Abstract

Abstract In the life of a state that longs for a political justice, surely in the Basic Law or the Constitution in the country the inventor of his ideas and / or its founders have included a power sharing system that seeks to re ect political justice. If it must be connected with the form of the state, in fact this idea remains rooted in political justice. In the distribution of power, which according to John Locke is divided into legislative power, executive power, and judicial power, there must be authority that is balanced with each other and not overlapping. This was stated by John Locke so that power is not centralized within one institution, thereby reducing the risk of abuse and creating a democratic state. Abstract

The state is responsible for providing proper health services as stipulated in the 1945 Constitution of the Unitary State of the Republic of Indonesia, the government as the personification of the state is obliged to provide legal protection to patients. The protection in question is that the state explicitly establishes special laws for patients. Healthcare providers must be criminally responsible if there are mistakes and/or negligence in providing their services that cause the patient to experience harm, both physically and non-physically. Legal regulations that have been used as instruments to protect patient rights are considered ineffective because the ethical process for health care providers, in this case, doctors, takes a protracted time, so patients have already been convicted because they were accused of committing defamation, so it becomes a dilemma for patients to take legal steps against doctors who have committed malpractice and harmed patients. This study uses normative legal research methods with statutory approaches, legal concept approaches, and qualitative approaches to describe and produce descriptive data. The results of this study indicate that until now, there has been no regulation that specifically regulates the rights of patients so it is the state's responsibility for proper health services and should form special laws to protect the rights of patients.

Abstract

Narkoba tidak terlepas dari daerah wisata internasional sehingga berkontribusi terhadap kejahatan lokal, kemiskinan dan ketidaksetaraan sosial di komunitas setempat. Untuk meningkatkan pengetahuan masyarakat Kabupaten Toba, Sumatera Utara sebagai salah satu destinasi wisata internasional tentang narkoba dan akibatnya bagi masyarakat setempat, penyuluhan hukum narkoba dilakukan dengan metode partisipatif, menyampaikan materi yang berhubungan dengan narkoba dan diikuti dengan seri tanya-jawab. Pengetahuan peserta tentang narkoba meningkat baik dari sisi promotif maupun preventif. Penyuluhan hukum destinasi wisata internasional bebas narkoba meningkatkan pengetahuan masyarakat Kabupaten Toba baik promotif maupun preventif. Disarankan agar perangkat desa, Lembaga Swadaya Masyarakat Anti Narkoba dan Dinas Kebudayaan dan Pariwisata Kabupaten Toba tetap mengedukasi masyarakat tentang anti narkoba sehingga Kabupaten Toba terwujud menjadi destinasi wisata internasional bebas narkoba

Abstract

This article describes the results of anti-corruption legal counseling in Lumban Dolok Village, Silaen District, Toba Regency, North Sumatra. This counseling aims to raise public awareness about the dangers of corruption and the importance of integrity, by adopting Batak Na Raja cultural values that emphasize anti-corruption attitudes. Corruption is viewed from the perspective of Batak Na Raja as behavior that not only violates the law, but also the customs and morality of the Batak community. A person's motive for committing corruption is often related to economic needs, existing opportunities, and weak supervision. GONE (Greed, Opportunity, Need, and Exposure) and Fraud Triangle (pressure, opportunity, and rationalization) theories are used to analyze the motives and driving factors of corruption. This counseling emphasized that, in accordance with the values of Batak Na Raja, the Toba people are expected to uphold honesty, responsibility, and transparency. By understanding and internalizing these values, society is expected not only to reject corruption but also actively prevent it. This counseling succeeded in instilling an understanding that corruption damages social and economic order, and is contrary to the Batak philosophy of life that upholds honesty and honor. It is hoped that, through a cultural approach and intensive legal education, the Toba people can become the frontline in eradicating corruption, strengthening good governance, and realizing sustainable welfare in their region.

