Abstract

In the election context, participatory supervision should be a necessary thing in the implementation of democracy to ensure that the political contestation agenda is not faced with various obstacles such as administrative violations, violations of political morality, and legal crimes. Therefore efforts to reconstruct the electoral agenda based on high participatory oversight need to be pursued ahead of the upcoming 2024 elections. The research results show that participatory supervision needs to be carried out using two approaches. The first is a formal approach by optimizing the role and function of the Bawaslu as an election regime institution that does not only act as a supervisor, but also as a breaker for administrative violations and violations of political morality. Second, extra-formal participatory supervision is held by the community as citizens who actually have political rights. Participatory oversight is very important to produce elections that are clean and not full of conflict and of course produce leaders with integrityDalam konteks pemilu, pengawasan partisipatif seharusnya menjadi hal yang niscaya dalam penyelenggaraan demokrasi untuk memastikan agenda kontestasi politik tidak dihadapkan dengan berbagai kendala seperti pelanggaran administratif, pelanggaran atas moralitas politik, hingga kejahatan hukum. Oleh karena itu upaya untuk kembali merekonstruksi agenda pemilu berbasis tingginya pengawasan partisipatif perlu diupayakan menjelang pemilu tahun 2024 mendatang. Hasil penelitian menunjukan bahwa pengawasan partisipatif perlu diusung dengan menggunakan dua pendekatan. Pertama adalah dengan pendekatan formal lewat pengoptimalan peran dan fungsi Bawaslu sebagai lembaga rezim pemilihan umum yang tidak hanya berperan sebagai pengawas, namun juga sebagai pemutus pelanggaran admistrasi dan pelanggaran moralitas politik. Kedua, pengawasan partisipatif secara ekstra formal dipegang oleh masyarakat sebagai warga negara yang sejatinya memiliki hak politik. Pengawasan partisipatif sangat penting untuk menghasilkan pemilu yang bersih, dan tidak sarat konflik serta tentunya menghasilkan pemimpin yang berintegritas

Abstract

Sistem merit merupakan prinsip fundamental dalam manajemen Aparatur Sipil Negara (ASN) yang bertujuan menjamin pengelolaan aparatur berdasarkan kualifikasi, kompetensi, dan kinerja secara objektif. Undang-Undang Nomor 20 Tahun 2023 tentang Aparatur Sipil Negara menegaskan pentingnya penerapan sistem merit melalui pengaturan fungsi pengawasan sebagaimana tercantum dalam Pasal 26 ayat (2) huruf d. Penelitian ini difokuskan pada pengkajian pengawasan penerapan sistem merit dalam manajemen ASN berdasarkan ketentuan tersebut dengan menggunakan perspektif siyasah dusturiyah. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pengawasan penerapan sistem merit merupakan perwujudan prinsip supremasi hukum dan akuntabilitas dalam penyelenggaraan pemerintahan. Dalam perspektif siyasah dusturiyah, pengawasan tersebut sejalan dengan prinsip ketatanegaraan Islam yang menekankan keadilan, amanah, dan kemaslahatan umum sebagai landasan penyelenggaraan kekuasaan. Oleh karena itu, pengawasan penerapan sistem merit memiliki kedudukan strategis sebagai instrumen hukum untuk menjamin profesionalitas ASN serta mencegah penyalahgunaan kewenangan dalam manajemen aparatur negara.

