Abstract

The coastal strip is one of the elements regulated in the regulation of spatial planning. The coastal strip is also a protected area of local protection type. However, there are still many people who do not pay attention and comply with the status of the coastal boundary area and the regulations governing the coastal boundary. One of them is done by the people of Kampung Wuring because they have used the coastal boundary for settlements. Therefore, this research discusses how the regulation of the coastal boundary in the Regional Regulation of the RTRW of Sikka Regency, how law enforcement against the use of the Wuring coastal boundary in Sikka Regency, and what environmental impacts are caused by the use of the Wuring coastal boundary in Sikka Regency. This research is a type of empirical legal research with qualitative data analysis method. The conclusion of this research is that Wuring Village is one of the locations designated as a coastal border area of Sikka Regency based on the Regional Regulation of Sikka Regency RTRW. However, in its implementation, the use of the Wuring coastal boundary is more focussed on residential activities. The Wuring coastal boundary follows the national legal regulation of 100 metres from the highest tide point inland. The area has been filled with houses, and the houses even protrude further into the sea. It is also known that the law enforcement implemented by the local government on the use of the Wuring coastal boundary is in the form of building restrictions. The use of the Wuring coastal boundary also causes impacts on the environment consisting of robb flooding, abrasion, pollution due to waste, pollution due to garbage, mangroves are decreasing, and coral reefs are damaged.

Abstract

Indigenous peoples have characteristics in every activity. One of the characteristics in the life of indigenous peoples, especially the indigenous people of the Lamaholot tribe, is the customary judicial institution of the Lamaholot tribe. The purpose of this study is to determine and analyse the description of the Lamaholot customary judicial institution and the role of the Lamaholot customary judicial institution in resolving customary violations during murung keneber. This research is an empirical legal research with primary and secondary data. The data were collected through interviews and literature study. The results obtained are that there is a customary judicial institution of the Lamaholot tribe that has a role in resolving customary violations during murung keneber (planting season). This institution prioritises peace and recovery efforts (mela sare). The process of resolving customary violations through the Lamaholot customary justice institution is guided by Lamaholot customary law which still believes in the power of Dewa Rerawulan Tanaekan (God) and Ama Opo Koda Kewokot (ancestors). The settlement of customary violations through the Lamaholot customary judicial institution in Leworahang, Ile Padung Village is carried out by the belen suku onen (tribal chief) Raja Tuan who is the four major tribal parts in the Lamaholot tribe consisting of the koten, kelen, hurit and maran tribes, witnessed by belen suku onen from other tribes in the village/lewotana, and attended by ata nalan (the offending party). The Lamaholot customary justice institution plays a role in resolving customary offences. The settlement has a distinctive feature because the Lamaholot customary justice institution carries out the settlement of customary violations through traditional ceremonies (loge towe tonu wujo). It is expected that the indigenous people of the Lamaholot Tribe will maintain the characteristics of the Lamaholot Tribe's customary judicial institution so that it remains effective in resolving customary violations.

Abstract

The purpose of this study is to comprehensively describe and analyze the regulation of land ownership from both national law and customary law perspectives in the context of land inheritance in Lewa District, East Sumba Regency. The research method employed is a normative-empirical legal approach based on library studies. The normative approach involves the review of primary legal sources such as the Basic Agrarian Law and related regulations, while the empirical approach examines secondary data sourced from scientific literature, accredited national journals, customary law documents, mediation archives, and documented local news. Data collection was conducted indirectly through systematic documentation studies and literature reviews, without direct field observation. Data analysis was carried out qualitatively using a descriptive-analytical approach. The analysis process included data reduction by selecting relevant information regarding land ownership regulations according to national and customary law, presentation of data in a systematic thematic narrative, and in-depth analysis linking legal theory, customary norms, and conflict resolution practices as reflected in mediation documents and news sources. Conclusions were drawn based on a comprehensive interpretation of the analyzed data to address the research problems thoroughly. The results indicate that customary law still plays a significant role in resolving inheritance land disputes in East Sumba by emphasizing kinship values and consensus deliberation. However, national law is also important as a final recourse when customary resolution fails. The ideal integration is a synergy between customary and national law with official recognition of customary decisions and national legal protection, enabling land disputes to be resolved fairly and sustainably.

