Abstract

This research is to respond to the problem of land disputes in the issue of land boundary designation and inheritance distribution in the community of Maru Village, which prefers to resolve land dispute problems using local wisdom patterns as a form of settlement through non-litigation channels and applicable in the Maru Village community Because according to the village community, accommodation using local wisdom patterns is more effective, the settlement process is more straightforward and more practical. This study aims to describe the types and characteristics of land disputes in the last five years and dispute resolution efforts based on alternative dispute resolution (ADR) based on local wisdom. The problem in this study is the characteristics of law in the local knowledge of the Maru community. The chosen approach is a variation between normative and empirical research, so the historical, conceptual, philosophical, and case techniques are preferred. The method offered as a form of alternative dispute resolution (ADR) is an effort to resolve using customary traditions and customary law of Maru Village, namely Hari. The resulting research results are the settlement process using customary law and local wisdom in Maru Village in the field of law, especially land and inheritance cases in the form of settlement efforts in the form of adjudication, conciliation, and customary law, namely Hari, which will undoubtedly have an impact on reducing (litigation lawsuits) because non-litigation settlements have been carried out with the ADR model

Abstract

Spatial planning is one of the elements to realize a harmonious life. Spatial planning can be guided by national law and local wisdom. The purpose of this study is to determine and analyze the implementation of spatial planning in Kampung Adat Bena based on local wisdom. In addition, this study aims to determine and analyze the correlation between the implementation of spatial planning in Kampung Adat Bena based on local wisdom with regulations governing spatial planning. This research is an empirical legal research with the approach of legal sociology, legal history, and legislation. The results show that the implementation of spatial planning in Kampung Adat Bena based on local wisdom consists of a planning process, implementation of plans that produce components or areas, as well as prohibitions and sanctions based on local wisdom values adopted by the community. The value of local wisdom such as mutual cooperation, togetherness, justice, benefits, environmental balance, and harmony between Ga'e Dewa and indigenous peoples through the intermediary Ine Ebu. In addition, there are several components in the implementation of spatial planning in Kampung Adat Bena based on local wisdom that have a correlation with laws and regulations on spatial planning. However, the implementation of spatial planning in Kampung Adat Bena based on local wisdom also has several characteristics that are different from those regulated in the laws and regulations on spatial planning.

Abstract

The increasing population density often leads to differences in views that can eventually trigger disputes, including disputes related to land. Based on the increasing population level, of course the need for land as a place to live and make a business is getting narrower because the land has been controlled by other communities, while other communities also need land to carry out the same activities, this is where the dispute occurs. The method used in this research is empirical juridical research. The results show that the characteristics of dispute cases that occur in Oel'ekam Village include inherited land disputes, customary land disputes and land boundary disputes. The form of local wisdom in the Oel'ekam Village community is oko mama and the advantages of this alternative resolution are that the settlement is quickly realized, low cost, confidential and unemotional while there are also weaknesses, namely the execution mechanism which is difficult because the way to execute the decision, depends on the good faith of the parties to resolve the dispute to completion and the mediator will not bring good results especially if insufficient information and authority is given to him.

Abstract

The purpose of this study is to comprehensively describe and analyze the regulation of land ownership from both national law and customary law perspectives in the context of land inheritance in Lewa District, East Sumba Regency. The research method employed is a normative-empirical legal approach based on library studies. The normative approach involves the review of primary legal sources such as the Basic Agrarian Law and related regulations, while the empirical approach examines secondary data sourced from scientific literature, accredited national journals, customary law documents, mediation archives, and documented local news. Data collection was conducted indirectly through systematic documentation studies and literature reviews, without direct field observation. Data analysis was carried out qualitatively using a descriptive-analytical approach. The analysis process included data reduction by selecting relevant information regarding land ownership regulations according to national and customary law, presentation of data in a systematic thematic narrative, and in-depth analysis linking legal theory, customary norms, and conflict resolution practices as reflected in mediation documents and news sources. Conclusions were drawn based on a comprehensive interpretation of the analyzed data to address the research problems thoroughly. The results indicate that customary law still plays a significant role in resolving inheritance land disputes in East Sumba by emphasizing kinship values and consensus deliberation. However, national law is also important as a final recourse when customary resolution fails. The ideal integration is a synergy between customary and national law with official recognition of customary decisions and national legal protection, enabling land disputes to be resolved fairly and sustainably.

