous spirit naya in the Aceh war which is often told through the saga of the sabil war.

Abstract

Tan Malaka's economic politics are characterized by two separate terms: politics in the style of communism and economics in the style of socialism. These concepts represent resistance against the hegemony of capitalism in Indonesia, which, from a historical perspective, began to evolve into global capitalism following the Industrial Revolution. Tan Malaka sought 100% independence for the republic through a path of social revolution, advocating resistance and mass movements. Mass Action towards Social Revolution was seen as the final means to achieve complete independence, specifically in opposing the hegemony of imperialism, colonialism, and capitalism. Socialism was envisioned as a means to liberate the nation from foreign influence by eliminating social classes, thereby eradicating oppression, slavery, and capitalist exploitation.

Abstract

This article is motivated by the banking sector which is undergoing dramatic changes because the concept of interest has resulted in the inability of the community in economic matters and also eventually propagated to other orders of life, including social life, politics, and other fields in a country. The presence of Islamic banking in Indonesia has had a major impact on the economy of the community, because Islamic banking is not the concept of interest. This article uses a qualitative descriptive approach that is more specific to library research data. In this paper the authors produce that the politics of law as a policy to implement the objectives of the state, especially in the field of law on the law that will run, is running and has been applied that dimbil through the values in society to achieve the goals of the state. Furthermore, the implementation of Sharia banking law is carried out in stages in the early stages of Sharia banking regulation regulated in law Number 7 of 1992 by accommodating banks in the principle of profit sharing. Sharia banking regulation in the next stage is regulated in Law No. 10 of 1998 by implementing the Sharia principle Bank model. And in the end a new law was issued Law No. 21 of 2008 which regulates Islamic banks separately from conventional banks. Keywords: Politics, Law, Islamic Banking.

Abstract

This article is motivated by the sound of the 1945 Indonesian constitution Article 33 initiated by the founding fathers contains the philosophy of togetherness and the principle of family that is the cornerstone of the Indonesian economy. The realization of Islamic Economics in Indonesia has had a major impact on efforts to improve the economic life of the community, as well as provide education to the community in the economic system using a non-ribawi system. This article uses a qualitative descriptive approach that is more specific to the data of the library or library research. In this paper the author meghasilkan that Syar'i law khitab (decree) of God related to the act of mukallaf in the form of demands, choices and provisions and each claim contains taklif (legal burden) which in this case is human mukallaf. Furthermore, the 1945 Indonesian constitution Article 33 paragraph 2 is an important pillar in the development of economic law in Indonesia which determines, “the branches of production that are important to the state and that control the livelihood of many people are controlled by the state. So, in this paragraph is a constitutional mandate that should be run by the government. Keywords: Economy, Islamic Law, Positive Law.

Abstract

This research is motivated by Tan Malaka's political economy known by separate terms, namely communism-style politics and socialism-style economics. The concept of both is a resistance to the hegemony of capitalism in Indonesia, which in historical review is considered to have begun to transform into global capitalism after the industrial revolution. This research uses library data with a historical and biographical approach. This paper finds and produces that Tan Malaka wants 100% independence in this republic through the path of social revolution by means of resistance and mass movements. Mass action towards social revolution is the last way to achieve 100% independence in this case against the hegemony of imperialism, colonialism and capitalism. Socialism is here to free this nation from foreign shadows by erasing social classes so that there will be no more oppression, slavery, and exploitation of capital. Abstract