Abstract

Pendaftaran tanah merupakan instrumen strategis dalam menjamin kepastian hukum dan perlindungan hak atas tanah, namun dalam praktiknya masih terdapat banyak bidang tanah di Indonesia yang belum terdaftar, sehingga mendorong pemerintah melaksanakan program Pendaftaran Tanah Sistematis Lengkap sebagai upaya percepatan pendataan tanah secara menyeluruh. Penelitian ini bertujuan untuk menganalisis strategi Kantor Pertanahan Kabupaten Subang dalam meningkatkan pendataan tanah melalui program tersebut, mengidentifikasi kendala yang dihadapi, serta mengkaji implementasinya dalam perspektif Siyasah Dusturiyah. Penelitian ini menggunakan landasan teori berupa teori kepastian hukum, teori implementasi kebijakan publik serta konsep Siyasah Dusturiyah yang menekankan prinsip legitimasi (al-masyru’iyyah), kemaslahatan (al-mashlahat), dan keadilan (al-‘adalah) dengan metode penelitian yuridis empiris yang menelaah penerapan hukum dalam praktik melalui data lapangan, wawancara, dan dokumen resmi. Hasil penelitian menunjukkan bahwa strategi yang diterapkan meliputi pembentukan satuan tugas PTSL yang terstruktur, pendekatan partisipatif berbasis desa, pemanfaatan sistem informasi digital, serta sosialisasi komunitas dua arah, namun implementasinya masih menghadapi kendala berupa keterbatasan sumber daya manusia, fluktuasi target akibat kebijakan anggaran, serta permasalahan yuridis dan sosial di lapangan. Dalam perspektif Siyasah Dusturiyah, program ini memiliki legitimasi yang kuat karena sejalan dengan prinsip perlindungan harta (hifzh al-mal) dalam maqashid al-syariah.

Abstract

This study aims to examine the transformative leadership model implemented by a village head with a background as a former thug and its implications for the community empowerment process in Cikuya Village, Cicalengka District, Bandung Regency, Indonesia. Village leaders with non-conventional backgrounds are often perceived negatively and considered problematic in the context of village governance. However, in practice, such figures have the potential to bring about significant social change, particularly in village development and strengthening community participation. This study uses a qualitative approach with juridical-sociological methods to deeply understand the socio-political dynamics, leadership patterns, and the legitimacy of the village head's power from the perspective of constitutional law and Islamic values. Data collection techniques included in-depth interviews, participatory observation, and documentation, involving the village head, village government officials, community leaders, and residents of Cikuya Village as key informants. Data analysis was carried out using the siyasah dusturiyah theoretical framework as proposed by Ibn Taymiyyah, which emphasized that the legitimacy of leadership is not determined by a person's social background, but rather by the leader's capacity to carry out mandates, uphold justice, and create benefits for the wider community. Through this approach, research is expected to be able to reveal the process of social transformation from a thug figure to a formal leader who is recognized legally and socially. Apart from that, this research is also expected to show how leadership can form effective, responsive, and inclusive patterns, as well as to provide theoretical contributions to the study of village leadership and practical contributions to strengthening village governance.

Abstract

Constitutional Court Decision Number 87/PUU-XXIII/2025 concerning the minimum educational requirements for presidential and vice-presidential candidates has generated constitutional debate regarding the balance between democratic inclusiveness and leadership competency in Indonesia’s constitutional system. The decision rejected the petition seeking reinterpretation of Article 169 letter r of Law Number 7 of 2017 concerning General Elections, which requires candidates to possess at least a senior high school diploma or its equivalent. This study aims to analyze the juridical foundation of the Constitutional Court’s reasoning within the doctrine of open legal policy, examine its implications for constitutional loss and judicial review access, and evaluate the relevance of the minimum educational requirement from the perspective of siyasah dusturiyah. This research employs normative juridical methods with statute and conceptual approaches using constitutional regulations, court decisions, and Islamic political thought as primary analytical sources. The findings reveal that the Constitutional Court reaffirmed the doctrine of open legal policy and judicial restraint by emphasizing that the determination of educational qualifications for presidential candidates belongs to legislative authority as long as constitutional principles are preserved. The decision also strengthens the Court’s restrictive interpretation of constitutional loss by limiting judicial review access to applicants who can demonstrate direct constitutional injury. From the perspective of siyasah dusturiyah, however, the minimum educational requirement of senior high school graduation is considered substantively inadequate because it does not fully reflect the principle of kifayah ‘ilmiyyah emphasized by Al-Mawardi and may potentially undermine maslahah ‘ammah in contemporary governance. This study argues that leadership competency should be positioned as an important component of constitutional morality and public welfare within Indonesia’s constitutional democracy.