Abstract

Drug abuse continues to be a major concern that affects both individuals and society as a whole. In response, the Indonesian government has adopted a rehabilitative approach for drug users, as detailed in the Narcotics Law. Legal counseling is a vital component of this strategy, providing recidivists with essential knowledge about their rights and responsibilities during the rehabilitation process, especially at the Narcotics and Drug Rehabilitation Center (NARKOBA) in Lido, Sukabumi. These counseling sessions feature presentations on narcotics laws, the rehabilitation process, and interactive discussions to engage participants effectively. The success of legal counseling is evident in participant feedback, with 95% indicating a greater understanding of rehabilitation laws and increased confidence in their reintegration, while only 5% express uncertainty about their future. To evaluate its effectiveness, pre- and post-counseling interviews assess participants' understanding. This initiative not only promotes legal awareness and encourages active participation in rehabilitation but also helps to diminish the stigma surrounding drug rehabilitation, supporting a comprehensive approach to recovery

Abstract

The Regional People's Representative Council (DPRD) has an important role in forming local regulations (Perda) that reflect the needs of the community. However, in North Gorontalo Regency, the number of draft local regulations has decreased due to sectoral ego, lack of political communication with the local government, and limited derivative regulations from the center. Therefore, this study aims to analyze the relationship and influence of the implementation of DPRD's legislative function on the implementation of good governance principles in North Gorontalo District Government. This research uses quantitative methods with a population of 130,400 people and a sample of 400 respondents selected through probability sampling techniques. Data were analyzed using Jeffrey's Amazing Statistics Program (JASP) application. The results showed that there is a significant relationship between the implementation of DPRD's legislative function and the optimization of good governance in North Gorontalo Regency. DPRDs play a strategic role in ensuring that governance runs in accordance with the principles of democracy, transparency, accountability, effectiveness and efficiency. In addition, the influence of DPRD's legislative function can also be seen in efforts to improve the quality and quantity of legislative products to meet the priority needs of the community. Therefore, synergy between DPRDs and local governments needs to be improved through better political communication to reduce sectoral egos and ensure the implementation of good governance.

Abstract

Kekerasan dalam rumah tangga (KDRT) merupakan bentuk pelanggaran hak asasi manusia (HAM) yang signifikan dan kerap terjadi dalam ruang privat, terutama terhadap perempuan dan anak. Penelitian ini bertujuan untuk menganalisis faktor penyebab terjadinya KDRT serta mengevaluasi bentuk perlindungan hukum bagi korban KDRT dari perspektif HAM di Kota Bekasi. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode kualitatif-empiris, mengkaji peraturan perundang-undangan yang relevan, serta menganalisis data sekunder berupa laporan, literatur hukum, dan studi kasus. Hasil penelitian menunjukkan bahwa KDRT terhadap perempuan dan anak dipicu oleh faktor internal (emosi, ketimpangan relasi kuasa, kecanduan) maupun eksternal (kemiskinan, budaya patriarki, kurangnya akses pendidikan dan informasi). Meskipun Indonesia telah memiliki perangkat hukum seperti UU No. 23 Tahun 2004 tentang Penghapusan KDRT dan ratifikasi konvensi internasional seperti CEDAW, implementasi di lapangan masih menghadapi kendala berupa minimnya kesadaran hukum masyarakat, stigmatisasi terhadap korban, serta respons aparat penegak hukum yang belum optimal. Studi ini merekomendasikan penguatan institusi perlindungan seperti P2TP2A, peningkatan edukasi HAM, serta perbaikan mekanisme pelaporan dan pendampingan korban KDRT. Dengan pendekatan multidimensi yang melibatkan negara, masyarakat, dan lembaga internasional, perlindungan terhadap perempuan dan anak korban KDRT dapat ditingkatkan secara efektif, sejalan dengan amanat konstitusi dan prinsip-prinsip universal HAM.

Abstract

Abstract The Indonesian Suspension of Debt Payment Obligations (PKPU) framework, designed to prevent bankruptcy and provide debt restructuring opportunities, faces significant challenges, particularly in enforcing peace agreements post-homologation. This study investigates the legal implications of these challenges, with a focus on creditors’ rights, particularly for separatist creditors holding security interests. The research aims to identify the procedural and legal gaps that hinder the effective enforcement of peace agreements and propose recommendations for improving the PKPU system. The research method used is a qualitative approach with a case study method. Data were collected through in-depth interviews, field observations, and document analysis, focusing on judicial practices, legal interpretations, and the experiences of creditors and debtors involved in the PKPU process. The findings reveal critical issues such as the lack of a coercive enforcement mechanism, judicial inconsistencies, and the legal ambiguity surrounding the remedies available to creditors when debtors breach peace agreements. The study highlights the need for a more structured enforcement process, clearer guidelines for creditor rights, and enhanced legal protections for secured creditors. Policy recommendations include introducing automatic enforcement mechanisms, refining judicial procedures, and improving creditor participation in the debt restructuring process to ensure greater legal certainty and fairness..".