Abstract

Village Regulations play an important role in regulating the lives of village communities so that they are more directed, fair, and in accordance with local needs. However, many village governments still experience obstacles in its preparation, especially in terms of legal procedures and community participation. This community service activity was carried out in Sunsea Village with the aim of providing training and technical assistance to village officials, BPD, and community leaders regarding methods of drafting Village Regulations in accordance with laws and regulations. Activities were carried out through a participatory approach with lecture methods, group discussions, and simulations of drafting Perdes. The results of the activity showed an increase in participants' understanding of the formal and technical procedures for drafting Perdes. This activity is expected to improve the quality of village legal products in Sunsea Village.

Abstract

Perjanjian bagi hasil merupakan perjanjian antara pemilik tanah dengan penggarap untuk menyelenggarakan usaha pertanian diatas tanah pemilik serta membagi hasil antara kedua pihak. Meskipun telah diatur dalam UU Nomor 2 Tahun 1960 tentang Perjanjian Bagi Hasil, namun masyarakat adat tertentu seperti masyarakat adat Desa Runut Kabupaten Sikka masih berpedoman pada hukum adat dalam melaksanakan perjanjian bagi hasil yang disebut lelen. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis pelaksanaan sistem lelen berdasarkan hukum adat di Desa Runut serta untuk mengetahui dan menganalisis perbandingannya dengan pengaturan perjanjian bagi hasil dalam peraturan hukum nasional. Penelitian ini merupakan jenis penelitian hukum empiris. Hasil penelitian menunjukan bahwa terdapat sistem lelen yang berpedoman pada hukum adat dan dilaksanakan di Desa Runut. Lelen dilaksanakan dengan beberapa tahapan yakni: penyampaian permohonan, survei lokasi, musyawarah perjanjian, pelaksanaan lelen, panen, dan pembagian hasil. Selain itu terdapat perbedaan mendasar antara sistem lelen berdasarkan hukum adat di Desa Runut dengan ketentuan yang diatur dalam UU Nomor 2 Tahun 1960 tentang Perjanjian Bagi Hasil. Perbedaan tersebut mencakup: bentuk perjanjian, keterlibatan Kepala Desa dan para saksi, pengesahan perjanjian oleh Camat, jangka waktu perjanjian bagi hasil, pemutusan perjanjian bagi hasil, sistem pembagian hasil, jenis sanksi, dan pelaksanaan ritual hukum adat.

Abstract

Tulisan ini hadir untuk mengkaji secara mendalam masalah implementasi asas keadilan harusnya mencakup seluruh wilayah Indonesia, sesuai yang diamanatkan Sila kelima, Pancasila.Dalam hal ini penulis berfokus pada satu kasus di Kenari, Desa Warloka, Kecamatan Komodo, Kabupaten Manggarai Barat, Nusa Tenggara Timur (NTT) yang merupakan tempat dilangsungkan proyek Embung, yang sekarang sudah beroperasi sebagai tempat wisata, tetapi karena tidak adanya kepastian ganti kerugian sesuai kesepakatan kepada masyarakat dalam hal ini pemilik tanah, dimana ganti rugi lahan warga yang belum dibayar sampai sekarang mengakibatkan munculnya konflik dan ketidakadilan. Menggunakan penelitian hukum normatif dengan melibatkan analisis literatur atau data sekunder.Jenis penelitian ini juga dikenal sebagai penelitian doktrinal. Adapun bahan hukum tersier berfungsi sebagai penuntun navigatif yang menjembatani pemahaman atas bahan hukum primer dan sekunder, sekaligus memperluas cakrawala interpretasi hukum secara sistematis. dianalisis secara kualitatif dengan mengkaji temuan penelitian.Tujuan analisis data kualitatif adalah untuk memperoleh pemahaman yang lengkap tentang suatu situasi dan mengembangkan teori mengenai konteks sosial tertentu. Proses pengadaan tanah bagi pembangunan Embung Anak Munting di Desa Warloka, Kecamatan Komodo, Kabupaten Manggarai Barat menunjukkan beberapa penyimpangan mendasar yang mencerminkan pengabaian terhadap hak konstitusional masyarakat atas kepemilikan tanah serta perlindungan atas kepentingan sosial-ekonomi warga terdampak.

