Abstract

The use of e-commerce in trade has had a big impact on Indonesian society, especially in terms of very important legal issues. Legal protection in e-commerce is crucial to protect consumers who make buying and selling transactions via the internet. This development is driven by high demand and acceptance from the public, as evidenced by the emergence of various online stores such as Kaskus, Tokopedia, Bukalapak, Shopee, and Lazada. Rapid advances in technology have changed the method of buying and selling from physical stores to online transactions via the internet. E-commerce, as an information technology innovation, allows consumers to make transactions with just the touch of a finger without having to leave the house. However, the variety of e-commerce platforms available increases the potential for legal issues in online transactions. This research aims to understand how to legally protect consumers and help them if losses occur in e-commerce transactions. The method used is a normative approach, by reviewing literature and secondary data related to consumer legal protection in e-commerce transactions.

Abstract

This journal analyzes the legal aspects of default in a land title release agreement based on Court Decision Number 26/Pdt.G/2024/PN Sbr. The case involves the Plaintiff seeking compensation after Defendants PT Caruban Jaya Persada and two individuals failed to fulfill obligations in a land rights release agreement concerning parcels of land in Warugede Village, Depok Subdistrict, Cirebon Regency, valued at Rp3,311,182,000.00. The Defendants allegedly failed to make full payments and neglected other agreed terms, prompting the Plaintiff to file a claim under Article 1239 of the Indonesian Civil Code (KUH Perdata). This study employs a juridical analysis of legal documents, including the court decision and relevant legal provisions such as Article 1239 of the Indonesian Civil Code. Legal interpretation methods were used to assess the contractual dispute and its resolution. The court found the Defendants in default and ordered them to vacate the land and compensate the Plaintiff for financial losses incurred. The court's ruling emphasized the legal consequences of breaching contractual agreements, highlighting the enforceability of legally binding agreements under Indonesian civil law. The study concludes that Indonesian civil law provides robust protection for aggrieved parties in contractual disputes through Article 1239, ensuring that contract defaults lead to legally enforceable remedies. Adherence to contractual obligations is essential to avoid severe legal and financial consequences.

Abstract

Intellectual property rights are a system of modern life that is interconnected with the system that exists today. Intellectual property rights are a by-product of human ideas and thought patterns, so they are currently one of the complex problems that arise in the world of commerce. The aim of this research is to analyze the sociology of law in the circulation of trademarks in Indonesia. Analytical descriptive methods are used in research specifications to describe facts and realities relating to trademark law in Indonesia. The research results show that, within the framework of the rule of law, respect for trademark rights is a national honor given to individuals who have taken the time to consider developing original and distinctive works of intellectual property. Legal sociology has a role in violations that occur in trademark cases; apart from filing criminal and civil charges for failure to reach a resolution, there are other options to overcome existing problems. All parties must comply with certain requirements so that the conflict resolution process can be effective. Having a certificate is one of the components of feeling more comfortable running a business in the future. It is easier for trademark owners to demonstrate ownership rights to the trademarks they use, so they don't need to worry about their company if a lawsuit occurs. Based on the results of the analysis carried out, society, namely the private sector, must support intellectual property, including trademarks, by upholding corporate ethics that demand integrity in all business dealings. Strong business growth in terms of market share and product quality is a catalyst for economic expansion, raising living standards, and achieving economic development.

Abstract

Cyberbullying has become a significant social problem in Indonesia, especially among teenagers. With the increasing use of the internet and social media, cases of cyberbullying are increasingly being reported, causing negative impacts on victims, including psychological and social disorders. This study aims to explore the impact of cyberbullying in Indonesia and assess legal protection for victims in the context of the ITE Law and cyber law. The research method used is a qualitative approach with case study analysis, where data is collected through interviews with victims, parents, and legal experts, as well as analysis of relevant legal documents. The study found that many victims of cyberbullying experienced profound psychological impacts and felt less protected by existing regulations. Although the ITE Law provides a legal basis for dealing with cyberbullying, many cases are not followed up effectively. The need to increase public understanding regarding victims' rights and applicable legal provisions is one of the main recommendations.

Franchising has significant potential but also high risks due to trade secret violations. Law Number 30 of 2000 regulates trade secrets, but these violations can be detrimental to the party providing the secret. Research on the feasibility of establishing legal protection for trade secrets in franchise companies is crucial. This research aims to examine how franchise businesses have used trade secret legal protections. A qualitative methodology was used, and data collection techniques involved collecting relevant documents. The findings indicate that if trade secrets meet the criteria regulated in Article 1 Paragraph 1 of the Trade Secrets Law, they are entitled to legal protection. Abstract

In the context of toxic business competition, this research investigates the legal protection of Micro, Small, and Medium Enterprises (MSMEs) in Indonesia, particularly in partnerships with large corporations. The primary emphasis is on the implementation of Law Number 5 of 1999, which prohibits monopolistic practices and unfair business competition, and Law Number 20 of 2008, which pertains to small and medium-sized enterprises. Data was collected from literature studies, pertinent regulations, and in-depth interviews with relevant stakeholders using a qualitative approach and a case study design. The research results show that although the legal framework already exists, effective implementation still requires improvement. MSMEs face various challenges in partnerships with large companies, including access to resources and greater risks in business transactions. Recommendations are prepared to strengthen legal protection through regulatory revisions, strengthening legal institutions, legal education, developing partnerships, and stricter law enforcement. The main aim is to increase fairness in business relations between MSMEs and large companies, as well as support inclusive and sustainable economic growth in Indonesia. It is hoped that the implications of this research can provide a positive contribution in renewing policies that support the development of MSMEs as the backbone of the national economy.