Riset ini dilatarbelakangi bahwa la dharara wa la dhirar adalah sesuatu hal yang berkenaan dengan perbuatan yang tidak boleh merugikan diri sendiri ataupun orang lain, sehingga oleh karenanya hukum tersebut sesuai dengan dalil syara’ yang menjadi suatu rujukan. Riset ini menggunakan pendekatan deskriptif kualitatif yang lebih khususnya kepada data kepustakaan atau library research. Penulis dalam riset ini menghasilkan bahwa dalam kaidah-kaidah fiqhiyah terdapat kaidah-kaidah al-khamsah, salah satu diantaranya adalah kaidah asasi keempat yaitu La Dharara Wa La Dhirar yang artinya tidak boleh merugikan diri sendiri ataupun orang lain. Redaksi sabda Nabi Muhammad Saw “La dharara wa la dhirara.” Ini berpola tidak tertentu (nakirah) dan berpola penafian (negativ), sehingga menafikan segala bentuk adh-dharar ataupun adh-dhirar, bagi yang khusus (merugikan seseorang tertentu) maupun umum ( merugikan orang banyak), baik secara perseorangan maupun kelompok, baik yang utuh maupun parsial, baik secara material maupun spritual. Selanjutnya, Penafian disini bererati larangan pasalnya adh-dharar dan adh-dhirar pasti terjadi di tengah masyarakat, akan tetapi tidak dizinkan syariat karena keduanya diharamkan.

Abstract

Every action taken by humans will always have consequences. If the action taken is a bad action and has an impact on others, then this action will result in sanctions. This results in the need for clear rules made by the government in a country, in order to create harmony in society in the nation and state. Indonesia, although it allows the death penalty for perpetrators of crimes stated in Article 11 of the Criminal Code, including corruption, in fact the death penalty is very rarely carried out in Indonesia, one of the reasons for the rare death penalty is that people still think about human rights. This study aims to analyze the death penalty for perpetrators of corruption of the Covid-19 pandemic funds in terms of human rights. This research is a juridical-normative type of research, namely legal research conducted by the method of reviewing library materials. Giving the death penalty to corruptors is very appropriate because it can be used as shock therapy because psychologically corruptors who are sentenced can be used as an example to influence other parties not to commit corruption. The results of the study revealed a discrepancy between the harsh legal basis and the commitment to human rights principles in the Indonesian legal system. In addition, the failure to apply the death penalty to corruptors of pandemic funds was influenced by various factors, such as the direction of legal policy taken by the government, pressure from the international community, and the low integrity of law enforcement officers. This study concludes that the threat of the death penalty has not been able to function effectively as a deterrent because it is not accompanied by consistent law enforcement. Therefore, this study contributes to the discourse on reforming corruption criminalization policies by emphasizing the need for a balance between the values ​​of justice, humanity, and legal effectiveness.

Abstract

Law Number 1 of 1974 on Marriage explicitly adheres to the principle of monogamy as stated in Article 3 paragraph (1). However, paragraph (2) of the same article provides an exception by allowing polygamy under certain conditions, raising the impression of normative inconsistency. This research focuses on analyzing the existence of the monogamy principle in relation to the practice of polygamy from the perspective of legal politics. The study employs a normative juridical method with statutory, conceptual, and historical approaches. The findings indicate that, from a legal standpoint, polygamy is not entirely contradictory to the monogamy principle as long as it complies with legal requirements, namely: (1) the wife is unable to fulfill her marital duties, (2) the wife suffers from a physical disability or incurable disease, or (3) the wife is unable to bear children. Beyond these conditions, polygamy is not justified and is considered contrary to the principle of monogamy. From a legal-political perspective, monogamy remains the primary principle, while polygamy is recognized only as a limited exception. Furthermore, in the Civil Code, monogamy is absolute, and violations may be subject to criminal sanctions under Article 279 of the Indonesian Penal Code. Thus, polygamy practiced outside the legal framework may be deemed a violation of the monogamy principle.

Abstract

This study analyzes the legal certainty of Tarim cream under Consumer Protection Law and maqashid sharia principles. Tarim cream has gained popularity, particularly through social media promotion by religious influencers, despite lacking official BPOM and halal certification from BPJPH. This normative legal research employs a statutory and Islamic legal approach grounded in maqashid sharia. The findings reveal that Tarim cream violates consumer rights, particularly those related to safety, information transparency, and honest marketing. From the sharia perspective, the product potentially harms the five fundamental objectives of Islamic law: protection of religion, life, intellect, wealth, and lineage. This study underscores the need for stronger regulations and public education to ensure the circulation of halal and safe products in Indonesia. It contributes to strengthening consumer protection frameworks in the halal industry and emphasizes the importance of maqashid-based consumer awareness.