Abstract

Land registration is an important activity that needs to be adhered to by the community because through land registration a certificate of land rights will be issued. The certificate is a proof tool that can provide protection and certainty to the land and the community as landowners. Land registration can also be carried out in all regions of the Republic of Indonesia. However, in certain areas there are still people who have not participated in registering their land. This can lead to agrarian conflicts because there is no proof of ownership / control over the land. The lack of land registration is also still found in the lives of people in Patawang Village, Umalulu District, East Sumba Regency. In response to these problems, it is necessary to conduct socialisation on land registration in Patawang Village. The aim is to increase the participation of the Patawang Village community towards land registration and encourage legal protection of land. The method used in this PKM is socialisation accompanied by discussion and questions and answers. In this activity, the PKM team conveyed information related to the legal basis of land registration, the definition of land registration, the importance of land registration, land registration organisers, the principles of land registration, land registration objects, land registration requirements, land registration stages, and the land registration system in Indonesia. Through socialisation activities, the community has an adequate understanding of land registration so that it can increase community participation in following land registration and realising legal protection of land.

Abstract

Pendaftaran tanah sistematis lengkap (PTSL) merupakan kegiatan yang penting bagi masyarakat untuk memperoleh sertifikat ha katas tanah dengan cara yang terjangkau. Namun dalam kenyataannya masih ada masyarakat di Kelurahan Manulai II yang belum sadar dan belum mendaftarkan tanahnya. Oleh karena itu Permasalahan yang ditangani dalam kegiatan ini terkait permasalahan kesadaran hukum dan pengetahuan masyarakat terkait pendaftaran tanah sistematis lengkap (PTSL). Berdasarkan permasalahan tersebut maka diselenggarakan kegiatan penyuluhan hukum tentang PTSL di Kelurahan Manulai II. Kegiatan ini bertujuan untuk meningkatkan kesadaran hukum masyarakat dan meningkatkan pengetahuan masyarakat terkait PTSL. Dalam kegiatan tersebut tim pengabdian kepada masyarakat menyampaikan informasi-informasi terkait PTSL yakni pengertian yuridis mengenai pendaftaran tanah dan PTSL, dasar hukum PTSL, objek PTSL, manfaat masyarakat mengikuti PTSL, pembiayaan dalam PTSL, dan tahapan pelaksanaan PTSL yang terdiri dari 12 tahapan. Kegiatan ini disambut baik oleh masyarakat Kelurahan Manulai II dengan turut hadir dan berpartisipasi dalam diskusi.

Abstract

This study aims to examine and analyse the existence of Woloara customary land law and to examine and analyse the use and utilisation of land by the Woloara indigenous community based on Woloara customary land law. This study is an empirical legal study using three approaches, namely the legislation approach, legal sociology, and legal history. Based on the research conducted, it is known that Woloara customary land law contains important elements, namely commands, permissions, prohibitions, and sanctions, which are also closely related to respect for Embu Mamo (ancestors) and Nggae (God). In the context of this study, the indicators used to analyse the existence of customary land law, particularly among the Woloara indigenous community, are divided into three main aspects, namely: objects, values, and sustainability. Woloara customary land law is still valid and exists in community life, particularly in the use and utilisation of land. This is marked by the permissions, commands, prohibitions, and sanctions created by the Embu Mamo in ancient times, which are still recognised, obeyed, and enforced in community life. This is also evident from the continued use of the same objects, values that are generally unchanged, and sustainability that has shown that elements of customary land law continue to be applied in land use and utilisation activities. Furthermore, based on the results of the study, it is known that customary land law serves as a guideline in the implementation of land use and utilisation, which results in various types of land use and utilisation, namely land use and utilisation based on subject, land use and utilisation based on land type, land use and utilisation based on area function, land use and utilisation based on type of activity, and land use and utilisation based on social status.