Abstract

This study discusses the practice of land pawning (Gerang Ekan) in the Adonara community, East Flores, and analyzes it from the perspective of national law and customary law. Land pawning is a form of traditional financial transaction that is still practiced by many indigenous peoples as an alternative to meeting economic needs, especially for those who find it difficult to access formal financing. This study uses empirical research methods with historical, legislative, and legal sociology approaches. The results of the study show that the practice of land pawning in Adonara often takes place without a clear time limit and prioritizes the principle of kinship, in contrast to the provisions of Law Number 56 of 1960 and UUPA Number 5 of 1960 which limit the period of mortgage of agricultural land to a maximum of seven years. The legal problems that arise include injustice in the distribution of revenues, uncertainty of land rights, and potential extortion. Despite this, the local community views this practice as a form of solidarity and mutual help. This study recommends the need for harmonization between national law and customary law to provide legal certainty and fair protection for all parties involved in land pawn transactions in customary territories.

Abstract

Penelitian ini bertujuan untuk mengkaji praktik peralihan hak atas tanah melalui hibah tanpa akta otentik di Desa Deno, Kecamatan Lamba Leda Selatan, Kabupaten Manggarai Timur, pada era tahun 1980-an. Pendekatan yang digunakan adalah yuridis empiris, dengan metode deskriptif analitis, yang bertujuan memahami realitas hukum di lapangan serta membandingkannya dengan ketentuan hukum positif yang berlaku saat itu. Data diperoleh melalui studi kepustakaan, dokumentasi, dan observasi langsung, kemudian dianalisis secara deskriptif-kualitatif. Hasil penelitian menunjukkan bahwa praktik hibah secara lisan dan berdasarkan hukum adat masih dominan, yang berisiko terhadap ketidakpastian hak dan munculnya sengketa di kemudian hari. Temuan ini menggarisbawahi pentingnya penegakan prosedur formal berupa pembuatan akta otentik dan pendaftaran tanah untuk menjamin kepastian hak serta perlindungan hukum masyarakat.

Abstract

Tulisan ini hadir untuk mengkaji secara mendalam masalah implementasi asas keadilan harusnya mencakup seluruh wilayah Indonesia, sesuai yang diamanatkan Sila kelima, Pancasila.Dalam hal ini penulis berfokus pada satu kasus di Kenari, Desa Warloka, Kecamatan Komodo, Kabupaten Manggarai Barat, Nusa Tenggara Timur (NTT) yang merupakan tempat dilangsungkan proyek Embung, yang sekarang sudah beroperasi sebagai tempat wisata, tetapi karena tidak adanya kepastian ganti kerugian sesuai kesepakatan kepada masyarakat dalam hal ini pemilik tanah, dimana ganti rugi lahan warga yang belum dibayar sampai sekarang mengakibatkan munculnya konflik dan ketidakadilan. Menggunakan penelitian hukum normatif dengan melibatkan analisis literatur atau data sekunder.Jenis penelitian ini juga dikenal sebagai penelitian doktrinal. Adapun bahan hukum tersier berfungsi sebagai penuntun navigatif yang menjembatani pemahaman atas bahan hukum primer dan sekunder, sekaligus memperluas cakrawala interpretasi hukum secara sistematis. dianalisis secara kualitatif dengan mengkaji temuan penelitian.Tujuan analisis data kualitatif adalah untuk memperoleh pemahaman yang lengkap tentang suatu situasi dan mengembangkan teori mengenai konteks sosial tertentu. Proses pengadaan tanah bagi pembangunan Embung Anak Munting di Desa Warloka, Kecamatan Komodo, Kabupaten Manggarai Barat menunjukkan beberapa penyimpangan mendasar yang mencerminkan pengabaian terhadap hak konstitusional masyarakat atas kepemilikan tanah serta perlindungan atas kepentingan sosial-ekonomi warga terdampak.
