Abstract

Intelligence is the knowledge, organization, and activities related to formulating policies, national strategies, and decision-making based on analyzing information and facts collected through work methods for early detection and warning to prevent, deter, and overcome threats to national security. Therefore, for accuracy in reading world political trends and other dimensions in the context of very rapid world change, the role of intelligence is crucial, especially in analyzing emerging threats (current threat trends) and formulating appropriate, contextual, and predictive strategies. These strategies are essential in responding to challenges in times that are changing and relatively uncertain (uncertain periods and conditions).

Abstract

Inflation is one of the non-military threats in the economic dimension, as stipulated in Presidential Regulation Number 8 of 2021 concerning the General Defense Policy of 2020-2024. The Ministry of Home Affairs plays a crucial role as a key component in non-military defense against the threat of inflation in Indonesia. This research aims to elucidate the role of the Ministry of Home Affairs as part of non-military defense in handling inflation to support national security of a country. The author employs a qualitative research method with data collection techniques including interviews, observations, literature review, and data analysis using an interactive model by Miles Huberman, Saldana (2014), and Bruce J. Cohen's Theory of Roles (1992). The research findings indicate that the Ministry of Home Affairs, as part of Non-Military Defense, has played an enacted role in concrete efforts to control inflation. In the context of National Security, these follow-up actions by the Ministry of Home Affairs can have implications for economic stability and the inflation rate to support or maintain national security of a country

Abstract

The sustainability of national economic development faces various non‑military threats such as global economic crises, financial system turbulence, and pandemics, which demand swift and extraordinary responses from the President as the holder of executive power under the 1945 Constitution of the Republic of Indonesia. In this context, presidential powers to determine and implement policies in emergency situations become strategically important, although explicit regulation of an “economic emergency” is not clearly found in the current statutory framework. This study aims to analyse the regulation and practice of presidential powers in determining and implementing an economic emergency under Indonesian constitutional law, and to formulate an ideal construction of such powers that remains consistent with the rule of law and the protection of citizens’ constitutional rights. This research employs a normative juridical method with statutory, conceptual, and case approaches, based on the 1945 Constitution, Government Regulation in Lieu of Law Number 23 of 1959 on State of Emergency, regulations on state finance in times of crisis, and literature on emergency constitutional law. The findings reveal a normative gap concerning parameters and limits of presidential powers in an economic emergency, which opens room for power expansion potentially undermining constitutionalism. This study proposes a model for the construction of presidential powers in an economic emergency that specifies indicators, procedures, temporal and material limits, and oversight mechanisms by other state institutions, ensuring that emergency powers are exercised within the framework of the rule of law.

Abstract

Penelitian ini meninjau pengaturan hak asasi manusia dalam pengaturan substansi Undang-undang Prp No. 23 Tahun 1959 tentang Keadaan Bahaya. Memang regulasi tersebut bukan merupakan regulasi utama dalam pengaturan HAM di Indonesia, namun eksistensi Undang-undang Prp No. 23 Tahun 1959 merupakan satu-satunya regulasi berbentuk Undang-undang utama yang dapat diberlakukan sebagai landasan yuridis pengaturan kondisi ketika negara dalam keadaan bahaya dan atau darurat sehingga tinjauan ini merupakan upaya dalam mendorong perumusan regulasi baru yang dapat dipergunakan sesuai dengan urgensi serta tetap dapat melakukan perlindungan terhadap hak dasar warga negara. Tujuan penelitian ini adalah untuk menganalisis titik letak ketidakcakapan Undang-Undang Prp No. 23 Tahun 1959 sebagai regulasi yang dapat diaplikasi dalam keadaan darurat negara terutama pada zaman sekarang, serta ketidakmampuan mengakomodir perlindungan HAM sebagaimana regulasi lainnya yang muncul setelahnya. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis normatif serta menitikberatkan pada fokus studi kepustakaan dan studi doktrinal. Data sekunder yang digunakan diambil dari studi-studi hukum yang khusus membahas bidang hukum serta ilmu hukum terutama berfokus pada bagaimana perlindungan atas penegakan HAM di Indonesia terutama dalam keadaan darurat negara. Adapun data sekunder tersebut terdiri bahan hukum primer, termasuk peraturan perundang-undangan dan regulasi lainnya. Kemudian ada bahan hukum sekunder, yang mencakup referensi dari bahan hukum primer yang relevan. Hasil penelitian menunjukkan bahwa regulasi hukum Indonesia dalam upaya perlindungan HAM secara dogmatik telah kuat, namun dalam implementatif serta aplikatif keadaan darurat negara, UU Prp No 23 Tahun 1959 memerlukan pembaruan yang dapat mengikuti perkembangan zaman, terlebih pada situasi sekarang ini dimana spektrum ancaman telah meluas tidak hanya bersifat konvensional namun juga non konvensional
