Abstract

This research examines the process of proving an ijārah 'ala al-'amāl contract and the effectiveness of sanctions applied by the Badan Kepegawaian Aceh. The method used is an empirical legal approach in which data is collected from primary sources such as interviews, observations, and focus group discussions. Secondary data is collected from secondary sources such as books, journals, and other resources related to this research. The findings show that the sanctions applied have not been fully effective in tackling arrears. This research is important because the sanction policy of Badan Kepegawaian Aceh needs to be evaluated in order to improve the supervision and enforcement of employee discipline, as well as to ensure that the application of ijārah 'ala al-'amāl is in accordance with applicable principles. The level and type of sanctions for default are listed in Government Regulation No. 94 of 2021 on the Discipline of Civil Servants. Meanwhile, defaulting employees are subject to a series of disciplinary enforcement procedures. The first step is a warning in the form of a summons to provide information about the absence. If the employee fails to comply with the summons, a follow-up summons will be issued. If the employee still refuses to comply, disciplinary action will be taken. The first disciplinary action will usually be a light sanction. This serves as a warning and encouragement to comply with attendance and work discipline rules. However, if the employee still repeats the offence or commits another offence, moderate or more severe sanctions will be imposed. These include sanctions such as deduction of TTP, demotion, delayed salary increases, or even dismissal, depending on the policy and the level of offence committed.

Abstract

PT PNM Mekaar Syariah is an institution engaged in sharia financial services that provides financing in the form of capital to support business actors in developing their businesses. Even if the business fails, customers are still required to repay their loans. This study aims to determine the implementation, obstacles, and efforts in applying sharia principles to micro, small, and medium enterprise financing at PT PNM Mekaar Syariah Blang Mangat. This research is a qualitative study using a legal-empirical approach with a descriptive nature. The research data used are sourced from primary and secondary data. Primary data were obtained from observations and interviews, while secondary data were obtained from books, articles, and relevant scientific publications. The research data was systematically organized, beginning with data reduction, data presentation, and conclusion drawing. The research findings revealed that the implementation of Sharia principles and contracts by PT PNM Mekaar Syariah Blang Mangat Branch has not fully adopted Sharia principles, as evidenced by its operational practices not fully adhering to the murabahah system. The obstacles encountered by customers are that they often choose financing not for business purposes but for personal needs. This can lead to various challenges such as late payments, increased personal expenses, and difficulties in managing customer business operations. Efforts made include actively monitoring customers to detect potential late payments or defaults early on.

Abstract

Bullying adalah tindakan yang melibatkan penggunaan kekerasan fisik, verbal atau emosional secara berulang terhadap seseorang yang kurang berdaya. Tindakan bullying dapat terjadi di berbagai lingkungan, salah satunya adalah sekolah. Dampak perilaku ini merugikan bagi individu terutama anak yang berakibat jangka panjang. Undang-Undang Nomor 35 tahun 2014 tentang Perlindungan Anak mengatur bahwa undang-undang melindungi anak dari berbagai bentuk kekerasan termasuk bullying, serta undang=undang ini sangat melarang segala bentuk kekerasan terhadap anak. Pemerintah, orang tua dan masyarakat berkewajiban untuk melindungi anak dari segala bentuk kekerasan. Tim pengabdian masyarakat Fakultas Hukum Universitas Malikussaleh melaksanakan kegiatan pengabdian untuk memberikan edukasi bagi siswa SMPIT Bunayya untuk memberikan pemahaman hukum mengenai tindakan bullying serta mengatisipasi bahaya bullying di sekolah. Hasilnya menunjukkan bahwa setelah siswa memahami faktor yang mempengaruhinya serta mengembangkan kesadaran bahwa ada tindakan hukum yang bisa dilakukan untuk melindungi korban serta menghukum pelaku, siswa mendapatkan kesadaran bahwa Islam juga melarang keras perilaku bullying. Strategi yang efektif dibutuhkan untuk mengantisipasi perilaku ini akan muncul di masa depan. Sehingga kerjasama lebih lanjut antara sekolah dan Fakultas Hukum Universitas Malikussaleh dapat dilakukan dalam upaya aktif mencegah bullying di sekolah.

Abstract

Children has been increasingly vulnerable to a multitude of cybercrimes in Indonesia. These include alarming issues such as online grooming, sexual exploitation, cyberbullying, and identity theft. This situation not only presents significant legal challenges but also represents a profound ethical crisis within Indonesias evolving digital landscape. This article utilizes a normative juridical approach alongside a conceptual framework to articulate legal arguments surrounding these pressing concerns. While regulatory measures exist, such as the Electronic Information and Transactions (ITE) Law and the Child Protection Law, their enforcement remains fragmented and often inadequate to tackle the constantly changing nature of digital threats. The ethical dimensions of this crisis cannot be overlooked, as they intertwine with corporate responsibility, parental awareness, and systemic inaction. Such issues amplify the risks that children face online. This study asserts that the combination of legal deficiencies and ethical oversight creates a substantial protection gap that demands a coherent and interdisciplinary response. To effectively safeguard children in the digital age, it is crucial to strengthen institutional capacities, integrate digital literacy within educational curricula, and adopt child-centered approaches to digital governance. By doing so, we can work towards ensuring that the rights, dignity, and safety of children are prioritized and protected in Indonesia.
